Ordinance Amending the Zoning Map to Rezone Certain Property from Single - Family Residential to Business Park Action Requested a. Adopt, by resolution, the Land Use Amendment request by the City of Elk River to change the land use designation for a portion of Oudot F of Elk Path Business Center from Public/Institutional to Industrial. b. Adopt, by motion, the ordinance amending the City of Elk River zoning map to rezone certain portions of Oudot F, Elk Path Business Center, from BP (Business Park) to R -1c (Single -Family Residential) and from R -1c to BP. Background/Discussion City and county staff have been working together to position county property adjacent to the Sherburne County Government Center for a data center. As part of that discussion, a portion of county property must be rezoned from Single -Family Residential (R -1c) to Business Park (BP). The zoning district boundary is irregular in this area and adjusting the line to correspond to streets and property lines is desired. The attached map shows BP in purple and R -1c in green. At the conclusion of the process, the red area will be rezoned to BP, and the yellow area would be rezoned to R -1c. Access for a data center would come from a new road, as an extension of Rawlings Street. In order to accommodate the proposed rezoning, the underlying land use must be amended to reflect the proposed rezoning. Oudot F is currently guided for Public/Institutional uses and does not permit industrial uses. The proposal changes a section of Oudot F to Industrial to match the rezoning and accommodate future use as a Business Park. Zone Change Applicable Regulations In reviewing a proposed amendment, consideration shall be given to existing conditions within the area directly and indirectly affected by the proposal, the conservation ofproperty values, the use to which the property affected is being devoted at the time, and relevant provisions, if any, in the land use plan. P a w E R E U 6 Y NaA f RE] The proposed Land Use Amendment amends the Comprehensive Plan to reflect the proposed rezoning. The purpose of the Comprehensive Plan is to establish a framework and expectations as to the future use of land. In the review of the standards for a Zone Change as outlined, the request is consistent with these standards. Planning Commission The Planning Commission did not have any concerns with the request, and unanimously recommended approval. Public Hearing A resident expressed concern regarding potential noise associated with development as a data center. Their specific concerns were in regards to the cooling equipment. No additional comments have been received for or against the applications. The proposed use of the site is consistent with Light Industrial uses. 2. The land use is consistent with the surrounding land uses. 3. The use would not have adverse impacts on surrounding land uses. 4. The proposed changes are in general conformance to the adopted Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota, as follows: The Land Use Plan be amended to change the property as described above from Public/Institutional to Industrial. That the duly adopted Zoning Map of the City of Elk River is hereby amended to rezone the property described on attached Exhibit A from R -1c Single Family -Residential to BP Business Park. SECTION 2. That the rezoning approved by this Ordinance is based on the following findings: 1. THE REZONING IS CONSISTENT WTH THE CITY OF ELK RIVER LAND USE PLAN ADOPTED AS PART OF THE CITY OF ELK RIVER COMPREHENSIVE PLAN. SECTION 3.
