Request
Consider a request by Madison Marquette Realty Services for an amendment to
their conditional use permit to increase the allowed sign height from 19 feet to 30
feet and to increase the allowed sign area from 80 square feet to 126 square feet.

Overview
Madison Marquette Realty Services is requesting an amendment to their conditional
use permit to increase the allowed monument sign height from 19 feet to 30 feet and
the allowed sign area from 80 square feet to 126 square feet.
On June 21, 1999, Madison Marquette Realty Services was granted a conditional use
permit (Public Hearing Case No. CU 99-18) to construct the North Memorial Clinic
at the Elk River Plaza PUD. At that time, the Elk River Plaza Planned Unit
Development Agreement was amended as follows:

Addition, and an 8-foot tall monument sign on Lot 3, Block 2, Elk
River Plaza as shown on the approved site plan.
In the records, staff could not find an elevation of the approved 19-foot monument
sign or any notes on the site plan indicating the proposed sign height. The staff
memorandum indicated that the amount of sign area proposed was 80 square feet.
In preparation for the public hearing, staff prepared videotape simulating the
proposed pylon sign at the 19-foot height and a 30-foot height utilizing the Utilities
boom truck. Images were taken from the immediate surroundings and from
Highway 169.
Simulation Observations
Staff concluded from the simulation that a 19-foot high sign would not visible from
Highway 169 and would be below the existing conifer trees. A 30-foot sign would be
visible from Highway 169 and does not appear out of scale or character with its
surroundings. The proposed 30-foot sign would be smaller than the Burger King
sign to the north and would better fit the site.
Sien Area
City Ordinance defines sign area as:
...the area of the largest face including its border area.
If a sign has an irregular shape or has open spaces within
its border, the sign area shall be the area of the smallest
single rectangular figure that encloses it. If the sign is
composed of two or more individual cabinets or other
structures containing advertising messages, the sign area
shall be the sum of all the areas of the individual
cabinets or structures including their border areas
A comparison of signs along the Highway 169 corridor shows that the proposed sign
is most closely aligned with the Hillside Crossing development in regards to the
amount of commercial space, sign area and the number of tenants identified on the
sign. From this comparison, it appears that the request for greater sign area is
reasonable.

Recommendation
Staff and the Planning Commission recommend that the City Council approve the
amendment to the Conditional Use Permit to increase the allowed monument sign
height from 19 feet to 30 feet and to increase the allowed sign area from 80 square
feet to 126 square feet.
1. THAT A SIGN PERMIT IS OBTAINED FROM THE ELK RIVER PLANNING
DEPARTMENT PRIOR TO ANY INSTALLATION OF SIGNS.
THAT NO CONIFERS ON THE ELK RIVER PLAZA PROPERTY OR ALONG
THE HIGHWAY 169 RIGHT- OF-WAY EAST OF THE SITE BE REMOVED
WITHOUT APPROVAL OF THE CITY OF ELK RIVER PLANNING
DEPARTMENT.

AMENDMENT NO. 4
to
ELK RIVER PLAZ& DEVELOPMENT' AGREEMENT
CITY OF ELK RIVER, SI-IERBURNE COUNTY, MINNESOTA
TI-[IS AMENDMENT NO. 4 is made effective the 21st day of June, 1999, by and
between the CITY OF ELK RIVER, Sherburne County, Minnesota (the City), and
ELK RIVER SHOPPING CENTER COMPANY, a Minnesota partnership, 9110 83~
Avenue North, Brooklyn Park, M;nnesota 55445.
WITNESSETH:
WI-IE~, on December 24, 1984, the parties hereto entered into Elk River
Plaza Planned Development Agreement, which agreement, was amended by
Amendment No. i effective December 31, 1985, and by Amendment No. 2, effective
March 16, 1987, and by Amendment No. 3, effective September 21, 1987; and
WHEREAS, the City Council on June 21, 1999, approved the Replat of Lot 4,
Block 2, of Elk River Plaza, as Elk River Plaza 4th Addition.
VfI-IEREAS, on June 21, 1999, the Elk River City Council approved an
amenetment to the Elk River Plaza Planned Development Agreement to permit the
development of Elk River Plaza 4m Addition by the placement of the following
improvements on the property: A 15,000 square foot retail building on Lot 1, Block
1, Elk River Plaza 4~ Addition; the placement of a 200 seat Class I restaurant with
on sale liquor, a 6,500 square foot retail builr~ng on Lot 2, Block 1, Elk River Plaza
4th Addition, and the placement of a 40,00 square foot medical office on Lot 3, Block
1, Elk River Plaza 4z Addition.
NOW, THEREFORE, it is hereby agreed by and between the parties here as
follows:
1.) The Elk River Plaza Planned Development Agreement is hereby
amended to allow the construction of the following improvements:

A 15,000 square foot retail building to be located on Lot 1, Block 1,
Elk River Plaza 4m Addition; and
A Class I restaurant with on-sale liquor, and 6,500 square foot retail
on Lot 2, Block 1, Elk River Plaza 4th Addition; and
A 40,000 square foot medical office building on Lot 3, Block 1, Elk
River Plaza 4m Addition; and
A 19-foot tall monument sign on Lot 2, Block 1, Elk River Plaza 4th
Addition, and an 8-foot tall monument sign on Lot 3, Block 2, Elk
River Plaza as shown on the approved site plan.

Wall signage as follows:
1. Free standing retail building on Lot 1 - Each tenant shall have.
no more than ! wall sign except for ~he drug store at the east
end of the building, which will 'be allowed 2 signs. Wall
signage shall consist of individual letters. Capital letters shall
be no larger than 32" high; lower case letters shall be no more
than 24" high. Letters shall extend no closer than 3'-4' from
projected lease line.
_Attached restaurant/retail building on Lot 2 - Restaurant shall
have 2 wall signs and retail tenants shall have 1 wall sign.
Signs shall consist of individual letters. Capital letters shall
be no larger than 32" high; lower case letters shall be no larger
than 24" high. Letters shall extend no closer than 3'-4' from
projected lease line.
2.) It is further a condition of approval of the authorized development
that the same shall be completed in conformance with the attached site plan
approved by the Planning Commission and City Council and that all signage and
lettering shall be consistent with the approved site plan and as outlined in this
amendment.
3.) The words, phrases, terms, and conditions used herein shall be
interpreted the same as those used in the Elk River Retail Center Planned Unit
Development Agreement.
4.) All other terms and conditions of the Elk River Plaza Planned Unit
Development Agreement, as amended, shall remain in full force and effect and shall
be binding upon the parties hereto, except to the extent clearly inconsistent with the
terms and conditions of this Amendment No. 4.
IN WITNESS WHEREOF, the parties have caused this Amendment No. 4 to
be duly executed in their names and on their behalf on or as of the date first above
written.
