DATE: April 22, 1997 SUBJECT: Request by Scott LaPlante for Variance, Public Hearing Case No. V 97-2 Request Consider a request by Scott LaPlante for a 5 foot variance to the required 20 foot rear yard setback. The variance is requested in order to construct a 14' X 14' porch. Location 13104 180th Lane NW, Lot 20, Block 2, Mississippi Oaks Attachments • Location map • Letter from applicant • Site plan • Map of 180th Lane showing homes with decks Background According to Section 900.20 (6) of the Zoning Code, open porches can encroach into the rear yard setback. However, the applicant is proposing to enclose part of the deck and make it a 3 season porch and therefore would not be allowed to extend into the setback. The part of the deck that is not enclosed could extend into the setback. In June 1994 a building permit was issued for a single family house, at that time the proposed porch and deck were not included. The house was constructed with a upper level sliding glass door which was intended to provide access to a rear deck or porch. The applicant is now proposing to construct a 14' X 22' porch/deck combination to the rear of his house. This porch/deck will require him to encroach 5 feet into the rear yard setback. • 13065 Orono Parkway • P.O. In September 1995, after the home was built, the rear yard setback was increased to 20 feet. The required front yard setback is 30 feet; the applicant's home has a 35 foot front yard setback. Had the house been constructed with a 30 front setback, the proposed porch/deck would not require a variance. The 6 other homes on this cul de sac have decks and or porches extending from the rear of the house. Four of those were constructed prior to the increased rear yard setback; two of the homes were constructed after the change and meet the current setback requirement. A review of the building permits indicated that the other six homes had the decks or porches constructed at the same time that the house was constructed. The existing decks comply with the current setback requirements. The request to encroach 5 feet into the rear yard setback will not adversely affect the appearance of the neighborhood. This house, as well as all the others in this cul de sac, was constructed with a deck or with the intention of adding a deck at a later time. The variance requested is to allow the applicant to construct a deck of 308 square feet. Without the variance the deck would be limited to approximately 8 feet out from the house; the variance will allow the deck to extend approximately 14 feet from the house. • The variance request is a result of a special condition of the property . The q p p p location of the house was determined when the rear setback requirement was 10 feet. If that setback was in effect today, there would be no need for this variance request. Variance A variance may be granted only if it meets the following five conditions: 1. Literal enforcement of the ordinance will cause undue hardship. 2. The hardship is caused by special conditions and circumstances which.are peculiar to the property and the structure involved and which are not characteristic of, or applicable to, other lands or structure in the same area. 3. The literal application of the provisions of this ordinance would deprive the petitioner of rights enjoyed by other properties in the same district under the terms of this ordinance. 4. The variance will not be injurious to or adversely affect the health, safety or welfare of the residents of the City or the neighborhood where the property is located and will in keeping with spirit and intent of the ordinance. Recommendation • Staff believes that the this request meets the five conditions required for granting a variance and recommend the Board of Adjustment approve this variance request to allow a 15 foot rear yard setback for the purpose of constructing a porch/deck based on the following findings. 1. Literal enforcement of the ordinance will cause undue hardship in that the house was constructed when the rear yard setback was 10 feet. The house was setback further than it had to be and could have complied with the rear setback requirements applicable at the time the house was constructed. If the house was built at the minimum front yard setback, the home, including the proposed deck, could meet the rear yard setback currently in effect. 2. The hardship is caused by special conditions and circumstances which are peculiar to the property and the structure involved and which are not • characteristic of, or applicable to, other lands or structure in the same area. The problem is peculiar to this lot in that the other homes on this cul de sac that have decks had the decks constructed at the time the home was built and were built on lots that are deeper than the applicant's. 3. The literal application of the provisions of this ordinance would deprive the petitioner of rights enjoyed by other properties in the same district under the terms of this ordinance. Of the 7 other homes on this cul de sac, 6 of them have decks/porches attached to the rear of the house. 4. The special conditions and circumstances are not a consequence of the petitioner's own action or inaction. The house was located on the lot in such a way that it would comply with the setback requirements in effect at the time the house was constructed. After the home was constructed, the city increased the rear yard setback. 5. This is Lot 20, Block 2 in Mississippi Oaks. In the investigation of obtaining bids and a building permit,Elk River Building&Planning personnel identified an issue with the rear set-back(minimum distance from the rear lot line for structures)of the proposed addition. It was brought to my attention that the current rear set-back enforced in the Mississippi Oaks development is 25'. The current residential structure at 13104 180dj Lane NW was coed 30'from the rear lot line. The current ordinance does not allow for a useable porch or deck to be consnucted(5'in width or less). In further discussions with Elk River Building&Planning,I was informed that the rear set-back at the • time the house was built(Fall 1994)was 15'. This request is for a variance to construct a 14'x 14'three-season porch with an attached/adjacent 8'deck that will be in compliance with a 15'rear set-back(see attached diagram).
