SUBJECT: Request by Dan Frojd for Variance,
Public Hearing Case No. V 97-1
Request
Consider a request by Dan Frojd for a 2687 square foot variance to.the 4500
square foot maximum allowed for accessory buildings. The variance will
allow the replacement of a deteriorated garage with a larger metal building.

Background
The property is 19.5 acres in size and is zoned A1(Agricultural Conservation).
In the Al zone, lots between 10 to 20 acres in size are allowed up to 4500
square feet of accessory building area. Mr. Frojd currently has 5 accessory
buildings on the property.
Existing accessory structures
• 44' X 18' storage shed 792 square feet
• 37' X 32' metal shed 1184 square feet
• 39' X 51' quonset hut 1989 square feet
• 46' X 32' barn 1472 square feet
• 22' X 52' garage 1144 square feet

• The 5 existing accessory structures total 6581 square feet. The applicant
currently exceeds the maximum square footage allowed for accessory
buildings by 2081 square feet.
Proposed storage building
The existing garage is in disrepair and the applicant would like to replace it
instead of repairing it. The applicant would like to remove the existing
garage and construct a new metal building in the same location. The request
is to replace the 22' X 52' garage with a 35' X 50' metal building. The new
garage would be 606 square feet larger than the existing garage.

The 4 existing accessory structures and the proposed garage total 7187
square feet. This would exceed the maximum square footage allowed for
accessory buildings by over 50% (2687 square feet).
The Frojd's farm is located in a rural area of the city with a land use mix of
agricultural and large lot residential. The property to the south is a farm that
raises horses, to the east are crop lands and woods, the property to the west
is undeveloped and to the north is a residence.
The applicant has not indicated why he can not repair the existing structure.
The existing structure could be maintained without requiring a variance.
The applicant currently exceeds the maximum square footage allowed for
accessory structures by 2081 square feet. He has not shown any hardship as
to why he needs even more space.
Variance
A variance may be granted only if it meets the following five conditions:
1. Literal enforcement of the ordinance will cause undue hardship.
2. The hardship is caused by special conditions and circumstances which are
peculiar to the property and the structure involved and which are not
characteristic of, or applicable to, other lands or structure in the same area.

• 3. The literal application of the provisions of this ordinance would deprive the
petitioner of rights enjoyed by other properties in the same district under the
terms of this ordinance.
4. The special conditions and circumstances are not a consequence of the
petitioner's own action or inaction.
5. The variance will not be injurious to or adversely affect the health, safety
or welfare of the residents of the City or the neighborhood where the
property is located and will in keeping with spirit and intent of the
ordinance.
Recommendation
It is recommended the Board of Adjustment deny Dan Frojd's request for a
variance to the 4500 square feet allowed for accessory buildings based on the
following findings:
1. The literal enforcement of the ordinance will not cause undue hardship in
that the applicant currently exceeds 4500 square foot maximum allowed for
accessory structures by 2081 square feet.
2. The applicant must show that the special conditions and circumstances are
not a consequence of the petitioner's own action or inaction. In this case it is
the applicant's choice not to maintain the existing garage but to replace with
a larger building. It is his decision to replace the existing garage with a
larger building that is triggering the need for a variance.
3. The literal application of the provisions of this ordinance would deprive the
petitioner of rights enjoyed by other properties in the same district under the
terms of this ordinance. The applicant has failed to show that he will be
denied rights enjoyed by other properties in the area if he is unable to replace
the exiting garage will a larger building.
4. The applicant could maintain the existing garage without the need for a
variance.
