SR 06-14-2004TO: FROM: DATE: S U BJ ECT: MEMORANDUM Mayor and City Council Joan Schmidt, City Clerk June 14, 2004 Consider Premises Permit Renewal for Elk River Lions Club Item # 3.2.* REQUEST The Elk River Lions Club has requested to renew its premises permit to conduct charitable gambling at Broadway Bar and Pizza, 16754 Highway 10. The permit will run for two years from September 1, 2004 until August 31, 2006. APPLICANT Elk River Lions Club BACKGROUND The City's ordinance requires that 75% of the lawful purpose expenditures must be spent within the City's trade area. The trade area for Elk River includes the cities of Elk River, Ramsey, Otsego, Rogers, and Zimmerman. The attached chart shows that the amount of expenditures spent in the trade area during the years 2002 and 2003 exceeded the required 75%. ACTION REQUESTED A motion from Council adopting the attached resolution approving a premises permit for the Elk River Lions Club to conduct lawful charitable gambling at Broadway Bar and Pizza. S:\ Council\Joan\Gambling\ PremPermLionsClub.doc RESOLUTION 04- A RESOLUTION OF THE CITY OF ELK RIVER A RESOLUTION APPROVING PREMISES PERMIT RENEWAL FOR THE ELK RIVER LIONS CLUB WHEREAS, The Elk River Lions Club has made application to the State Gambling Control Board for a Premises Permit Renewal; and, WHEREAS, the Premises Permit will allow charitable gambling on the premises of Broadway Bar and Pizza located at 16754 Highway 10 in the City of Elk River for the period of September 1, 2004 to August 31, 2006; and, WHEREAS, The Elk River Lions Club has met the city's requirement of spending 75 percent of its lawful expenditures within the city's trade area during the past two years. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota that a Premises Permit be granted to The Elk River Lions Club to allow charitable gambling operations at Broadway Bar and Pizza located at 16754 Highway 10 in the City of Elk River, Minnesota.
