Subdivide Lot 5, Block I - Elk River Business Park
Request
The City Council is asked to consider an Admimstrative Subdivision (lot split) to subdivide
Lot 5, Block 1 Elk River Business Park into two parcels; a .95-acre site and the remnant that
will be 2.48 acres. The .95-acre parcel will be combined with the remnant of Lot 4, Block 1,
Elk River Business Park to create a development parcel for Gradient Technology.

Analysis
The applicant is requesting that Lot 5, Block 1, a vacant business park parcel, be subdivided
into a .95-acre parcel and a 2.48-acre parcel. The .95-acre parcel will be combined with the

remnant created by the subdivision of Lot 4 in 2003 for a prospective light industrial tenant
(Gradient Technology).
The combined parcel and the remainder of Lot 5 meet the Business Park District standards.
The subject parcel is vacant, and has been graded. Final development plans for Gradient
Technology have been submitted and are under review by staff. A building permit
application has also been submitted and will be issued pending Council approval of the
requested lot split and Tax Rebate Financing.
Drainage and utility easements will be required to be dedicated on either side of the new lot
line as required by the ordinance.
Recommendation
Staff recommends that the City Council approve the request for a lot split of Lot 5, Block 1,
Elk River Business Park with the following conditions:
DRAINAGE AND UTILITY EASEMENTS SHALL BE GRANTED
ALONG EITHER SIDE OF THE NEW LOT LINE.
THE REMNANT PARCEL SHALL BE COMBINED WITH LOT 4,
BLOCK 1, ELK RIVER BUSINESS PARK.
THE ADMINISTRATIVE SUBDIVISION SHALL SHOW LIMITED
ACCESS ALONG THE EAST FRONTAGE OF LOT 5, BLOCK 1
(ADJACENT TO TWIN LAKES ROAD).

Dear Ms. McPherson:
As requested, we have reviewed the administrative subdivision in the Elk River Business Park.
The information we reviewed was prepared by John Oliver and Associates and dated May 25,
2004. Based on our review, we would offer the following comments:

Previously in 2003, Lot 4, Block 1, was divided into two parcels through the
administrative subdivision process. This second administrative subdivision being
proposed currently takes the east side remainder of Lot 4, Block 1, and combines it with
Lot 5, Block 1, then divides that entire parcel into two pieces. The western portion of
the combined parcel is approximately two acres in size, and the eastern portion of the
combined parcel is approximately 2.5 acres in size.
Previously with the first administrative subdivision, the drainage and utility easements
along the original Lot 4/Lot 5 common boundary were vacated. With the current
administrative subdivision, new drainage and utility easements are provided along the
common boundary between the west half (Parcel C) and the east half (Parcel D) of the
combined then subdivided parcel.
The original plat of Elk River Business Park shows limited access all along the Tyler
Street frontage. This administrative subdivision should also continue to show limited
access along the Tyler Street (Twin Lakes Road) frontage.
We have reviewed the descriptions for Parcel C and Parcel D in this administrative
subdivision and find them to be correct.
