The applicant is requesting to plat Outlot A of Hillside Crossing Three. The
property is 2.02 acres and is located between Highway 169 and Evans Street,
south of the Amoco convenience store. All the appropriate easements are in
place. Access to the property will be limited to the existing access from Evans
Street, which also services the Amoco store. The City Engineer had no
comments on the plat; he felt it was approvable as presented.
Park dedication or stormwater management fees have not been paid on these
2.02 acres. When the Hillside Crossing Three was platted park dedication
and stormwater management fees were collected for Lot I but not Outlot A.
Now that Outlot A is being platted, park dedication and stormwater
management fees should be collected.
Conditional Use Permit
The applicant is requesting a conditional use permit for motorcycle sales and
service. The proposed store will be a Harley-Davidson dealership. They are
proposing a 39,939 square foot building consisting of two stories and a
basement. The building will have a footprint of 17,930 square feet. The main
floor will be the sales and service area; the second floor will include office
area and display area; the basement will include underground parking and
storage. The conditional use permit shall be conditioned on final plat
approval.
Parking and Access
Access to the site will be via the existing entrance from Evans Street which
currently serves the Amoco store. No other access is permitted. The site plan
shows 98 parking spaces, 70 surface parking spaces and 28 spaces provided
in an underground garage beneath the building. Fifty-seven parking spaces
are required by code. Access to the underground garage will be on the west
side of the building. The drive aisles and parking spaces meet the
dimensional requirements of the zoning code. The layout of the parking lot is
acceptable. A striped parking island is shown at the east end of the row of
parking spaces located in the center of the parking lot. This island should be
curbed and landscaped and a second curbed and landscaped island should be
provided at the west end of the row.
Grading, Drainage and Utilities
Grading, drainage and utility issues are addressed in the City Engineer's
memo. Retaining walls will be constructed on the west side of the site,
adjacent to the drive aisle which will provide access for the underground
parking

Building Elevations
The exterior of the building will be red brick. A sample of the brick and a
color rendering of the building will be available at the meeting. Display
windows will be located on the south and west sides. The main entrance will
be on the south side. Two cupolas are located at the southwest corner of the
building.
A dumpster enclosure will be attached to the east side of the building. The
exterior of the enclosure will be brick to match the building.
Landscaping
The landscape plan as proposed is insufficient. It does not provide the
number of plantings required by the code. Staff is currently working with the
applicant on a landscape plan that meets the requirements of the landscape
ordinance. Changes will include additional street trees, additional shade
trees on site and in the parking lot, ornamental trees and some evergreens.
Landscaping will have to be setback from the property line north of the
entrance to ensure sight line to the north along Evans Street.
Signage
All signage shall comply with the Hillside Crossing PUD Agreement. The
agreement allows one freestanding monument sign no higher than 10 feet
and no larger than 100 square feet. The site plan shows a monument sign in
the northwest corner of the site, along Highway 169.
The PUD agreement also allows 2 wall signs. The building elevations show 3
wall signs, a wall sign on the south side of the building, one on the west side
and one on the southwest corner. An amendment to the PUD agreement will
be required for the third wall sign. All signs will require a sign permit.
There is an existing entrance sign at the driveway from Evans Street. The
sign currently includes the Amoco emblem, the applicant can also have a
similar sized emblem on that sign. The site plan should be revised to show
this existing sign.
The existing Menards/Goodwill sign will also remain. The developer, Phoenix
Enterprises, will have a private sign agreement/easement with the owner of
the Harley-Davidson dealership in order to retain control of the sign.

Planning Commission Meeting
At the Planning Commission meeting held on February 29th, no one spoke at
the public hearing. The Planning Commission discussed signage and
landscaping.
Recommendation
The Planning Commission and staff recommend the City Council approve the
preliminary and final plat request for Harley Addition with the following
conditions:
1. Park dedication fee shall be paid prior to releasing the plat for
recording.
2. Surface water management fee shall be paid prior to releasing the plat
for recording.
3. All comments of the City Engineer shall be addressed.
The Planning Commission and staff recommend the City Council approve the
conditional use permit for the Harley-Davidson dealership with the following
conditions:
1. All comments of the City Engineer be addressed.
A landscape plan be provided and approved by staff which meets the
planting requirements of the landscape ordinance. The landscaping
shall include street trees along Evans Street, shade trees on site and
on the parking islands, ornamental and evergreen trees.
3. Curbed landscaped islands be provided at the west and north ends of
the center row of parking spaces.
4. All signs will require a sign permit and shall comply with the
requirements of the Hillside Crossing PUD Agreement.
5. The site plan be amended to show the existing sign at the entrance
from Evans Street.

the ave~'age motor-cycle. However', the owner's of Harlc~y's
seem to think that part of the thrill of ridin9 is to make
excessive noise and so they modify the exhaust system of
their bike. That bein9 t. he case we ar'e concerned that there
will be excessive noise on Highway 169 dur'in. 9 the fr'eque~t
r'a] lies they have planned throughout the "9ood season months"
when l-learby residents enjoy navin9 their home windows open.
Perhaps some consideration can be made as to ho~_lr$, l)oise

RE: HARLEY-DAVIDSON SITE PLAN REVIEW
Dear Mr. Harlicker:
As requested, we have reviewed the submittal package for the proposed Harley-Davidson store
to be located immediately south of the Amoco Oil Company at 197th Avenue and TH 169. The
information we have reviewed consisted of Harley Addition prepared by Lot Surveys Company,
a site plan prepared by Lambert Architects, and a preliminary grading, drainage, erosion control,
and utility plan prepared by Plowe Engineering, Inc. Based upon our review, we would offer the
following comments:
1. We believe the plat of Harley Addition is accurate and approvable as presented.
2. The only comment we have on the site plan is that it shows the existing concrete island
which divides the two outbound lanes from the one inbound lane being removed. At our
staff review meeting, there were some comments regarding this concrete island making it
difficult to access the Amoco Oil Company store with a larger vehicle.
3. It is unclear from the site plan where delivery vehicles will access the store. It would seem
to be difficult for any larger truck to acc, ess the service entry if the parking stalls in the
general area are being used at the time.
4. The proposed building has a basement under a portion of it with a ddveway access to the
basement on the west side of the building. This causes the grades to require a 7-8 foot high
retaining wall on the north side of the ddveway access to the basement. The retaining wall
in this area should be terraced to reduce its overall height. There is also a retaining wall
needed just south of the basement driveway access in the 4-5 foot high range.
5. Drainage from the site will be conveyed to the west edge of the parking lot where it is
proposed to be picked up in a catch basin and discharged to the TH169 highway ditch.
From here, drainage would flow southerly approximately 200 feet to a Iow area where it will
be picked by the storm sewer system for the overall Hillside Crossing Addition. The
drainage is then conveyed to a sedimentation pond constructed with the Hillside Crossing
Addition, and then ultimately under 193rd Avenue to the regional ponding area south of
there. It will be necessary for the developers to obtain a MnDOT permit for the discharge to
the TH169 highway ditch.

6. There is a trench drain shown at the point where the driveway access to the basement
meets the garage door. The elevation at the top of this trench drain is 983. This is also the
approximate elevation of the outlet to the TH169 ditch. Obviously, gravity flow cannot be
used to convey stormwater away from the trench drain. There will likely need to be some
type of pump with a force main that should be conveyed to the catch basin in the parking lot
rather than directly to the highway ditch to prevent any type of erosion.
7. In the southeast corner of the parking lot, the elevation of the curb surrounding the parking
lot is 994.31. Approximately 15 feet away, the boulevard elevation of Evans Street is 990.
This will provide a very steep bank leading from the parking lot to the boulevard of Evans
Street. We suggest that a small retaining wall of approximately two feet would be better
suited here to make the transition from the parking lot grade to the boulevard in an attempt
to maintain a relatively flat boulevard area along Evans Street.

WHEREAS, application has been made for final plat approval, pursuant to
Section 1008.08 (1)(c) of the Elk River City Code of Ordinances, of the property
legally described on attached Exhibit A and hereinafter referred to as "the
Property"; and
WHEREAS, the application for preliminary plat approval has been referred
to the Planning Commission which has given its advice and recommendation to
the City Council; and
WHEREAS, a preliminary plat of the Property was approved by the City
Council on March 20, 2000; and
WHEREAS, the proposed final plat is consistent with the preliminary plat
as approved by the City Council; and
WHEREAS, the proposed final plat complies with each of the conditions
set forth by the City Council in its approval of the preliminary plat of the Property;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF ELK RIVER, as follows:
It is hereby determined by the City Council for the City of Elk River as
follows:
The proposed subdivision is consistent with the Zoning Ordinance
and conforms with all of its requirements.
The proposed subdivision is consistent with all applicable general
and specialized city, county, and regional plans including, but not
limited to, the City's Comprehensive Development Plan.

The physical characteristics of the site, including, but not limited
to, topography, soils, vegetation, susceptibility to erosion and
siltation, susceptibility to flooding, and drainage are suitable for the
type and density of development and uses contemplated.
The proposed subdivision makes adequate provision for water
supply, storm drainage, sewage transportation, erosion control and
all other services, facilities and improvements otherwise required
herein.
The proposed subdivision will not cause substantial environmental
damage.
The proposed subdivision will not conflict with easements of record
or with easements established by judgment of a court.

The proposed subdivision will not have an undue or adverse impact
on the reasonable development of neighboring land.
Final plat approval is hereby granted for the Property, subject to the
conditions set forth in attached Exhibit B.
The officers of the City are hereby authorized, once the conditions set
forth in Exhibit B are met and complied with, to sign the final plat for the
Property and to issue a certified copy of this Resolution giving final
approval of the plat.

The owner of the Property is authorized to record the final plat as required
by law and shall file proof of said recording with the City. No building
permits will be issued for the Property until the final plat is recorded.
