Section 216 - Park Board and Recreation Board
216 .00 - Abolition of Park Board. The Park Board in and for the
City of Elk River heretofore established pursuant to the provisions of
4: Minnesota Statutes , Sections 412.501 to 412.531 , is hereby abolished.
216 .02 - Establishment and Composition of Recreation Board. There
is hereby established in the City of Elk River a Recreation Board
pursuant to the authority given by Minnesota Statutes , Sections 471 . 15
to 471 . 19 , under which the power of the City to operate a program of
recreation may be delegated to such a board. The Board shall consist
of seven (7) members appointed by the Council for a term of three (3)
years . The terms of the members shall be staggered so that no more
than three (3) members ' terms expire at the same time.
Both original and successive appointees shall serve until their
successors are appointed and qualified. A vacancy shall be filled for
the unexpired portion of the term by the Council . Members of the
Board shall serve without compensation. At the beginning of each
fiscal year they shall select a chairman and a secretary from their
own number with duties in addition to Board membership implied by
these titles. A majority shall constitute a quorum for the
transaction of business .
216 .04 - General Powers of Recreation Board. The Recreation Board
shall have power to operate a program of public recreation and play-
grounds as agent of the City. If any part of the public recreation
program of the City is administered directly by any public or private
agency other than the Board, the Board shall have power to make
cooperative agreements with any such public or private agency for the
purpose of coordinating all the activities and facilities included in

such public recreation program. The program directly administered by
the Board may make use of public property assigned to , or of private
property leased or otherwise made available for , public recreational
use . The City Council shall determine what land is to be acquired by
it for recreational purposes , what land it shall be permitted to use
in carrying on its recreational program, and what buildings or other
permanent structures are to be constructed upon such land . The Board
lip shall advise the City Council upon such matters and shall operate
facilities made available to it for recreational purposes ; but it
shall have no authority to construct buildings or other permanent
structures upon any land without the consent of the owners of such
land; and in no event shall such buildings or structures be
constructed by the Board upon privately owned land.
216 . 06 - Specific Powers . In order to carry on the recreation
program provided herein , the Board shall have the powers specified in
the following paragraphs :
1. The Board may adopt rules for its meetings and the trans-
action of its business and rules governing the use by the public
of the recreation facilities under its control .
2. The Board may employ instructors , leaders , administrative
guardians , and custodial personnel , and it may provide for
workers ' compensation insurance and surety bonds for any such
officers and employees . All officers and employees shall be
selected on a basis of merit and fitness , and instructors and
directors shall be appointed in compliance with the minimum
qualifications established by the Minnesota Department of Education .
3 . The Board may make contracts for completion within a current
ILfiscal year.
4. The Board may lease real or personal property for public
recreational use for periods not longer than one year.
5 . . The Board may accept gifts of personal property for public
recreational purposes, subject to the provisions of Section 216 .04
of this Code.
6 . The Board may perform whatever other acts are reasonable and
necessary and proper to carry on a recreational program under this
ordinance.
216 .08 - Preparation of Program.
1 . The Board shall each year prior to July 1 , prepare a compre-
hensive program for public recreation activities for the ensuing year ,
with recommended divisions of responsibility as between private agen-
cies administering recreation activities directly, and the Board
itself. The Boards ' s own program shall be described in terms of
activities as well as finances .
2 . The budget of finances shall be substantially balanced and
shall show:

a. Estimated revenues , divided as follows :
(1k. i . Contributions from City Council ;
ii. Contributions, if any , from other public bodies
having power to levy taxes for recreational
purposes;
iii . Contributions from private sources;
iv. Earnings from admissions and other charges made for
use of facilities;
v. Miscellaneous revenues; and
b. Estimated expenditures, divided as follows:
i. Instructional and supervisory payroll;
ii. Custodial payroll;
iii. Supplies;
iv. Printing;
v. Postage, express, freight, utility charges;
vi. Rents;
vii. Miscellaneous expenditures.
3. Such budget shall be submitted not later than September 1 to
the City Council and any other public body from which contribu-
tions shall be reported back to the Board, which shall adjust the
budget, if necessary. The expenditure allowances, as finally
approved by the Board, shall control the year 's spending program,
except that excess revenues received may be spent upon the
approval of a majority of the Board. The Board shall not itself
levy taxes or borrow money; and it shall not approve any claims or
incur any obligations for expenditure, unless there is
unencumbered cash in the treasury to the credit of the Board with
which to pay the same.
216.10 -Finances of the Board. For the purposes of financing the
public recreation program authorized by this ordinance, there shall be
established in the City accounts and treasury a special fund to be
called the Recreation fund. Into this fund shall be placed the
various revenues as enumerated in Section 216.08 hereof and from it
shall be paid the claims for various recreation expenditures as
therein enumerated. All receipts belonging to the Board shall be
deposited intact in a bank account to the credit of the fund and no
disbursement shall be made from this bank account except by order-
check and after compliance with the requirements for the submission of
claims against the City. The accounting of the fund and the custody

of the cash and the bank checking account shall be in the hands of the
City Treasurer who shall make reports to the Board at reasonable
intervals. For purposes of budgeting , accounting , and reporting , the
fiscal year of the Board and the fund shall be the calendar year . An
audit of the fund shall be made annually . Such audit may be made
independently of or in conjunction with any audit which may be made of
the funds of the City. The Board shall be authorized to establish
charges or fees for the restricted use of any facilities or to make
any phase of the recreation program wholly or partially self-
sustaining. Any concessions or privileges may be sold after public
advertising and competitive bidding. Any employees of the Board who
handle cash in the process of collection shall be bonded .
216. 12 - Financial Report. The Board shall as soon as possible
after the end of each fiscal year prepare and present to the City
Council and all other public and private participating agencies a
comprehensive annual report of its activities and finances.
Section 218 - Basic Personnel Re•ulations
218 .0 " - Purpose. It shall be the purpos: of these Sections

establish a uniform and equitable system o municipal personnel
administrati•n for employees of the City.
218 .02 - D- initions.
1 . "Perma -nt Employee" shal mean an employee who has
completed the ' nitial probatio - ry period and who serves on a
permanent basis in a position which is provided for by the
IIM Council .
2. "Temporary ' ployee" shall mean any person employed by the
City who does not hive r 'ght of tenure in employment and whose
employment does not on - inue for a period in excess of one hundred
twenty (120) working • . ys within any one consecutive twelve-month
period.
3. "Casual Emplo en :" shall mean employment which is
incidental to the ncti•_ s of the City 's operation, normally for
a short duration.
4 . "Seasonal imit" shal' mean the employment of any person who
is employed in -- position which is both recurrent and seasonal in
nature and whi• requires or ' s likely to require services of an
employee only during certain • - rts of each year or an uninterrup-
ted period w ch may exceed on- hundred twenty ( 120) working days
within any o e consecutive twel --month period.
5. "Ben fits" means privileges • ranted to an employee in the
form of v. cation leave, sick leave overtime allowance, holidays ,

insurance or otherwise.

SECTION 2145 - Park and Recreation Advisory Commission
Section 24'5 : 00. Establishment.
Subd. 1. There is hereby continued as heretofore created a
Park and Advisory Commission. All members shall be residents
of the City of Brooklyn Park. All member shall be appointed
by the Council., for terms of three years , excepting the ex-
officio members , who shall serve a one year term. Vacancy
shall be filled for the remainder of the original term of office
in the same manner as provided for original appointments . Three
members shall be appointed from each of the three council dist-
ricts of the City. Three members shall be appointed at large
within the City and one member, who shall be an ex-officio mem-
ber shall be a member of the Council , and there shall be one
member vino shall be an ex-officio member who shall be e -a member
of the Planning Commission.
Subd. 2 . The members who need not be members of the Council,
or the Planning Commission and who are presently serving on
the Commission as of March 1 , 1973 , shall complete their desi-
gnated two year terms ; the Council shall designate the terms
of new members appointed from the Council districts and said
appointments shall terminate on January 10 , 1976 . One new
member at large shall be appointed to serve until January 10 , 1975
and one new member at large shall be appointed until January 10 ,
1976. Subsequent appointment shall be for three year terms.
A member' s term shall expire on January 10 , except that a member
shall continue in office until his successor is duly appointed.
The term of each appointment shall be designated by the Council
at the time of the appointment and shall in no event be longer
than three years but shall be staggered so that one third of
the Commission representing each of- the Council districts shall
be appointed each year. Following the appointment and selection
of the full membership, the Commission shall meet and organize ,
adopt By-Laws and elect such officers for such terms as it deems
desirable from the members . The ex-officio members shall not be
• an officer of the Commission. -
Section 245:05, Compensation. The members of the Commission shall serve
without ray but may be reimbursed for actual expenses if funds therefor
are provided in the adopted budgets of the Park and. Recreation Fund.
Section 245:10. Duties. It shall be the duty of the Commission to hold
meetings of- its members at least once a month on a regular scheduled meeting
date, and to meet from time to time with the Manager, the Council, and the
Director of Parks and Recreation to consider such matters pertaining to •
parks arm public recreation programs in the City as shall be referred to
the Commission by the Council, the Manager, the Director of Parks and
Recreation, or as the members of the Commission deem proper.
Section 245:15. Rerorts. The Commission shall make an annual report to
the Manager and the Council not later than August 15, which report sh3»
contain such details as the Council shall require, gcncerning its estimate
of financial needs and its recommendations for the ensuing year. The
Commission shall report quarterly on its activities to the Council, said
reports being due no later than February 15, MaS' 15, August 15 and November 15.

Section 245:20. Reports to be Advisory. The Commission's reports, corn
clusions and recommendations shall be made to the Council, Manager and the
Director of Parks and Recreation as may be requested, or to any or all of
them as the Commission deems appropriate in the light of the matter under
consideration. Its reports, conclusions and recommendations are purely
. advisory, and.the final determination and responsibility shall be with the
Council. It shall be aided and assisted in every way possible by the
Director of Parks and Recreation, who shall be appointed by the Manager. .

210 PARKS COMMISSION
210 . 010 Establishment of Commission . A Parks Commission of
the City of Lake E1mQ is hereby established.
210 . 011 Pur ose . The Parks Commission is established to re-
view and macommendations to the City Council on the future
development of City parks , including the establishment of and
improvements to said parks; and to make recommendations to
the City Council on policies governing th'e maintenance and
public use of the parks within the City .
210 :012 Composition. The Parks Commission shall consist of
nine members and alternate members . Members shall be ap-
' pointed by the City Council for three year terms so that only
one-third (1/3) of the appointments will expire on December
•
31st of each year. No member may serve more than two consecu-
tive three-year terms unless the average years of service
for a Commission members is less than four years . A member
who hat served two terms may be reappointed by the City Council
after a one year absence . The City Council shall designate
a first alternate and a second alternate who will become full
members in order of appointment and shall complete the un-
expired term of the member they succeed. If the office of
any alternate becomes vacant , the vacancy shall be filled in
the same manner in which the last regular appointment for that
office was made .
210 . 013 Qualifications . Each member and alternate member
shall be a resident of the City. of Lake Elmo . Wherever
possible , Commission members should represent all geographical
areas of the City and a cross-section of the population of
• the City at the time of appointment .
210 . 014 Removal . Any member or alternate member may be
removed by a four-fifths vote of the City Council , for cause .
Cause shall include but not be limited to having more than
three (3) consecutive unexcused absences or being absent from
more than one-third (1/3) of the meetings in any one calendar
year. The Council may consider exceptional circumstances
when applying this rule .
210 . 015 Officers . The Commission shall elect a Chairperson
. a Vice Chairperson, and may elect a Secretary from among its
appointed members at the annual meeting each year , for a term
of one year. The Chairperson shall preside at all meetings
of the Commission, if present , and shall perform all other
duties and functions assigned by the Commission or the City
Council , The Vice Chairperson shall perform these duties in
the absence of the Chairperson . If a vacancy occurs in the
Chairperson' s office , the Vice Chairperson shall assume the
Chairperson ' s duties for the remainder of the year ; and a new

210 .016 Annual Meeting. The Commission shall hold an annual
meeting the first Monday in the month of January in each year ,
unless the first Monday is. New Year ' s Day , in which case the
annual meeting shall be held at the first regularly scheduled
meeting of the Corranissioq in the month of January in each year .
Such meeting shall be devoted t? the election of officers and
such other business as shall be scheduled.
210 . 017 Annual Work Plan. The Parks Commission shall meet
with the City Council at their first meeting in April each
year to develop an annual work plan , including a list of
projects , points of interaction on projects , programs and
goals -for the year.

210 .018 Regular Meetings . Regular meetings shall be held in •
the City Halt at 7: 30 p .m. on the first Monday of each month .
No action shall be taken in the absence of a quorum except
to adjourn the meeting to a subsequent date . A regular
meeting may be cancelled or rescheduled by the Commission at
a prior meeing of if there are no scheduled agenda items on
the Thursday prior to the meeting . All action taken by the
Commission shall be by the affirmative vote of a majority of •
the members present .

210. 019 Special Meetings . Special meetings of the Commission
shall be held in the City Hall at a time and place designated
. or at a public place at a time designated and shall be called
by the Chairperson . Upon the written request of at least
four members the Chairperson shall be required to call a Spe-
cial meeting to be held within seven days of the request .
Written notice thereof shall be given to all members not less
than forty-eight hours in advance of the meeting .
210 .020 Quorum. A quorum shall consist of two-thirds (2/3)
of the members .
210 .021 Voting. Each member attending any meeting shall be
entitled to cast one vote . Voting shall be by voice vote .
In the event that any member shall have a personal interest
of any kind it the matter then before the Commission', he
shall disclose this interest and be disqualified from voting
upon the matter, and the Secretary shall record in the
minutes that no vote was cast by such member. Alternate
members shall be entitled to cast one vote in the absence
of any member. The second alternate shall be entitled to
cast one vote in the absence of any two members .

prepared and mailed a written Agenda of all meetings to all
Commission members., the City Council , and the public , no
less than four days before each meeting .
210 .025 Records . Each formal action of the Commission shall •
be embodied in full upon the Minute Book as a formal motion
or resolution after an affirmative vote as provided herein .
The minutes of each meeting shall be provided to each member,
the City Council , and the public no more than seven days a.:ter
the date of each meeting. The recommendations and findings
of the Commission shall. be presented to the City Council at
the next regularly scheduled City • Council meeting. The records

avail themselves of training courses offered by the City ,
the State and other government and public training agencies

210 . 027 Powers and Duties . The Commission shall prepare ,
hold hearings on, and recommend to the City Council such
plans , programs , and policies as it deems necessary to carry

1607.01 Establishment of Commission. A Park &
Recreation Advisory Commission is hereby established
to advise the City Council on Park and Recreation
related matter. •
1607.02. Composition. The Park 6•Recreation Ad-
visory Commission shall consist of seven(7)members
appointed by the Council.Any member of the Park I
Recreation Commission may be removed by a melority
vote of Council.
1607.03 Terms end Compensation.Appointment to the
Park&Recreation Advisory Commission shall be made
at the firs!regular January meeting of the Ctty Council,
