Iv COUNTY OF SHERBURNE RESOLUTION 83-4 CITY OF ELK RIVER
RESOLUTION OF CITY COUNCIL VACATING EASEMENT
In the matter of the vacation of that public easement described
on the attached Exhibit "A" .
The above entitled matter came on to be heard before the City Council
of the City of Elk River, Sherburne County, Minnesota, upon the Petition
of Wallace E. Ohland and Irene D. Ohland and upon motion of the City
Council for the vacating of the said public easement described on the
attached Exhibit "A"; and the City Council having given due notice of
said hearing by published and posted notice as provided by law and said

hearing having been held on the 14th day of February , 198 3 , at
eight o'clock p.m. at the Elk River Public Library
in said City, and no one appearing in opposition thereto and the said
Council after hearing the evidence presented it in favor of said Petition
finds: That said public easement is not serving any public purpose and
410 it would be in the best interest of the public to vacate said public
' easement;
Councilman Duitsman introduced the following resolution,
to wit:
That the public easement as described on the attached Exhibit "A"
be and the same hereby is vacated.
Which resolution was seconded' by Councilman Schuldt and
being put to a vote was passed by a unanimous vote in favor of said resolution
by all members of the City Council whereupon said resolution was declared
adopted by the Mayor of said City.
