1. Call Meeting To Order
Pursuant to due call and notice thereof, the meeting of the Elk River Board of
Adjustments was called to order at 6:30 p.m. by Chair Mesich.
2. Consider 1/25/00 Board of Adjustments Agenda
COMMISSIONER THOMPSON MOVED TO APPROVE THE JANUARY 25, 2000, BOARD
OF ADJUSTMENTS AGENDA. COMMISSIONER KUESTER SECONDED THE MOTION.
• THE MOTION CARRIED 7-0.
3. Consider 12/28/99 Board of Adjustments Minutes
COMMISSIONER THOMPSON MOVED TO APPROVE THE DECEMBER 28, 1999, BOARD
OF ADJUSTMENTS MINUTES. COMMISSIONER KUESTER SECONDED THE MOTION. THE
MOTION CARRIED 7-0.
4.1. Request by Mark Rothfork/John Weicht & Associates for Variances, Public Hearing
Case No. V 00-1
Staff report by Michele McPherson. The applicant originally requested four
variances for Lots 3 and 4, Block 1, McChesney Industrial Park (18983 York Street),
in order to construct a 6,000 square foot building addition. He has since revised
the site plan so that only one variance is needed; to reduce the side yard
setback from 25 feet to 21.6 feet. Ms. McPherson reviewed the 5 conditions
which must be met to grant a variance. She explained why staff feels the
applicant meets each of these requirements.
Ms. McPherson reviewed a concern regarding the close proximity and shared
parking/driving aisles. She explained that a condition has been recommended
to prohibit conversion of the easterly overhead door on the north building to full
loading dock status. This will prevent two full semis from parking in an off-set
manner, one at each building, and allow emergency vehicle access to the rear
of the south building.

• Commissioner Thompson asked if the fire chief has reviewed the plans. Ms.
McPherson stated that the fire chief has reviewed and approved the proposal.
Chair Mesich opened the public hearing.
Chair Mesich asked if the applicant had planned to put in the overhead door.
John Weicht, applicant,stated that he would put in the door if it were allowed.
Commissioner Kuester had a concern regarding the dumpster. Mr. Weicht
addressed her concern by explaining the location of the dumpster in relation to
the retaining wall. Commissioner Kuester asked what the distance was between
the retaining wall and the driveway. Mr. Weicht stated that it was 25 feet.
Mr. Weicht noted that they have allowed for three overhead loading doors on
the site, so that the easterly overhead door on the north building is not necessary
to accommodate semis.
There being no further public comment, Chair Mesich closed the public hearing.
COMMISSIONER THOMPSON MOVED APPROVAL OF THE REQUEST BY MARK
ROTHFORK/JOHN WEICHT&ASSOCIATES FOR A 3.4 FOOT SIDE YARD SETBACK
VARIANCE, PUBLIC HEARING CASE NO. V 001, BASED ON THE FOLLOWING
FINDINGS:
1. THE APPLICANT TO COMPLY WITH THE COMMENTS IN THE ENGINEER'S MEMO OF
JANUARY 19,2000.
• 2. THE EASTERLY OVERHEAD DOOR ON THE BUILDING SHALL NOT BE CONVERTED
TO FULL LOADING DOCK STATUS.
3. CROSS PARKING AND DRIVE AISLE AGREEMENTS SHALL BE APPROVED AND
EXECUTED PRIOR TO ISSUANCE OF A BUILDING PERMIT.
COMMISSIONER CHAMBERS SECONDED THE MOTION. THE MOTION CARRIED 7-0.
6. Adjournment
There being no further business, COMMISSIONER SCHUSTER MOVED TO ADJOURN
THE MEETING. COMMISSIONER THOMPSON SECONDED THE MOTION. THE MOTION
CARRIED 7-0.
