) Call Meeting To Order
Pursuant to due call and notice thereof, the meeting of the Elk River Board of
Adjustments was called to order at 6:30 p.m. by Chair Anderson.

COMMISSIONER MOVED TO APPROVE THE JULY 22, 1997 BOARD OF ADJUSTMENTS
AGENDA. COMMISSIONER SECONDED THE MOTION. THE MOTION CARRIED 5-0.
-3.1. Rea>iu'est by Charles and Natalie Johnson for Variance,Public Hearing Case No.V
Charles and Natalie Johnson, 14146 182nd Avenue (Lot 11, Block 3, Pinewood
Subdivision) have requested a variance to allow a 25 foot high net along their
side property line. The applicants' property is located along the fairway of one of
the holes at the Pinewood Golf Course. The applicants are requesting the net to
prevent golf balls from being hit into their yard, causing damage to their house
and presenting a safety hazard.The applicants have requested the owner of the
golf course to put up net and he was not receptive to the idea. Staff
recommends approval based on the findings in the staff report and with the
condition the net be removed during winter months.
Chair Anderson opened the public hearing. There being no comments from the
public, Chair Anderson closed the public hearing.
Commissioner Minton expressed support for the request but questioned whether
or not hardship exists. Scott indicated if golf course had been laid out differently,
there would not be a need for the net.
Commissioner Mesich indicated he could not support Finding No.4. regarding
special conditions, since the applicant knew he was purchasing a home on a
golf course. Commissioner Thompson questioned whether or not the city can
anticipate similar requests from property owners on this golf course.

• Steve Ach indicated he has spoken with owner of course, Paul Krause, and he
stated he was not willing to put up a net.
Chair Anderson indicated he felt the property owner and owner of golf course
need to work out this issue.
COMMISSIONER MOVED TO RECOMMEND DENIAL OF THE VARIANCE REQUEST BY
CHARLES AND NATALIE JOHNSON TO ALLOW A 25' HIGH NET ALONG THEIR SIDE
PROPERTY LINE, PUBLIC HEARING CASE NO. V 97-5, BASED ON THE FACT THE
REQUEST DOES NOT MEET THE FINDINGS FOR GRANTING A VARIANCE, AND THE
FACT THERE MAY BE UP TO SIX OTHER PROPERTY OWNERS EXPERIENCING THE SAME
PROBLEM. COMMISSIONER SULLIVAN SECONDED THE MOTION. THE MOTION
CARRIED 5-0.
5. Adjournment
There being no further business, COMMISSIONER MINTON MOVED TO ADJOURN THE
MEETING. CHAIR ANDERSON SECONDED THE MOTION. THE MOTION CARRIED 5-0.
