JOINT POWERS AGREEMENT
FOR COMMUNITY EDUCATION
THIS AGREEMENT, made and entered into this day of , 1978, by and
• between the Anoka-Hennepin Independent School District No. 11 (hereinafter called
School District who are parties hereto.
WITNESSTH:
WHEREAS, pursuant to the authority granted by M.S. 471.59 and M.S. 121.85 to 121.89,
the School District and several municipalities within said district entered into a Joint
Powers Agreement on September 13, 1971, to implement Community Education within the
participating communities, in order to provide recreational, educational and social
services to the citizens of all age groups, and
WHEREAS, the parties thereto desire to make certain changes in said agreement.
NOW, THEREFORE, it is agreed by and between the parties as follows:
1. Community Education Advisory Council: The membership of the Advisory
Council shall consist of the following:
one member shall be appointed by the governing body of each participating
• municipal governmental unit who employs a full or half-time Community
School Coordinator (which presently includes Anoka, Coon Rapids, Andover,
Champlin, Blaine, Ramsey, Dayton, Total Number- 7)
five appointed by Local Advisory Council
four appointed at Large (one Anoka-Ramsey Community College, one Anoka
Vocational Technical Institute; two appointed by the Council)
one appointed by the School Board
The Advisory Council shall perform an advisory function. Its major responsibility shall be
to:
a. Provide input into the decision making process.
b. Recommend policy as it relates to Community Education.
c. Give direction to the overall development of Community Education as it relates
to District No. 11.
The term of members and officers shall be for the calendar year. Members shall be
-eligible for reappointment. The Advisory Council shall elect its own officers, in addition,
shall adopt its own rules and procedures not inconsistent with the terms of the agreement.
2. Finance: Each year in concert with the budget process the Director of
Community Education shall recommend a budget to the Community Education
Advisory Council. This recommended budget shall be prepared in consultation
with the appropriate administrative officials of each of the governmental units
which are a party to this agreement. The budget shall set forth the proposed
program of activities to be provided on a school districtwide basis, and within
• each of the participating municipalities and shall be reviewed annually.
• Upon'the appropriate approval of the budget, each participating municipality will
transmit 1/12 of the approved amount to the School District each month. At the
end of each fiscal year the Community Education Advisory Board shall review
the funds expended in the previous year. Actual expenditures in a previous year
shall be the basis for adjusting a current year's monthly payments based on an
over or under expenditure of actual expenditures compared to the budget in the

prior year.
• At the end of each year the Director of Community Education shall prepare a
report of activities which were conducted in the previous year and submit this
report to the Advisory Council and to the parties to this agreement. The annual
report shall be in a form such that it can be compared to the proposed program
on which the annual budget has been prepared, realizing that flexibility in the
program is necessary as long as it is within the budget. The Advisory Council
shall have no taxing power.
The Advisory Council shall review and recommend the appropriate use of State
and Feder .l grldts in accordance with the State Guidelines and in concert with
the growth and development of Community Education in District No. 11.
3. Funding: School District responsibility. In order to encourage and facilitate the
growth and development of Community Education the School District will
provide:
- 30% of a full or part time Community School Director's salary.
- Supplementary benefits for all full time Community School Directors.
- Administrative cost.
• City Responsibility: In an effort to maintain a cooperative fund the city will
provide:
- 70% of a full or part time Community School Director's salary.
- Partial supplement for Youth activities.
- Cost of a Summer Program.
4. School and Park Facilities: Use of school facilities shall be in accordance with
the administrative handbook of the School District. Use of municipal facilities
shall conform to policies established by each governmental body.
Each governing body shall be responsible for the maintenance and repair of their
facilities. The Coordinator of Community Education shall bring to the attention
of the appropriate municipal or school official items in need of repair or
maintenance and a suggested time when the maintenance might be performed so
as not to disrupt programmed activities.
The construction of any new facilities shall be the prerogative and responsibility
of each governmental body.
In order to minimize duplication and thereby reduce costs, the parties are
encouraged to enter into supplementary maintenance agreements for each
project or facilities jointly used, taking into consideration sharing of staff and
equipment, rental of equipment, joint purchase of equipment, etc., for park
development and maintenance purposes.

5. Employees: All personnel under the Community Education concept shall be
• considered to be employees of the School District. They need not be certificated
teachers and shall bot be eligible for tenure.
The Director of Community Education shall serve as a full-time, year around
school staff member, directly responsible to the Superintendent or his designee.
He will administer all activities related to Community Education. He shall serve
as the executive secretary to the District Community Education Advisory
Council.
Future employment of any Community School Coordinator shall be done in
consultation with an individual designated by the governmental body within which
the school is located and the building principal. Retention or dismissal of said
Community School Coordinator will be dealt with in a similar manner.
6. Liability: Each party shall assume sole responsibility for injuries to users by its
facilities while the facilities are being used. Each party shall secure proper
liability insurance to provide for any such claim.
7. Length of Agreement and Termination: This agreement shall take effect upon
approval by the School District and the participating governmental bodies. It
may be terminated as it pertains to any of the parties by providing at least one
hundred eighty (180) days written notice to the Community Education Advisory
Council. City councils shall review the program annually and may increase or
decrease the number of Community School Coordinators.
IN WITNESS WHEREOF, the parties hereto have executed this agreement
• effective the day and year first above written.
