CITY OF ELK RIVER
COUNTY OF SHERBURNE RESOLUTION 83-3
• . RESOLUTION OF CITY COUNCIL AUTHORIZING CONVEYANCE OF PROPERTY
WHEREAS, the City Council of the City of Elk River has on this
day of , 1983, vacated the public easement as described
on the attached Exhibit "A", and
WHEREAS, the said easement was in part dedicated to the public pursuant
to a Quit Claim Deed by Wallace E. Ohland and Irene D. Ohland to the Town
of Elk River and the public at large dated April 19, 1977, filed April
26, 1977, as Instrument No. 140760, and
WHEREAS, the Town of Elk River has now been consolidated into the
City of Elk River, and
WHEREAS, neither the Town nor the City of Elk River has ever accepted
the public easement or the conveyance described in said Deed, and
WHEREAS, the said Deed failed to provide that the conveyance was
limited to a public easement for utility and road purposes, and
WHEREAS, the City of Elk River has no need for the said public easement
or any fee interest in the land described on the attached Exhibit "A".
IIINOW THEREFORE, it is hereby resolved that the City Mayor and the
City Administrator execute a Quit Claim Deed for the property described
on the attached Exhibit "A" conveying all interest, if any, of the City
of Elk River in and to said property to Wallace E. Ohland and Irene D.
Ohland as joint tenants.
