Adopt, by motion, an ordinance amending Section 6-94 of the City Code regarding the sales of alcoholic
beverages.
Background/Discussion
On May 1, 2015, new state liquor laws became effective including the Bloody Mary Lazar which changes the
hours for the sale of intoxicating liquor on Sunday to 8 a.m. from 10 a.m.
In order for this change to take effect in Elk River, the Council needs to approve an amendment to City
Code.
A request was made by The Sunshine Depot to match the new hours approved in state law. Businesses
would like to be able to serve bloody mary's and mimosa's as part of their Sunday brunch specials.
Staff also recommends a change to the hours for the sale of 3.2 percent malt liquor off-sale in order to be
consistent with state law. If approved, sales can take place beginning at 10 a.m. instead of noon on
Sundays.
Cities can be more restrictive in liquor licensing and the Council wouldn't have to adopt these changes.
There were more changes in the liquor laws, but staff will come back with those at a later date. They do
not have as much of an effect on current liquor establishments. This change is being processed sooner in
order to accommodate businesses.

An Ordinance Amending Section 6-94, Regarding Hours of Sales for Alcoholic
Beverages, of the City of Elk River, Minnesota, City Code
The City Council of the City of Elk River does hereby ordain as follows:
SECTION 1. That§ 6-94 (a), 3.2 percent malt liquor of the City of Elk River Code of
Ordinances shall be amended to read as follows:
No sale of 3.2 percent malt liquor shall be made between 2:00 a.m. and 8:00 a.m. on the days of
Monday through Saturday, or between 2:00 a.m. and 12:00 neon 10:00 a.m. on Sunday.
SECTION 2.That§ 6-94 (c), Intoxicating liquor, Sunday sales, on-sale of the City of Elk River
Code of Ordinances shall be amended to read as follows:
Sales of intoxicating liquor for consumption on the premises by hotels, restaurants, bowling centers,
or clubs which have on-sale licenses and which also have facilities for serving not less than 30 guests
at one time shall be permitted between the hours of 10:00 8:00 a.m. on Sundays and 2:00 a.m. on
Mondays in conjunction with the serving of food, provided that the licensee is in conformance with
the Minnesota Indoor Clean Air Act. An establishment serving intoxicating liquor on Sunday must
obtain a Sunday license. A Sunday license shall be issued for a one-year period running from July 1
to June 30 and shall be subject to all provisions of this chapter.
SECTION 4. That this ordinance shall take effect upon adoption and be published as provided by
law.
