The applicant requests a Zone Change and Conditional Use Permit to allow a 42,000 sq. ft. facility for truck sales and service at 10743 168th Circle NW. Chair Johnson opened the public hearing for the zone change. Tim Dolan, Decklan Group, stated that he represented the applicant. He noted that only one of the lots needs to be rezoned. He stated that the applicant is in agreement with staff's comments and is willing to work with them on addressing the conditions. There being no further comments from the public, Chair Johnson closed the public hearing. Chair Johnson stated that he did not see a reason to not approve the rezoning and felt the use would go well with the existing uses and new businesses being proposed for this area. Motion by Commissioner Johnson and seconded by Commissioner Theil to recommend approval of the request by GATR Truck Center for a zone change from Business Park to Highway Commercial, Case No. ZC 15 -03. Motion carried 5 -0. Chair Johnson opened the public hearing for the Conditional Use Permit request by GATR Truck Center. There being no comment from the public, Chair Johnson closed the public hearing. Motion by Commissioner Johnson and seconded by Commissioner Larson -Vito to recommend approval of the request by GATR Truck Center for a Conditional Use Permit for truck sales and service, Case No. CU 15 -09, with the following conditions: 1. As a Conditional Use Permit is not a building permit, all necessary permits must be acquired before any work begins. 2. Remove outdoor storage area identified on the site plan. 3. Pave the trailer parking area east of the facility with bituminous pavement. 4. Address all comments in the staff comment letter dated April 17, 2015. Motion carried 5 -0. 4.4 Request by City of Elk River for Ordinance Amendment for accessory structure permits, Case No. OA 15 -03 — Public Hearing Zack Carlton explained that the ordinance amendment would increase the minimum accessory structure size requiring a building permit from 120 sq. ft. to 200 sq. ft. Also, the amendment would eliminate the size requirement for compliance with minimum setbacks and specific material standards and include all accessory structures. He noted that the building official is interested in adding a land use application to inspect all accessory structures, even if less than 200 sq. ft.
