Country clubs, while not clearly defined in the ordinance, are a conditional use in the Rla District. In 1990, the City approved a conditional use permit to allow the construction of the existing facility, including the kitchen and dining areas. In 1999, the City approved a conditional use permit and agreed to exchange land to allow construction of a new maintenance facilty. An establishment needs to obtain a wine and 3.2 beer license before obtaining a strong beer license. Such licenses have been issued to the Club for several years. Nature's Hideaway is proposing to take over the restaurant and catering services at the club. They would like to expand the liquor license to an on-sale license for the sale of all forms of liquor. While no expansion of the building is proposed, the expansion of the liquor license to on-sale is an intensification of the use on the site, and staff felt it appropriate for the Planning Commission and City Council to review the request. The Police department reviewed this request and had no negative comments. The applicant will be expected to comply with the City's licensing requirements on an annual basis. Planning Commission Action A public hearing was conducted; no one spoke for or against the request. The Planning Commission unanimously recommended that the City Council approve the request to allow on-sale liquor at the Elk River Country Club with the following condition: 1. The applicant shall comply with the City's liquor licensing requirements. The Commission felt that the following condition was too onerous; to have the applicant's request tied to property owner's responsibilities was unfair. The property owner shall comply with the conditions of all previous conditional use permits. City Council Recommendation Staff recommends that the City Council concur with the Planning Commission recommendation and approve the request for an on-sale liquor license for Nature's Hideaway at the Elk River Country Club with the following condition: 1.
