RE: CSAH 12 PLAN APPROVAL
Dear Council Members:
Attached is a resolution for the City Council's consideration approving the final plans for the
Sherburne County CSAH 12 upgrade. Because this is a Sherburne County improvement
project within the borders of the City of Ell< River, it is necessary for the County to get the City
Councit approval of the plans before the project can proceed.
As we have discussed many times before, the plan consists of a 4-lane urban style roadway
from County Road 13 heading east. This section is continued to approximately the east
boundary of Trott Brook Farms, at which point the section changes to a 2-1an,s rural section with
8-foot shoulders. The project also includes a detached bituminous pathwa~y along the urban
section on the north side of the roadway. Finally, the project includes all the necessary
channelization to accommodate the future signalization of the intersection of Tyler Street with
CSAH 12.
From a financial standpoint, the City's contribution to the cost of this project is anticipated to be
approximately $250,000. This is made up of construction costs of approximately $200,000
when the Sherburne County cost participation policy is applied to the project, and a pro rata
share of the TEA-21 grant is deducted from the City's cost. In addition, there is anticipated to
be overhead of approximately $50,000. As a percentage, the overhead may seem quite large,
but this is due to the fact that the TEA-21 grant does not cover any overheacJ costs. Sherburne
County will be preparing an agreement spelling out the terms and conditions of the cost
participation between the City and the County. They will ask for the City to formally adopt and
execute the agreement prior to the award of the project.
We would recommend that the City Council adopt the attached resolution so that the project
may proceed to the bidding phase, if you have any questions, I will be in attendance at your
June 12, 2000, City Council meeting.

The county has established a cost sharing policy for its public improvement projects
and the city had no influence in the development of this policy, nor does it have any
control over changes the board may deem appropriate in the future.
According to this policy and based on construction estimates, the cost to the city for
the County Road 12 project is $198,000 plus overhead. The city's only recourse to
being charged this amount by the county is to not have the project done, and this
doesn't seem reasonable at this time. I guess to a certain degree we should be
thankful that the county's policy wasn't structured so that our share would be more
because again, our only options are to pay or not have the project take place.
A county policy that requires municipal participation in public improvement projects
is reasonable. However, as discussed by the City Council a number of times in the
past few years, we cannot support the Sherburne County policy that calls for such
things as 100 percent municipality funding of any needed street lighting on county
roads, 100 percent municipality funding of any needed concrete curb and gutter on
county roads, and 100 percent municipality funding of any needed or replaced bike
paths for pedestrian movement. Accordingly, while I believe we have to pay the
county its requested amount, we should also make a statement about our continued
displeasure with their cost sharing policy. From a staff point of view, it is most
appropriate for the city's cost participation on County Road 12 to be applied toward
the improvements generally between new County Road 13 and Highway 169, which
is the area most significantly impacted by the commercial/industrial development
proposals.
Recommendation
It is recommended that the attached resolution be adopted and that the city
financially participate in the County Road 12 project (estimated amount of $198,000
plus overhead), but that we also do so with opposition to the current cost sharing
policy.

PLAN FOR THE RECONSTRUCTION OF COUNTY STATE-AID HIGHWAY
NO. 12 FROM COUNTRY STATE-AID HIGHWAY 13 TO THE EAST CITY LIMITS
WHEREAS
plans for Project No. SP 71-612-06 & SP 204-020-02 showing proposed
alignment, profiles grades and cross-sections for construction,
reconstruction or improvement of County State-Aid Highway No. 12 within
the limits of the City of Elk River as a Federal Aid Project have been
prepared and presented to the City.
NOW, THEREFORE, BE IT RESOLVED: That said plans be in all things approved.
Passed and adopted by the City Council of the City of Elk river this 12th day of June,
2000.
