Request
Beaudry Oil Co./John Weicht & Associates is requesting a variance to the
building setback and parking requirements to construct a canopy over the
existing fuel pumps.
• Location
Southwest corner of Lowell and Highway 10, 335 Lowell Avenue; Lot 3, Block
23, Village of Elk River, Sherburne County, Minnesota.

Background
Beaudry Oil Co./John Weicht &Associates is requesting a variance to
construct a canopy over existing fuel pumps already at variance to the
required setback.
The applicant has indicated Texaco requires the improvements to make this
110 store more closely resemble the company's national image.

*The applicant also needs a variance to the parking setback for his existing
parking areas along Highway 10 and Lowell already at variance to the
required setback.
Variance Requirements
Staff refers the Board to Section 900.40 of the City of Elk River code of
ordinance for the five standards to consider when reviewing a variance.
Recommendation
If the Board decides to grant this variance request, the following findings are
offered in support of that determination:
1. Literal enforcement would cause undue hardship in that the applicant
would not be able to make the improvements requested by Texaco
thereby presumably damaging relations.
2. The hardship is caused by special conditions peculiar to this lot such as
size and shape, and orientation to the highway.
• 3. The variance will not be injurious to or adversely affect the health,
safety or welfare of the residents of the city or the neighborhood, as the
fuel pumps already exist in the present location as does the building
and parking lots. The variance is necessary purely for improvements.
