07-14-2015 PC MINSpecial Meeting of the Elk River Planning Commission Held at the Elk River City Hall Tuesday, July 14, 2015 Members Present: Chair Eric Johnson, Commissioners, Garrett Christianson, Jeremy Johnson, Jill Larson -Vito and Brad Thiel Members Absent: Commissioners Andrew Crook and Mark Konietzko Staff Present: Planning Manager Zack Carlton, Senior Planner Chris Leeseberg and Sr. Administrative Assistant Debbie Huebner 1. Call Meeting to Order Pursuant to due call and notice thereof, the meeting of the Elk River Planning Commission was called to order at 6:30 p.m. by Chair Eric Johnson. 2. Pledge of Allegiance The Pledge of Allegiance was recited. 3. Consider 7/14/2015 Planning Commission Agenda Moved by Commissioner Larson -Vito and seconded by Commissioner Thiel to approve the June 23, 2015, Planning Commission agenda with the following changes: Move Item 4.2 to 4.1 and 4.1 to 4.2 Motion carried 5 -0. 4.1 Request by Envision Company, LLC — ERX for: 5.1a Ordinance Amendment to add a new extreme commercial recreational zoning district, Case No. OA 15 -04 — Public Hearing 5.1b Land Use Amendment to change the land use of the property located east of Hwy 169 and between the 215th and 221st road alignments, from Development Reserve /Mining /Residential to Highway Business /Mining, Case No. LU 15- 03 — Public Hearing 5.1c Zone Change from CRT (Commercial Reserve Transition) to XCR (Extreme Commercial Recreation, Case No. ZC 15 -06 — Public Hearing 5.1d Preliminary Plat Approval, Aggregate Commercial Third Addition, Case No. P 15 -05 — Public Hearing 5.1e Conditional Use Permit for Limited Stay Lodging, Case No. CU 15 -10 — Public Hearing Planning Commission Minutes Page 2 July 14, 2015 5.2 Request by the City of Elk River Elk River for Ordinance Amendments related to Extreme Commercial Recreation, Case No. OA 15 -07: 5.2a Section 30 -1— Definitions 5.2b Section 30 -880 — Extreme Commercial Recreation 5.2c Section 30 -1041— Principal Structures 5.2d Section 30 -1042 — Accessory Structure Setbacks Chris Leeseberg presented the staff reports for Items 5.1a -5.1e. Chair Johnson asked for clarification on roadside stands. Mr. Leeseberg stated that roadside stands typically sell farm products such as fruits and vegetables, or other seasonal items. He noted that this use is an interim use in the current ordinance for this zoning district. Chair Johnson asked if staff has considered food trucks as a use. Mr. Leeseberg stated yes, but that they are currently looking at the issue of food trucks in all zoning districts, including this one. Chair Johnson asked if the applicant had issues with any of the proposed conditions. The applicant indicated "no ". Mr. Leeseberg presented the staff reports for 5.2a — 5.2d. Chair Johnson opened the public hearing. There being no one to speak to this issue, Chair Johnson closed the public hearing. Motion by Commissioner Johnson and seconded by Commissioner Larson -Vito to recommend approval of an Ordinance Amendment to add a new extreme commercial recreational zoning district, Case No. OA 15 -04. Motion carried 5 -0. Motion by Commissioner Larson -Vito and seconded by Commissioner Johnson to recommend approval of a Land Use Amendment to change the land use of the property described from Development Reserve /Mining /Residential to Highway Business /Mining, Case No. LU 15- 03. Motion carried 5 -0. Motion by Commissioner Larson -Vito and seconded by Commissioner Johnson to recommend approval of a Zone Change from CRT (Commercial Reserve Transition) to XCR (Extreme Commercial Recreation), Case No. ZC 15 -06. Motion by Commissioner Johnson and seconded by Commissioner Christianson to recommend approval of the Preliminary Plat of Aggregate Commercial Third Addition, Case No. P 15 -05, with the following conditions: 1. Surface water management fee be paid in the amount required by the city (currently $1,287 /acre)prior to releasing the Final Plat for recording. 2. A development plan shall be approved by the city engineer prior to the issuance of building permits. 3. A wetland delineation report must be completed and accepted by the city. 4. A 45 foot easement around all wetlands shall be added to the Preliminary Plat. Planning Commission Minutes July 14, 2015 The Motion carried 5 -0. Page 3 Motion by Commissioner Larson -Vito and seconded by Commissioner Johnson to recommend approval of the request for a Conditional Use Permit for Limited Stay Lodging, with the following conditions: 1. The Conditional Use Permit is not a building permit and the applicant must apply for and receive approval of required building and sign permits before construction may begin. 2. The existing building and addition shall meet all building and fire codes. 3. All sources of artificial lights shall be so fixed, directed, designed or sized that the minimum subtotal of their illumination will not increase the level of illumination on any nearby residential property by more than 0.1 footcandle in or within 25 feet of a dwelling or by more than 0.5 footcandle on any part of the property. 4. The subject property shall be final platted prior to any permits being issued. 5. The limited stay lodging shall not exceed a period of seven (7) consecutive days. 6. There shall be no storage, repair, and /or maintenance of snowmobiles, cars, trucks, go- carts, and /or ATV's or other vehicles outside of the building. 7. All doors of the facility shall be kept closed at all times except for the passage of people or vehicles. 8. The level of noise from the building shall not exceed city ordinance levels. 9. All comments on the environmental memo dated June 5, 2015 shall be addressed. 10. All comments on the engineering division memo dated June 8, 2015 shall be addressed. 11. All comments on the stormwater coordinator memo dated June 10, 2015 shall be addressed. The Motion carried 5 -0. Motion by Commissioner Johnson and seconded by Commissioner Thiel to recommend approval of the following ordinance amendments: 5.2a Section 30 -1— Definitions 5.2b Section 30 -880 — Extreme Commercial Recreation 5.2c Section 30 -1041— Principal Structures 5.2d Section 30 -1042 — Accessory Structure Setbacks Motion carried 5 -0. 6.
