CITY OF ELK RIVER
COUNTY OF SHERBURNE RESOLUTION 81-42
RESOLUTION OF CITY COUNCIL VACATING STREET
In the Matter of the Vacation of that part of Freeport Avenue (formerly
Summer Street) lying South of the South line of Third Street and lying North
of the North line of Main Street in the City of Elk River.
The above entitled matter came on to be heard before the City Council
of the City of Elk River, Sherburne County, Minnesota, upon the Petition
of Eugene N. Kreuser and upon Motion of the City Council for the vacating
of the said portion of Freeport Avenue, above described; and the City Council
having given due notice of said hearing by published and posted notice as
provided by law and said hearing having been held on the 5th day of October
1981, at 8:00 o'clock p.m. at the Elk River Public Library
in said City, and no one appearing in opposition thereto and the said Council
after hearing the evidence presented it in favor of said Petition finds:
101, That said protion of Freeport Avenue is not serving any public purpose and
it would be in the best interest of the public to vacate said portion of
Freeport Avenue;
Councilman Duitsman introduced the following resolution, to-wit:
That all that part of Freeport Avenue (formerly Summer Street)lying
South of the South line of Third Street and lying North of the North line
of Main Street in the City of Elk River, be and the same hereby is vacated.
Which resolution was seconded by Councilman Engstrom, and
being put to a vote was passed by a unanimous vote in favor of said
resolution by all members of the City Council whereupon said resolution was
declared adopted by the Mayor of said City.
