Item# city of � MEMORANDUM Elk Ri• ver TO: The Board of Adjustments FROM: Stephen Wensman, Planner &frV DATE: August 24, 1999 SUBJECT: Request by Mark Jorgenson for a Variance, Public Hearing Case No. V 99-10 Request Please consider a request by the applicant for a 5 foot variance from the 10 foot minimum setback from the property line and an 8 foot variance from the 20 foot minimum distance from any structure in order to construct a new septic system. Location • 13726 189th Avenue NW, Elk River, Lot 15, Block 2, Camp Cozy 5th Addition, that part of the SE 1/4 of Section 30, Township 33 N, Range 26 W. Zoning/Land Use Rlb (Single Family Residential)/MR (Medium Residential) Attachments • Location/zoning map • Neighborhood plan • Site plan • Legal description of property • Letter from the applicant Overview The applicant plans to sell his property and is required by City Ordinance to bring the septic system up to code because the property lies within the Elk River Shore land. The property is located in the Urban River Segment of the 411 Shore land. 13065 Orono Parkway • P.O. The minimum lot area for individual septic is 160 ft wide and an acre in size. The applicant's property is roughly 1/3 of an acre. Due to the small lot size, there are few good locations for a septic system and well. Septic Systems According to City Ordinance: • Septic systems must maintain a 75-foot minimum distance from the Elk River. • Septic systems must maintain a 50-foot minimum distance from the well. • Septic systems must maintain a 10-foot minimum distance from property lines. • Drain fields must maintain a 20-foot minimum distance from any structure. • Septic tanks must maintain a 10-foot minimum distance from any structure. As indicated on the site plan, the variance is being requested because the applicant's proposed septic system does not meet the 10-foot minimum • setback from the property line, nor does it maintain a minimum 20-foot distance from any structure. The proposed septic system does conform to the minimum setbacks from the river and well and the tanks meet the setbacks from structures. As indicated on the neighborhood plan, the neighbor's buildings, wells, and drain fields are located such that they do not interfere with the proposed location of the applicant's septic system. Granting of Variance Staff refers the Board of Adjustments to Section 900.40 of the City of Elk River Code of Ordinances for the five standards to consider when reviewing a variance. A variance may be granted only if it meets the following five conditions: 1. Literal enforcement of the ordinance will cause undue hardship. 2. The hardship is caused by special conditions and circumstances, which are peculiar to the property and the structure involved and which are not characteristic of, or applicable to, other lands or structure in the same • area. \\elkriver\sys\shrdoc\planning\stevewen\pcmmo\v99-10.doc Memo to the Board of Adjustments/V 99-10 August 24, 1999 Page 3 • 3. The literal application of the provisions of this ordinance would deprive the petitioner of rights enjoyed by other properties in the same district under the terms of this ordinance. 4. The special conditions and circumstances are not a consequence of the petitioner's own action or inaction. 5. The variance will not be injurious to or adversely affect the health, safety or welfare of the residents of the city or the neighborhood where the property is located and will in keeping with spirit and intent of the ordinance. When considering the variance request, staff concurs with the applicant that there are no other locations for the proposed septic system. City Ordinance requires a new septic system be installed with the sale of the home. Staff and the applicant believe the literal enforcement of the ordinance will cause undo hardship for the following five reasons. (See the attached letter from the applicant). 1. Staff believes that the Literal enforcement will cause undo (unnecessary, unavoidable, extreme) hardship because there are no other locations for a • septic system. 2. Staff believes that the hardship is caused by special conditions and circumstances, which are peculiar to the property or structure involved because the property as created was too small to provide adequate locations for septic systems. 3. The literal application of the provisions of this ordinance would deprive the applicant of rights enjoyed by other properties in the same district under the terms of this ordinance because all the properties in camp cozy have septic systems. 4. The special conditions and circumstances are not a consequence of the petitioner's own action or inaction because the new septic system is a requirement of Elk River City Ordinance. 5. The variance will not be injurious to or adversely affect the health, safety or welfare of the residents of the city or the neighborhood because the septic system is designed properly and there are many other legal non- conforming lots, structures and septics in the subdivision. • \\elkriver\sys\shrdoc\planning\stevewen\pcmmo\v99-10.doc Memo to the Board of Adjustments/V 99-10 August 24, 1999 Page 4 • Recommendation Staff recommends that the Board of Adjustments approve this request for a 5 foot variance from the 10 foot minimum setback from the property line and an 8 foot variance from the minimum distance from any structure so the applicant can construct a new septic system based on the following five conditions for granting a variance: 1. LITERAL ENFORCEMENT OF THE ORDINANCE WILL CAUSE UNDUE HARDSHIP. 2. THE HARDSHIP IS CAUSED BY SPECIAL CONDITIONS AND CIRCUMSTANCES WHICH ARE PECULIAR TO THE PROPERTY AND THE STRUCTURE INVOLVED AND WHICH ARE NOT CHARACTERISTIC OF, OR APPLICABLE TO, OTHER LANDS OR STRUCTURE IN THE SAME AREA. 3. THE LITERAL APPLICATION OF THE PROVISIONS OF THIS ORDINANCE WOULD DEPRIVE THE PETITIONER OF RIGHTS ENJOYED BY OTHER PROPERTIES IN THE SAME DISTRICT UNDER THE TERMS OF THIS ORDINANCE. 4. THE SPECIAL CONDITIONS AND CIRCUMSTANCES ARE NOT A CONSEQUENCE OF THE PETITIONER'S OWN ACTION OR INACTION. 11111 5. Ave.NW in Elk River and accordingly must bring the septic system up to code. After talking with Kevin Kloeppner of Eco Systems it was determined that due to the subject's lot size this would be the only system which could ever be put on this property. With this in mind Kevin designed the most effective, efficient and longest lasting system possible. The proposed drainfield is located over 115 feet from the river and in excess of 115 feet from the neighbor's wells to either side of the subject property. These wells are metal encased and in excess of 50 feet deep. I have enclosed a letter from George Cowles who installed the well on the subject property stating that the subject's well is 89 feet deep. I have included the proposed design of the system and it's location on the subject property. Also,there is a description of the materials and design of the septic system to be installed.
