Approve,by motion, an addendum to the agreement with FirstLab for drug and alcohol testing services
for commercial drivers.
Background/Discussion
In 2008, the city entered into an agreement with FirstLab to provide drug and alcohol testing
administration for our commercial vehicle drivers as required by the Federal Motor Carrier Safety
Administration. Pre-employment and random selection testing administration,lab and collection site
management, and medical review of test results are a sample of the required elements that FirstLab
provides. We use the Fairview Clinic in Elk River for our collection site and FirstLab contracts with
Medtox for laboratory services.
FirstLab has added an Annual Subscription Fee of$250.00,which requires an addendum to our original
agreement. When we received notice of the fee,we researched service providers used by other cities. We
found that most agreements varied by cost based on the method of collection provided; some have on-
site collection, some use a designated clinic, and some have a service administrator that does its own
collection. The results were that that the city would not benefit from making a change at this time.
The North Memorial Clinic in Elk River currently does collection and is considering program
administration in the near future,which we will consider when it becomes available.
Financial Impact
The Annual Subscription Fee is $250.00.

Dear Lauren:
This letter will serve as an addendum to the existing contract between Elk River and FirstLab for
additional services. Upon execution of this addendum, the following services will be added to
the existing contract:
Test/Services Fee
Annual Subeription $250.00 annually
Authorization for Addendum. The execution and performance of this Addendum by Firstl.Ab and Client
have been duly authorized by all necessary laws,resolutions or corporate action and this Amendment to
the Agreement constitutes the valid and enforceable obligations of FirstLab and Client in accordance
with its terms.
Continuing Force and Effect. All terms conditions and provisions of the Agreement, unless amended
herein shall remain in full force and effect. All capitalized terms used but not defined herein shall have
the meaning ascribed to them in the Agreement.
