82-003 RES RESOLUTION 82-3 A RESOLUTION DECLARING THE CITY OF ELK RIVER POLICY FOR ISSUANCE OF NON-INTOXICATING MALT LIQUOR OFF-SALE LICENSES WHEREAS, in the past, the Elk River City Council has considered the issuance of non-intoxicating malt liquor off-sale licenses without the benefit of an express policy for said licenses; and, WHEREAS, the City Council is concerned that the issuance of non-intoxicating malt liquor off-sale licneses in the City of Elk River not contribute to driving accidents or problems related to alcohol or other public health, safety or welfare problems; and, WHEREAS, the City Council finds that it is necessary to restrict the issuance of non-intoxicating malt liquor off-sale licneses for businesses whose trade is primarily oriented to or associated with automobiles or automobile traffic in order to adequately protect the public health, safety and welfare; and, WHEREAS, the City Council finds that the community need for non-intoxicating malt liquor off-sale licneses can adequately be met through available or other future sources, even though restrictions may be placed on businesses pri- g', marily oriented to or associated with automobiles or automobile trade. NOW, THEREFORE BE IT RESOLVED by the Elk River City Council that the following policy regarding the issuance of non-intoxicating malt liquor off-sale licenses is hereby adopted: In order to protect the public health, safety and welfare and to not con- tribute to alcohol-related traffic accidents or problems, the City Council of the City of Elk River will not issue non-intoxicating malt liquor off- sale licenses to businesses who deal primarily with or are oriented to or associated with automobiles or automobile trade or service, such as but not limited to gasoline service stations, combination convenience store and gasoline service stations.
