EXTRACT OF MINUTES OF MEETING OF THE
CITY COUNCIL OF THE CITY OF
ELK RIVER, MINNESOTA
HELD: November 7, 1983
Pursuant to due call and notice thereof, a meeting
of the City Council of the City of Elk River,. Minnesota, was
duly called and held at the City Hall in the City of Elk River,
Minnesota, on the 7th day of November, 1983, at _.M.

resolution and moved its adoption:
RESOLUTION CALLING IMPROVEMENT
HEARING AND ASSESSMENT HEARING ON
GATES AVENUE WATER IMPROVEMENTS OF 1983
WHEREAS:
• 1. The City Council deems it necessary and expedient
that the City of Elk River, Minnesota, construct certain
improvements, to-wit: Gates Avenue Water Improvements of 1983
in the City as described in and in accordance with the
preliminary plans and report prepared by
consulting engineers;
2. The Council has been advised by the consulting
engineers that said Gates Avenue Water Improvements of 1983 are
feasible and should best be made as proposed, and the
consulting engineers' report to this effect has heretofore been
received by the Council, and filed with the Clerk;
3. The Clerk with the assistance of the consulting
engineer has prepared an assessment roll for Gates Avenue Water
Improvements of 1983, and said proposed assessment roll is on
file with the Clerk and open to public inspection; and

4. The statute provides that no such improvements
shall be made or the special assessments adopted until the
110 Council shall have held a public hearing on such improvements
and special assessments following mailed notice and publication
thereof in the official newspaper stating time and place of the
hearing, the general nature of the improvement, the estimated
costs thereof, and the area proposed to be assessed and that
the proposed assessment roll is on file with the Clerk, in
accordance with law.
NOW THEREFORE, BE IT RESOLVED by the City Council of the
City of Elk River, Minnesota, as follows:
1. A public hearing will be held at the time and place
set forth in the Notice of Hearing hereto attached to consider
said proposed improvements and special assessments.
2. The notice of said public hearing shall be in
substantially the form contained in the notice hereto attached.
3. The notice shall be published by the Clerk in the
official newspaper twice, the first publication at least two
weeks prior to the hearing and the second publication a week
later but at least three days shall elapse from the second
publication to the date of the public hearing and the notice
shall be mailed to the owners of each parcel described in the
assessment roll at least two weeks prior to the hearing.
• - The motion for the adoption of the foregoing resolution
was duly seconded by member and upon
a vote being taken thereon, the following voted in favor
thereof:
and the following voted against the same:
Whereupon said resolution was declared duly passed and
adopted.
