Location 20020 Gary Street; Lot 7, Block 2, Countryside Acres Zoning/Land Use R1a (Single Family Residential) / LR (Low Density Residential) Attachments • Location map • Site plan • Air photo • Letter from applicant Overview The applicant is requesting a variance to the required 20 foot side yard setback in order to construct a 14 foot wide addition to the existing attached garage.The addition would be 10 feet from the side property line. • Phone:763.441.7420 Fax:763.441.7425 www.ci.elk-rivermn.us Memo to Board of Adjustment/V 01-06 September 25,2001 Page 2 • The lot is approximately 1 acre in size.There is a large wetland that covers about 1/3 of the lot. The house is located 24 feet from the south side property line. The septic system is located on the north side of the house.The area behind the house has trees and the terrain drops down to the wetland. The existing garage is 24 feet wide and 28 feet deep (672 sf.). The property is located in Countryside Acres. Countryside Acres is zoned R1a with a minimum lot size of 2.5 acres.However,this subdivision was platted prior to the R1a zoning and consists of lots that are about 1 acre in size. Variance Staff refers the Board to Section 900.40 of the City of Elk River Code of Ordinances for the five standards to consider when reviewing a variance.A variance may be granted only if it meets the following five conditions: 1. Literal enforcement of the ordinance will cause undue hardship. 2. The hardship is caused by special conditions and circumstances which are peculiar to the property and the structure involved and which are not characteristic of, or applicable to, other lands or structure in the same area. 3. The literal application of the provisions of this ordinance would deprive the petitioner of rights enjoyed by other properties in the same district under the terms • of this ordinance. 4. The special conditions and circumstances are not a consequence of the petitioner's own action or inaction. 5. The variance will not be injurious to or adversely affect the health,safety or welfare of the residents of the City or the neighborhood where the property is located and will in keeping with spirit and intent of the ordinance. Staff believes that the literal enforcement of the ordinance would cause undue hardship in that the additional garage space is needed in order to clean up the property and provide indoor storage of personal possessions.The code allows up to 2,000 square feet of accessory building area, with the proposed addition the applicant will have 1,148 square feet of accessory building area, well under the 2,000 square feet allowed by code. Another consideration is the size of the lot.The property is 1 acre in size in a zoning district where the minimum lot size is 2.5 acres.The required 20 foot side yard setback is appropriate for 2.5 acre lots but is difficult to comply with when the lot is one acre in size. The hardship is caused by special conditions and circumstances that are peculiar to the land in that the terrain,the wetland,location of the septic system and existing vegetation limit possible locations for a storage building. Other lots in the area do not have the same characteristics that limit the land that is available • to construct additional garage space. The special conditions relate to the physical characteristics of the site and the location of the house on the site. The granting of this variance would not adversely affect the health,safety or welfare of the residents of the city or the neighborhood. Recommendation Staff recommends that the Board of Adjustment grant the variance request to the required 20 side yard setback to allow the proposed garage addition to be setback 10 feet from the side property line. The recommendation is based on the following findings: 1. We only have 24 feet to the side property line. We are not able to build anywhere else on our property. Our lot is only one acre and 30% of it is encompassed by wetlands, which holds the water runoff from this end of the development. • • THAT LITERAL ENFORCEMENT OF THE ORDANANCE WOULD CAUSE • UNDUE HARDSHIP. The reason for our request to build on to our garage is for extra storage space for,boat, motor home, trailer, snowmobile, four wheeler, etc. Currently those items are park either in the driveway or on the side of the existing garage, which makes our house and yard look junky. We are also storing some of the items, which become a costly issue. THAT THE HARDSHIP IS CAUSED BY SPECIAL CONDITIONS AND CIRCUMSTANCES WHICH ARE PECULIAR TO THE LAND AND THE STRUCTURE INVOLVED AND WHICH ARE NOT CHARACTERISTIC OF OR APPLICABLE TO OTHER LANDS OR STRUCTURES IN THE SAME DISTRICT. Because our lot has a pond, which is about 1/3 of our lot, which holds the main water runoff for the north end of the development the backyard is mostly covered with water so we can't build the garage there. If we were able to build back there we would be driving on our drainfield. Our drainfield goes out on to the north side of the lot. In order for the garage to be put there the garage would be on top of the drainfield, to comply with the 35 foot set back. Behind our garage we have trees, at the trees is a steep decline down to the pond. THAT THE LITERAL APPLICATION OF THE PROVISIONS OF THE ORDINANCE WOULD DEPRIVE THE APPLICANT OF RIGHTS ENJOYED BY OTHER PROPERTIES IN THE SAME DISTRICT UNDER THE TERMS OF THE ODINANCE. Again it comes back to the size of our lot and the amount of the lot that is covered by water. We would like to keep our development looking nice without clutter around people's houses. With the addition to the garage we can store more of our items in the garage and not out in the open. THAT THE SPECIAL CONDITIONS AND CIRCUMSTANCES ARE NOT A CONSEQUENCE OF THE PETIONER'S OWN ACTION OR INACTION. The special conditions are that we have a pond in our backyard that is 1/3 of our lot and the drainfield on the north side that goes almost over to the side property line which makes it impossible to drive around to the backyard. • THAT THE VARIANCE WILL NOT BE INJURIOUS TO OR ADVERSELY • AFFECT THE HEALTH, SAFETY, OR WELFARE OF THE RESIDENTS OF THE CITY OR THE NEIGHBORHOOD WHEREIN THE PROPERTY IS SITUATED AND WILL BE IN KEEPING WITH THE SPIRIT AND INTENT OF THE ORDINANCE. Our request would be in the best interest of the neighborhood as far as appearance and safety. Everything would be stored away out of sight and out of harms way. S •
