Robert Tousignant, General Manager of Timeout Restaurant, has asked that the City Council discuss allowing liquor establishments to remain open until 2 a.m. BACKGROUND At the June 23, 2003 City Council meeting, the Council directed staff to send letters to the local liquor establishments informing them of this issue to be discussed at the July 14, 2003 City Council meeting. At the july 14, 2003 city Council meeting, no one from the local liquor establishments was in attendance. No feedback from residents or businesses had been received. It was stated by Councilmember Kuester that she could see proceeding with the 2 a.m. closing if the city had any requests from liquor establishments but since the city had received none, there was no reason to move forward. It xvas the consensus of the Council to put this item on hold and wait to see if any comments are received or if neighboring cities pursue the 2 a.m. closing. At that time the cities of Andover, Anoka, and Ramsey had been contacted and no action had been taken. Recendy staff has received the following information. Big Lake - no requests for 2 a.m. closing. Rogers - has not changed its ordinance to allow a 2 a.m. closing. Ramsey - changed their ordinance effective May 20, 2004 to allow 2 a.m. bar closings. Two establishments have applied and paid for a permit to stay open the added hour. One establishment has opted to not stay open later. The staff member felt that four establishments might consider applying for the 2 a.m. closing at the time of renewing their liquor licenses. The City of Ramsey is charging a fee of $300. Otsego - has not changed its ordinance to allow a 2 a.m. closing. They have not had any requests. Anoka - will be on their next meeting agenda for consideration. Andover - will be on June 15 council meeting agenda for consideration. The following cities have gone to the 2 a.m. closing: Coon Rapids, Blaine, and Spring Lake Park. Depending on the City Council direction, an ordinance, which changes the closing time for liquor establishments, can be put on a future agenda. If approved, then local liquor establishments would have to submit a permit requesting the extension of their operating hours. Once this is received and processed, it would be sent to the State. Presentation of I,ife Saving Medals Police Chief Jeff Beahen stated ~h~,t,o~ne 29, 2003 Officers Peterson and Besser responded to a medical at 21308 VX~kgn Street on a report of a possible heart attack. The victim, Stephen Bolstad of Min~onka,~,~nt into cardiac arrest. Mr. Beahen explained that neighbors Pat and Bill Redn)~ came to the~tim's aid and performed CPR rmtil officers arrived. Officers applied/their AED and shocke"d~Mr. Bolstad four times, restoring both his pulse and his respiratiofi. IX/tr. Mr. Bolstad was in aNendance and '~' expressed his thanks to Pat and Bill Redman and to Officers Peterson and Besser for saving his life. Consider Ordinance Amendment to Allow for 2:00 a.m. Closing for Liquor Establishments Citvo ~ Administrator Pat Klaers stated, that new state law 'allows municipalities to change their local ordinances to allow for the 2:00 a.m. closing of on-sale liquor establishments. Mr. Klaers stated that when this item was discussed at the June 23, 2003 meeting, the idea of competition between Elk River establishments and establishments in other cities came up. Police Chief Beahen stated that he has been in contact with Andover, Anoka, and Ramsey and they are taking no action at this time. Mr. Klaers indicated that letters were sent to local liquor establishments and an ad was placed in the ,gtarlYew. f informing residents and businesses of this meeting, giving them an opportunity to voice concerns or comments. Mr. Klaers stated that the city has not received any feedback from residents or businesses. Councilmember Tveite stated that he is leery about being the only city, in the area to allow the 2:00 a.m. bar closing and doesn't believe Elk River should rash into it. Councilmember Kuester stated that she could see proceeding with the 2:00 a.m. closing if the city had any requests from liquor establishments but since the city has received none, she stated that can't see moving forward at this point.
