An Ordinance Amending Sections, 58-3 I, "Definitions" and 58-37, "Containers" of the
City of ilk River, Minnesota, City Code, to incorporate the Sherburne County Subsurface
Sewage Treatment System Program
The City Council of the City of Elk River does hereby ordain as follows:
SECTION 1. That § 58-31, "Definitions" of the City of Elk River Code of Ordinances shall be amended
to add the following definition:
Door -.ride Serziice means the hauler provides cart collection services from near the premises for those elderly
and disabled customers determined unable to maneuver carts to the end of the driveway:
SECTION 2. That § 58-37, "Containers" of the City of Elk River Code of Ordinances shall be amended
to read as follows:
(d) Placement for collection. Where an alley open to traffic is available, each container for premises
abutting the alley shall be placed at the rear of the property next to the alley. Where no alley exists, the
container shall be placed near the rear door of the building to which it relates and shall be placed at the
front property line for collection, but it shall not be so placed before 7:00 p.m. the night before
collection and shall be removed by 7:00 p.m. the day of collection.
(e) Door -side Service - The Collector shall provide door -side service for elderly and disabled customers,
approved by the City Administrator or his/her designee under provisions of the Door -side Operating
Order.
(1) Customers in need of Door -side Service shall apply and receive approval from the City
Administrator or his or her designee.
(2) Recipients of Door -side Service shall indemnify both the Collector and the City for any damages to
residential or personal property or persons.
(3 Carts placed for Door -side Service shall be made easily accessible for the Collector and shall be
placed in front of the garage or parking stall. The Collector shall not be required to enter through the
garage, fences, or other containments.
{e)(t Use of containers. Refuse shall be drained of liquid and household garbage shall be wrapped before
being deposited in a container. Highly inflammable or explosive material shall not be placed in
containers.
SECTION 6. That this ordinance shall take effect upon adoption and be published as provided by law.
