Action Requested
Recommend, by motion, approval of the Preliminary Plat for Solid Rock Addition with the following
conditions:
1. Surface water management fee be paid for one (1) lot in the amount required by the city (currently
$220 /lot) prior to releasing the Final Plat for recording.
2. All comments in the Environmental Memo dated July 8, 2015 shall be addressed.
3. A wetland delineation report must be completed and accepted by the city.
4. A 45 foot easement around all wetlands shall be added to the Preliminary Plat.
Background /Discussion
The subject property is part of the Brentwood subdivision which is zoned R -1a. This zoning district has
minimum lots sizes of 2.5 acres. The average sizes of the lots in Brentwood are 2.00 acres. Any lot that
is below the required lot size is a legal non - conforming lot. The applicant received a variance in 2013 for
the reduced lot sizes in this proposal.
The subject property containing the two residential structures and the church facility was originally
platted as eight lots in the Brentwood subdivision. In 1994, the eight lots were combined into the one
existing parcel today.
The applicant requests to subdivide the property into four lots, three lots for the existing structures and
one new buildable lot.
• Lot Twill be 1.85 acres, existing home
• Lot 2 will be 1.65 acres, existing home
• Lot 3 will be 1.50 acres, new buildable lot
• Lot 4 will be 8.06 acres, existing church building

Plat Approval: Sec. 30 -374
The findings necessary for ci y council approval of the pmliminary plat and the final plat shall be as follows:
(1) The proposed subdivision is consistent with the -oning regulations (article VI of this chapter) and conforms in
all respects with all requirements of this Code, including the tinning regulations and this article.
(2) The proposed subdivision is consistent with all applicablegeneral and specialitied ciy, couny, and regional
plans, including, but not limited to, the ciy's comprehensive developmentplan.
(3) The physical characteristics of the site, including but not limited to topography, soils, vegetation, susceptibiliy
to erosion and siltation, susceptibiliy to flooding, and drainage are suitable for the type and density of
development and uses contemplated.
(4) The proposed subdivision makes adequate provision for water supply, storm drainage, sewage transportation,
erosion control and all other services, facilities and improvements otherwise required in this article.
(S) The proposed subdivision will not cause substantial environmental damage.
(6) The proposed subdivision will not conflict with easements of record or with easements established by judgment
Of a court.
(7) The proposed subdivision will not have an undue and adverse impact on the reasonable development of
neighboring land.
(8) The proposed subdivision is not premature. A subdivision is premature if any of the following exists:
a. Lack of adequate stormwater drainage.
b. Lack of adequate roads.
C. Lack of adequate sanitary sewer systems.
d. Lack of adequate off -site public improvements or support systems.
In evaluating the conditions for approval of a preliminary plat, the proposal appears to satisfy all of the
conditions.
Park Dedication
Park dedication was satisfied with the original Brentwood Plat.

1. This plat has never had a wetland delineation. In the case of new plat,updated
wetland delineations are requested so that proper easements may be put in place with
the platting process. Please conduct the delineation for the four drainage easement
areas and submit the report with the appropriate Wetland Conservation Act
application to the City of Elk River (Local Government Unit).
2. It appears that two of the current easements (NW and South middle) may be
encroached upon by driveways.

"Natural Environment Wetland" and therefore is located within a "Natural
Environment Shorcland Di3trict."This district ha3 a number of additional
rcgulation3 and setbacks to keep in mind with future plans. At thi3 time, everything
on the property is in conformance.
2. The three wetlands located on the property shall have a 25 foot setback for mowing,
