1. Call Meeting To Order
Pursuant to due call and notice thereof, the meeting of the Elk River Board of
Adjustments was called to order at 6:30 p.m. by Chair Mesich.
2. Consider 8/22/00 Board of Adjustments Agenda
COMMISSIONER PEDERSON MOVED TO APPROVE THE AUGUST 22, 2000, BOARD OF
ADJUSTMENTS AGENDA. COMMISSIONER KUESTER SECONDED THE MOTION. THE
• MOTION CARRIED 5-0.
3.1. Request by Marlene Hentaes for Variance to Minimum Lot Width Requirement,
Public Hearing-Case No. V 00-3
Staff report by Scott Harlicker. Marlene Hentges requests a variance to the
minimum lot width requirement in order to subdivide approximately 23 acres
located at 12137 223rd Avenue NW. Mr. Harlicker indicated that the parcel
currently has 66 feet of frontage, each lot would have 33 feet of frontage. If the
variance is granted, the applicant will be requesting an administrative
subdivision. Staff recommends approval of the request and reviewed the five
findings listed in the staff report.
Commissioner Chambers asked what the reason was for the "finger" shaped
portion of Parcel A. Mr. Harlicker stated that was the 66' wide access for the
parcel and that staff will be recommending that the proposed property line be
changed to create a more triangular shape for the lots at 223rd.
Commissioner Baker asked if staff had any concerns regarding the shared
driveway. Scott Harlicker explained that an access agreement will be required as
part of the administrative subdivision.
Chair Mesich asked if the City would ever need to extend 223rd Avenue to access
the city trail. Mr. Harlicker stated that there is access to go both north and south
at County Road 33, at 221st and in Greenhead Acres. Ms. McPherson noted that
• when the landfill operation ceases, the area will be likely be reclaimed for some
type of recreational use which would have an access to the city trail.

• materials. They were in agreement that stucco and rock face block should not
exceed 50 percent of any building face.
Chair Mesich opened the public hearing. There being no public comment, Chair
Mesich closed the public hearing.
COMMISSIONER CHAMBERS MOVED TO RECOMMEND APPROVAL OF AN
ORDINANCE AMENDMENT TO THE DESIGN STANDARDS FOR THE BUSINESS PARK
ZONING DISTRICT AND TO ELIMINATE MULTI-TENANT BUILDINGS AS A CONDITIONAL
USE, AS PROPOSED. WITH THE FOLLOWING CHANGES:
D. LOADING SPACES/OVERHEAD DOORS-ADDITION TO LOADING
SPACES/OVERHEAD DOORS AS NOTED:
LOADING SPACES AND OVERHEAD DOORS MAY BE ALLOWED IN FRONT
YARDS AS A CONDITIONAL USE.
G. ARCHITECTURAL STANDARDS-CHANGES AND ADDITIONS TO
ARCHITECTURAL STANDARDS AS NOTED:
CLASS I MATERIALS: BRICK,MARBLE, GRANITE OR OTHER NATURAL STONE,
TEXTURED CEMENT STUCCO, COPPER, STAINLESS STEEL, GLASS AND
INTEGRAL COLORED SPLIT FACE(ROCK FACE) BLOCK. THE BUILDING FACE
SHALL NOT BE COMPRISED OF MORE THAN 50 PERCENT INTEGRAL COLORED
SPLIT FACE(ROCK FACE) BLOCK OR STUCCO.
ALL BUILDINGS SHALL BE CONSTRUCTED OF MATERIAL LISTED AS EITHER
CLASS II MATERIALS. AT LEAST 60 PERCENT OF EACH BUILDING WALL
FACING OR VISIBLE FROM A PUBLIC RIGHT-OF-WAY, OTHER PUBLIC RIGHT-
OF-WAY, OTHER PUBLIC PROPERTY OR RESIDENTIAL DISTRICT MUST BE OF
CLASS I MATERIAL. PORTIONS OF THE BUILDING NOT FACING OR VISIBLE
FROM A PUBLIC RIGHT-OF-WAY, OTHER PUBLIC PROPERTY OR RESIDENTIAL
DISTRICT MAY BE CONSTRUCTED OF A GREATER PERCENTAGE OF CLASS II
MATERIALS, NOT TO EXCEED 60 PERCENT, IF THE STRUCTURE OTHERWISE
CONFORMS TO ALL CITY ORDINANCES. IF A WALL IS VISIBLE BUT NOT
FACING A STREET, RESIDENTIAL DISTRICT OR PUBLIC FACILITY,THE
DEVELOPER MAY USE THE GREATER PERCENTAGE OF CLASS II MATERIAL,
PROVIDED THE WALL IS SCREENED FROM VIEW. THE MIXTURE OF BUILDING
MATERIALS MUST BE COMPATIBLE AND INTEGRATED.
COMMISSIONER KUESTER SECONDED THE MOTION. THE MOTION CARRIED 4-1.
Commissioner Pederson opposed.
6. Other Business
6.1. Update on August 21, 2000, City Council Meeting
Commissioner Baker was unable to attend the August 21, 2000, City
Council meeting.

HAVE FRONTAGE ON A CITY STREET; EACH LOT WOULD HAVE ADEQUATE
• EMERGENCY ACCESS AND EACH LOT WOULD BE ABLE TO MEET OR EXCEED
OTHER DIMENSIONAL REQUIREMENTS;
AND WITH THE FOLLOWING CONDITION:
1. THE SOUTHERN LOT LINE OF LOT A SHALL FOLLOW THE EXISTING DRIVEWAY.
COMMISSIONER PEDERSON SECONDED THE MOTION. THE MOTION CARRIED 5-0.
5. Adiournment
There being no further business, COMMISSIONER PEDERSON MOVED TO ADJOURN
THE MEETING. COMMISSIONER CHAMBERS SECONDED THE MOTION. THE MOTION
CARRIED 5-0.
