Overview
Elk River Extreme Motor Park (ERX) proposes to expand their current facility. ERX is a year-round
complex hosting snowmobile events in the winter and car, truck,ATV and go-cart racing in the summer
months.
The applicant is requesting to create a new zoning district,Extreme Commercial Recreation (XCR), to
accommodate their long term vision. Current zoning district standards and uses do not provide the
needed flexibility that a unique business like ERX requires. In working with the applicant, the city has
determined that establishing a new zoning district allowing the growth and expansion of their operation
will be a benefit to the city and the applicant. The new zoning district, like any other district,will include
a variety of permitted and conditional uses specific to the applicant's plans for expansion.
The creation of a new zoning district also provides the applicant more flexibility than a Planned Unit
Development (PUD) district would. When approving a PUD, the city reviews a specific site plan that
must be followed as growth occurs, and any deviation from that plan requires an amendment and
approval from both the Planning Commission and City Council. By creating a new zoning district the
applicant can acquire, subdivide, and develop property within the zoning district as needed.Amendments
to the zoning district are not required, and when developing a permitted use (as identified in the zoning
ordinance) only an administrative site plan review is required.
Any property owner within the city can apply for a zone change to their property. Creating this new
zoning district would allow any property owner that has at least 10 acres to request their property to be
zoned XCR.
Background/Discussion
ERX has historically operated under the regulations of an Interim Use Permit (IUP),which was first
issued on July 21, 2008 to operate at the current location. The current IUP has expired and the proposed
ordinance amendment will eliminate the need for an IUP in the future.

They are interested in expanding the size and scope of the existing business but also have a long term
vision for the growth and development of theirs and surrounding properties. Some of these activities are
short term visions with others being more long term.
The immediate to short.term uses include:
• Carlson Motorsports Expansion (CU 15-10)
• Rental Shop Space
• Off-Road Truck Racing
• Training/Development/Testing
The longer term uses include:
• Water Sports Facility
• Swap Meets
• Festivals
• Concerts
Staff and the applicant have been discussing their plans for expansion and development of the subject
property as well as the surrounding properties and felt the best approach was to create a new zoning
district to allow the current uses as well as the future uses.
With uses that are commercial and highway business in nature, staff is recommending the architectural
standards follow subsection 30-938(2) pertaining to building finish and subsection 30-938(3)pertaining to
roofs applies to this district.
The attached ordinance has been drafted to try to codify all the visions of the applicant but to also
maintain some of the current uses in the Commercial Reserve Transition District.
Utilities
The subject property is not located in the Urban Service District. Although the current project does not
require city services, some of the proposed permitted and conditional uses in the XCR.district will require
city services and this will have to be addressed in the future.
Planning Commission
The Planning Commission reviewed this application at their June 23, 2015 meeting. No concerns were
raised'by the commission regarding the request. The public hearing was opened and continued to the
July 14, 2015 meeting.

Sec.30-1027. -XCR extreme commercial recreation.
(a) Purpose.
The extreme commercial recreation district is intended to provide lodging, retail, and a
variety of commercial recreation uses that are more intense in nature than traditional
recreational uses. Some uses•may include,but are not limited to, off road racing,
hotels, and training facilities.
(b) Permitted'uses.
(1) Retail shops and stores.
(2) Business and professional offices.
(3) Class I restaurants.
(4) Class II restaurants.
• (5),Public parks,playgrounds, and open space.
(6) Agriculture horticulture uses(ten-acre lots or more).
(7) Facilities for flood and erosion control.
(c) Accessory uses.
(1) Accessory structures.
(2) Signs as permitted in section 30-851 et seq.
(3) Public shelters and essential services.
(4) Overflow event parking.
(d) Interim uses. Interim uses shall be permitted for no more than five years, or when the
property is platted,whichever occurs first. The city may require a[n] escrow to ensure
the conditions of the interim use are adhered to.
(1) Roadside sales stands.
(2) Wind generators.
(3) Gravel mining.
(4) Asphalt and concrete plant.
(5) Veterinary clinics commercial kennels.
(6) Conditional home occupation.
(e) Conditional uses.
(1) Off road racing facilities.
(2) Water sports training facility.
(3) Limited Stay Lodging.
(4) Active use storage.
(5) Campground- for a period of no more than seven (7) consecutive days.

(6) Hotels.
(7) Outdoor storage,provided the storage area:
a. Is accessory to a principal permitted,interim, or conditional use; and

b. Complies with the accessory structure setback requirement applicable to the
property; and
c. Is no larger than 30 percent of the building area and
d. Includes screening so as to provide a visual barrier. Any such barrier shall
reduce visibility in a manner that restricts vision of the object being screened,
but is not required to totally block the vision of any such object.
1. Screening shall consist of two or more of the following:
i. A compact evergreen or deciduous hedge or evergreen, overstory and
ornamental trees of sufficient width and density; or
a. Hedge material must be at least three feet in height.
b. Deciduous trees must be at least two inches in diameter as
measured six inches above the ground.
c. Coniferous trees must be at least six feet in height.
ii. An earth berm of sufficient height to provide an effective screen
throughout the year; or
a. Earth berms shall not have a slope of more than three feet
horizontal to one foot vertical or be located within any street right-
of-way unless otherwise approved by the city engineer.
iii. A screening fence constructed of one or more of the following
materials:
a. Factory finished metal or vinyl panels.
b. Wood.
(f) Architectural standards. No provision of section 30-938 except subsection 30-938(2)
pertaining to building finish and subsection 30-938(3) pertaining to roofs applies to this
district.

(2) Exterior building finish.
a. In the C-1, C-2 and C-3 districts, the exterior building finish shall consist of at least
two of the exterior building finishes, at least two shall be used per wall:
1. Face brick.
2. Natural stone.
3. Architectural glass. (i.e. curtain wall)
4. Wood.
5. Stucco.
6. Siding. (metal, fiber-cement or vinyl)
7. Integrally colored split face (rock face), bur nished or glazed concrete masonry
units (excluding smooth/plain or painted).
8. Other city approved architectural materials.
b. In the I-1 and I-2 districts, the exterior building finish shall consist of the following
exterior building finishes:
1. ,Face brick.
2. Natural stone.
3. Architectural glass. (i.e. curtain wall)
4. Wood.
5. Stucco.
6. Integrally colored split face (rock face), burnished or glazed concrete masonry
units (excluding smooth/plain or painted).
7. Integrally colored and/or exposed aggregate precast concrete panels.
8. Poured-in-place concrete walls.
9. Prefinished metal panels.
10. Other city approved architectural metal.
(3) Roofing standards. Roofing shall consist of a shingled, prefinished metal panel and/or
membrane roof.
