Request
The applicant requests that a variance be granted to reduce the required sign setback
from a property line from 10 feet to zero feet in order to reinstall the Ridgewood
development sign.

Analysis
The sign identifying the Ridgewood Development was originally installed without a
permit and on the property line. As the applicant's narrative indicates, a car hit the sign
during the winter of 1999, knocking it from its foundation. In order to reinstall the sign in
its original location, a variance is required.

Staff refers the Board of Adjustments to Section 900.40 of the Zoning Code for the five
• standards to consider when reviewing a variance. A variance may be granted only if it
meets the following five conditions:
1. Literal enforcement of the ordinance will cause undue hardship.
2. The hardship is caused by special conditions and circumstances, which are peculiar
to the property and the structure involved and which are not characteristic of, or
applicable to, other lands or structure in the same area.
3. The literal application of the provisions of this ordinance would deprive the petitioner
of rights enjoyed by other properties in the same district under the terms of this
ordinance.
4. The special conditions and circumstances are not a consequence of the petitioner's
own action or inaction.
5. The variance will not be injurious to or adversely affect the health, safety or welfare
of the residents of the city or the neighborhood where the property is located and
will be in keeping with spirit and intent of the ordinance.
Literal Enforcement
• Literal enforcement of the code requirement would set the sign 10 feet from the
property line and into the woods. The sign would also be on tall pilings due to the deep
ditch that parallels both roads.
Special Conditions
The subject parcel has unique topographic and wooded conditions that make placing
the sign at the setback difficult. Due to the number of trees, several would need to be
removed in order to see the sign.
Deprivation of Rights
The sign ordinance allows residential developments to have signs that identify the
overall development. Denying the variance would not necessarily deny the right to the
sign, but makes locating the sign more difficult. Other residential developments have
similar signs, but have been able to meet the ordinance requirements (Lafayette
Woods).
Petitioner's Action or Inaction
The applicant was not responsible for the topography or the vegetative quality of the
• property. The request is due to both of these qualities of the property.

• Adverse Impacts
Granting the variance would not create adverse impacts to adjacent properties or uses.
The sign is located out of the vision safety zone for traffic purposes. The rights of way
on both Proctor Road and Ridgewood Drive are wide enough that the sign, set at the
property line, does not pose a safety hazard.
Recommendation
Staff recommends that the Board of Adjustments approve this request to reduce the
sign setback from 10 feet to zero feet as the applicant meets the following five
conditions for granting a variance:
1. LITERAL ENFORCEMENT OF THE ORDINANCE WILL CAUSE UNDUE
HARDSHIP.
2. THE HARDSHIP IS CAUSED BY SPECIAL CONDITIONS AND
CIRCUMSTANCES WHICH ARE PECULIAR TO THE PROPERTY AND THE
STRUCTURE INVOLVED AND WHICH ARE NOT CHARACTERISTIC OF, OR
APPLICABLE TO, OTHER LANDS OR STRUCTURE IN THE SAME AREA.
• 3. THE LITERAL APPLICATION OF THE PROVISIONS OF THIS ORDINANCE
WOULD DEPRIVE THE PETITIONER OF RIGHTS ENJOYED BY OTHER
PROPERTIES IN THE SAME DISTRICT UNDER THE TERMS OF THIS
ORDINANCE.
4. THE SPECIAL CONDITIONS AND CIRCUMSTANCES ARE NOT A
CONSEQUENCE OF THE PETITIONER'S OWN ACTION OR INACTION.
5. THE VARIANCE WILL NOT BE INJURIOUS TO OR ADVERSELY AFFECT THE
HEALTH, SAFETY OR WELFARE OF THE RESIDENTS OF THE CITY OR THE
NEIGHBORHOOD WHERE THE PROPERTY IS LOCATED AND WILL BE IN
KEEPING WITH SPIRIT AND INTENT OF THE ORDINANCE.
Staff also recommends that the property owner grant the Ridgewood Association an
easement to locate the sign on private property.

From: Ridgewood Homeowners Association
The attached pictures reflect the sign that the Ridgewood Homeowners Association desires
to reinstall at the intersection of Proctor Road and Ridgewood Drive. The orange stake in the
location picture is the Northwest corner of the right-of-way on the corner of Ridgewood Drive
and Proctor Road. We request authorization to vary from the setback requirements and
install the sign on the property line. Following the setback requirements would require trees
to be cut and the sign would be lower in the ditch thus making it much less functional. The
sign was constructed and initially installed approximately four years ago. At the time of
installation, Ridgewood Association was unaware of any sign size or setback requirements.
This past winter, a car slid off the icy road while turning off Proctor onto Ridgewood Drive and
hit the sign while narrowly missing the utility pole.
• The sign is much larger than the City's normal street sign and is more aesthetic. This sign
provides a good landmark when giving directions to the area and provides a source of pride
for the Ridgewood neighborhood.

Moving the Sign beyond the easement line would entail cutting some trees along with putting the sign at
the bottom of the ditch.This would also require the sign to be higher.
