CITY OF ELK RIVER
COUNTY OF SHERBURNE
RESOLUTION OF THE CITY COUNCIL VACATING STREET
In the matter of the vacation of that part of
the 50 foot public street dedicated and accepted
in that instrument dated December 31 , 1984, Piled
January 12, 1965, in the Sherburne County Recorder 's
Office as document No. 100566 which lies within
the boundaries of Lot 1 , Block 7, Barrington Place
according to the plat thereof Filed in Sherburne
County, Minnesota.
The above entitled matter came on to be heard before the
City Council of the City of Elk River, Sherburne County,
Minnesota, upon the petition of Gar—San Enterprises , Inc . ,
and upon motion of the City Council for the vacating of that
portion of the street above described and the City Council
having given due notice oP said hearing by published and
posted notice as provided by law and said hearing having
111 beeo held on the 5th day of January 1981,
at 8:00 o 'clock P.M. at the Elk River Public Library_
in the City of Elk River and the said Council after hearing
the evidence presented in favor of said Petition finds:
1 . That Petitioner, Gar—San Enterprises , Inc . , is the owner of
the land abutting said street to be vacated , and
2. Said portion of the street is not serving any public purpose
and it would be in the best interest of the public to vacate
the said portion of said street , and
3. That Councilman Toth introduced the following
Resolution , to—wit :
That that Part of the 50 Foot street dedicated and
accepted in that instrument dated December 31 ,
1964, Filed January 12, 1965, in the Office
of the Sherburne County Recorder as document
No . 100568 which lies within the boundaries
of Lot 7, Block 1 , Barrington Place according
to the plat on File and of record in the office
of the County Recorder in and for Sherburne County,
Minnesota, be and the same hereby is vacated.
-' 4. That said resolution was seconded by Councilman Duitsman
and being put to a vote was passed by a vote in favor of said
Resolution by the Council members in and for the Council of the
City of Elk River, Minnesota, whereupon said Resolution was
declared and adopted by the Mayor of said City.
