81-035 RES EXHIBIT B • EXTRACT OF MINUTES OF MEETING OF THE CITY COUNCIL OF THE CITY OF ELK RIVER, MINNESOTA HELD: AUGUST 17, 1981 Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Elk River, Sherburne County, Minnesota, was duly held at the Elk River Public Library on the 17t4 day of August, 1981 at 8:00 o'clock P.M. The following members were present: Mayor Hinkle, Councilmembers Duitsman, Toth and Schuldt and the following were absent: Councilman Engstrom. Member Duitsman introduced the following resolution and moved its adoption: RESOLUTION NUMBER 81-35, ORDERING THE COMPLETION OF THE BARRINGTON PLACE IMPROVEMENTS AND AWARDING THE BID FOR PHASE TWO OF THE CONSTRUCTION TO HBH, INC. IN THE AMOUNT OF $136,678.75. WHEREAS, the City Council has received a petition pertaining to sanitary sewer and water, permanent street surfacing, and storm sewer improvements located on Dodge Avenue, Auburn Place, 6th Street east of Auburn Place, the Fawn Road Cul-de-sac and the Line Avenue Cul-de-sac. • NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota as follows: a. The aforesaid petition is signed by all the owners of real property abutting upon the street named as the location of the improvement in the petition, b. said property owners request in the petition that the improvement be constructed and that the entire cost of the improvement be assessed against their property, c. the consulting Engineer has recommended that said improvement is feasible and can best be made as proposed. and said improvement is hereby ordered and the bid awarded to HBH,Inc. in the amount of $136,678.75. The motion for the adoption of the foregoing resolution was duly seconded by memberSchukit and upon vote being taken thereon, the following voted in favor there- of: Mayor Hinkle, Councilmembers Duitsman, Toth and Schuldt and the following voted against the same: None.
