Adopt, by motion, a resolution acknowledging the $1,505 in contributions from the Elk River Youth Lacrosse Association. Background/Discussion The Elk River Youth Lacrosse Association approached the city to assist in purchasing an auxiliary tank and attachments for our Kromer Field Commander. This piece of equipment is used by parks maintenance for painting athletic field lines for all youth sports programs. An auxiliary tank is needed to do multiple colors of paint allowing staff to paint athletic field lines at Oak Knoll for both the boys and girls lacrosse programs. Girls' lacrosse field measurements and lines are different than the boys. Since this was not planned in our budget, lacrosse agreed to pay back the city for the auxiliary tank. They also agreed to pay the additional cost of field athletic paint required to make additional field lines for girls' lacrosse. Currently, the city has multiple color field paint that the manufacturer provided at no cost with the purchase of an auxiliary tank. Financial Impact N/A Attachments • Athletic Field Lining Agreement • Resolution Acknowledging Contributions P0WInII a Template Updated 4/14 [NATUREJ Athletic Field Lining Agreement THIS AGREEMENT ("Agreement") made this 15th day of June, 2015, by and between the CITY OF ELK RIVER, a Minnesota municipal corporation ("City"), the Elk River Lacrosse Association, a Minnesota nonprofit corporation (the "Association"). RECITALS A. The City owns and operates the athletic fields at the Oak Knoll Athletic Complex. B. The Elk River Youth Lacrosse Association has asked the City to install additional field lining colors for girl's lacrosse games at the Oak Knoll Athletic Complex. C. Without a substantial financial contribution by the Association, the City would be unable and unwilling to install additional athletic field lining at the Oak Knoll Athletic Complex. D. The City is relying upon this Agreement to install additional field lining colors for athletic fields at the Oak Knoll Athletic Complex. NOW, THEREFORE, IN CONSIDERATION OF THEIR MUTUAL COVENANTS THE PARTIES AGREE AS FOLLOWS: 1. INITIAL CONTRIBUTION. The Association shall pay the City $505.00 as an initial contribution towards the City's costs to purchase an auxiliary tank with attachments to paint athletic field lines at the Oak Knoll Athletic Complex at the time of execution of this Agreement. 2. SUBSEQUENT CONTRIBUTIONS. The Association shall make an additional contribution to the cost of a paint auxiliary tank for multiple field lining at Oak Knoll in the amount of $1,000.00. The additional contributions shall be paid to the City in two (2) annual payments, the first payment of$500 to be made on July 1, 2016 and the final payment of$500 to be made on July 1, 2017. 3. FIELD TIME COMMITMENT. The Association shall have the same priority rights to use of the City's athletic fields as other users pursuant to then-applicable City Policies, including the City's field allocation policies. Failure of either Association to make its initial contribution and all additional contributions as provided in the Agreement shall be cause for the City to deny that Association athletic field time. Dietz, Mayor Its AND AND Tina Allard, City Clerk Its 2 City of Elk River Councilmember introduced the following resolution and moved its adoption: Resolution 15- A Resolution of the City of Elk River Acknowledging Contributions WHEREAS, the City of Elk River is grateful to all civic groups, organizations, and individuals for their contributions to the community;and WHEREAS, the City of Elk River received a $1,505 donation from Elk River Youth Lacrosse Association with the intent it be used by Parks and Recreation for auxiliary tank with attachments to paint athletic field lines.. NOW, THEREFORE, BE IT RESOLVED by the City Council, by at least four-fifths vote, to acknowledge the support and commend Elk River Youth Lacrosse Association for their donation. The motion for adoption of the foregoing resolution was duly seconded by Councilmember , and upon vote being taken thereon, the following voted in favor thereof: and the following against: ,whereupon said resolution was declared duly passed and adopted.
