Overview
The applicant is proposing to subdivide a 6.51 acre parcel into two single
family lots. Parcel C will be 2.86 acres in size and contains an existing house
and shed. Parcel D will be 2.5 acres in size and is undeveloped. Additional
right-of-way will be dedicated for County Road 13 and 209th Avenue. The
surrounding property is zoned Rla (Single Family Residential) with a
minimum lot size of 2.5 acres.

Existing Conditions
The property is fiat with an abandoned county ditch on the east boundary.
The eastern 50 feet of the property is encumbered with a 50 foot wide
drainage and utility easement. The western half of the property serves as a
yard for the existing single family house and the eastern half is a mowed
field. Access to the existing house is from 209th Avenue.
The property is bound by County Road 13 on the west, 209th Avenue on the
north and single family homes on the east and south. 209th Avenue is a gravel
road that terminates in a cul-de-sac east of the property.
Right-of-way and access
Additional right-of-way is being provided along both County Road 13 and
209th Avenue. 60 feet of right-of-way is being provided along County Road 13
and 42 feet along 209th Avenue. Access to both lots will be from 209th Avenue.
No access will be allowed from County Road 13.
Lot size and dimensional requirements
The minimum lot size in the Rla zoning district is 2.5 acres; both lots meet
the minimum lot size requirements. The minimum lot width is 160 feet; both
lots meet the minimum lot width requirement. There is a shed on Parcel C
that will have to be moved because it does not meet the 5 foot setback
requirement. The existing house meets all setback requirements
Drainage and utilities
Drainage and utility easements are proposed along all lot lines. There are 10
foot easements proposed along street right-of-ways and 5 foot easements
along the lot line between the two parcels and along the south property line.
There is also a 50 foot wide drainage and utility easement along the east
property line of Parcel D that follows an abandoned county ditch.
Each lot will have a private septic system and well. A pressurized mound
system is being proposed for Parcel D. The proposed location for the septic
system and alternate site, as well as the proposed well location, will have to
be shown on the survey. The well and septic vent are shown for Parcel C.

There are no parks identified for this area in the Master Park and Recreation
Plan. A park dedication fee of $1,400.00 will be required for the new lot being
created prior to recording the administrative subdivision at the County.
Recommendation
Staff recommends that the City Council recommend approval of the request
for Administrative Subdivision to subdivide 6.51 acres into two lots with the
following conditions:
1. PARK DEDICATION FEE BE PAID IN THE AMOUNT REQUIRED BY THE CITY PRIOR TO
RECORDING THE ADMINISTRATIVE SUBDIVISION.
THAT PAYMENT OF SURFACE WATER MANAGEMENT FEE IN THE AMOUNT REQUIRED BY
THE CITY FOR THE NEW LOT BEING CREATED BE PAID PRIOR TO RECORDING THE
ADMINISTRATIVE SUBDIVISION.
3. ALL COMMENTS OF THE CITY ENGINEER BE ADDRESSED PRIOR TO RECORDING THE
ADMINISTRATIVE SUBDIVISION.
4. THE SHED ADJACENT TO THE PROPERTY LINE BETWEEN PARCELS C & D BE MOVED SO IT
COMPLIES WITH THE SETBACK REQUIREMENTS.

RE: LANG ADMINISTRATIVE SUBDIVISION
Dear Mr. Harlicker:
As requested, we have reviewed the proposed Administrative Subdivision for Dale K.
Lang. The Certificate of Survey was prepared by John Oliver and Associates, and
consists of splitting Parcel B1 into two parcels, one of 2.5 acres and one of 2.86 acres.
The larger of the two parcels contains the existing house. We see no problems with the
proposed subdivision of this land.
Submitted with the Certificate of Survey was a report from Halstad Contracting regarding
the suitability of the 2.5-acre site for an on-site septic system. The report indicates that a
septic system can be built on this parcel.
The one comment we do have on the Certificate of Survey is we believe there are a
number of issues in the proposed descriptions that could be better written in a slightly
different manner. I will have Frank Kriz of our office speak with Rick Blom of John
Oliver's office to pass our comments on. I would request that we get the chance to
review the final Certificate of Survey prior to it being filed.
