Surface Water Management Impact Fee shall be paid for one dwelling unit at the rate applicable when the subdivision is released for recording. The 2015 rate for rural residential is $110 per lot. Overview The applicant proposes to split his 17.3-acre property into two lots, creating one new buildable lot and one lot for the existing home. Background/Discussion The property is west of Elk Lake Rd and generally south of 217th Ave and is zoned R1-a with minimum lot size of 2.5 acres. The proposed parcels are 6.14 and 10 acres in size. Comprehensive Plan The subject property has a Rural Residential Land Use. Rural Residential uses are guided to be developed as residential use in areas outside of the Urban Service Area that are not currently served by municipal sewer and water. The predominant land use in this area is single family detached homes. Parks Section 30-392 (e) indicates subdivisions shall be submitted to the Parks and Recreation Commission for review of park dedication requirements. The Commission recommended that Park Dedication shall be paid for one dwelling unit at the rate applicable at the time the lot split is released for recording. Environmental A wetland delineation was completed as part of the platting process and has been accepted by the city. A drainage and utility easement is provided around each wetland to preserve the required 45-foot structure setback as required by Sec. 30-1852 of the Elk River City Code. POWERED 9r UREI Transportation/ Circulation The proposed subdivision provides road right-of-way on the west half of Elk Lake Road (CSAH 1). Access to both the existing and proposed parcels will be from Elk Lake Road. Sherburne County must approve additional access drives from Elk Lake Road Applicable Regulations Subdivision These findings are necessary for the City Council approval of the preliminary plat and the final plat: (1) The proposed subdivision is consistent avitb the honing regulations (article VI of this chapter)and conforms in all respects with all requirements of this code, including the honing regulations and this article. (2) The proposed subdivision is consistent with all applicable general and specialised city, county, and regional plans, including, but not limited to, the city's Comprehensive Development Plan. (3) The physical characteristics of the site, including but not limited to topography, soils, vegetation, susceptibility to erosion and siltation, susceptibility to flooding and drainage are suitable for the type and density of development and uses contemplated. (4) The proposed subdivision makes adequate provision for water supply, storm drainage, sewage transportation, erosion control and all other services,facilities and improvements otbem'se required in this article. (5) The proposed subdivision will not cause substantial environmental damage. (6) The proposed subdivision will not conflict witb easements of record or nritb easements establisbed by judgment of a court. (7) The proposed subdivision will not have an undue and adverse impact on the reasonable development of neigbboring land. (8) The proposed subdivision is notpremature.A subdivision is premature if any of the following exists.- a. xists.a. Lack of adequate stormwater drainage. b. Lack of adequate roads. c. Park dedication shall be paid for one (1) dwelling unit at the rate applicable at the time the lot split is released for recording. The 2015 rate for residential is $3,712 per dwelling unit. Background/Discussion The applicant will be splitting their 17.3 acre property into two lots, creating one new buildable lot (10 acres) and the remaining lot (6.14 acres) for the existing home. The plat will also provide 50 feet of road right-of-way for county Road 1 along the entire eastern portion of the property. Section 30-392 (3) indicates lot splits shall be submitted to the Parks and Recreation Commission for review of park dedication requirements. A recommendation should be forwarded to the city council for consideration, along with the proposed subdivision. The Parks and Recreation Master Plan The Neighborhood Parks Service Area text in Chapter 5 of the master plan states, recreation facilities should be developed P)hen 300 or move households P)ithin cluster developments or on lots less than 2 acres are located V)ithin 1.5 miles of the park. The subject property does not meet this requirement. Therefore, staff recommends the Parks and Recreation Commission recommend park dedication be in the form of cash. Trail Connectivity (Figure 5.5), as indicated in the master plan, states that Other Future Trails are desired along County Road 1. Under Initiative 3 Strengthen Trail Connections,item 6 discusses the desire to have trails on both sides for rural collector and arterial roads. If the commission believes it is necessary, they could recommend a trail easement outside of the proposed County Road 1 right-of-way.
