Overview
In 1987, the City Council passed Ordinance 87-1 that established a £Lxed fee
to be paid for park dedication purposes and that the fee shall be set by
resolution of the City Council. In 1992 and 1995, the City Council passed
resolutions amending those fees.
The Park and Recreation Commission recently asked staff to research park
dedication fees in other cities. Staff surveyed 19 cities and found a variety of
approaches to park dedication fees with some greater than and some lesser
than Elk River. Overall, Elk River park fees fall to the low-to-middle by
comparison. Upon surveying cities, there were no obvious method that were
used to determine fees. The cities surveyed tended to have varying amounts
of developable land and varying needs for parks and park improvements.

According to Sherburno County, there has been a raw land value increase of
roughly 71% from 1995 to 1998. In 1905, raw land was selling for roughly
$7,000 an agre, and in 1998, roughly 12,000 an acre.
The City of St. Cloud recently hired the planning firm of SDU to study park
dedication fees in the region. Elk River was surveyed and will share in the
results when the study is completed in April or May of 1999.
Park and Recreation Recommendation
The Park and Recreation Commission has discussed park dedication fees for
several months and have made the following one year fee recommendation:
Residential:
$1,100/lot or dwelling unit with a $200 trail fee.
Commercial:
$3,000 per acre
Industrial:
$2,000 per acre
After sharing in the results of the St. Cloud study being conducted by SDU,
the Park and Recreation Commission hopes to use the information for future
park dedication fee recommendations.
Action Requested
Staff and the Park and Recreation Commission request that the City Council
approve the Resolution 99-~ to amend the park dedication fees.

CITY OF ELK RIVER
A RESOLOTION AMENDING THE PARK DEDICATION FEE FOR RESIDENTIAL,
COMMERICAL, AND INDUSTRIAL DEVELOPMENT
WHEREAS,
the City Council of the City of Elk River, in Ordinance 87-1, established
that a development fee may be paid for Park Dedication purposes and
that this fee shall be set by resolution of the City Council; and,
WHEREAS,
the City Council has received and reviewed a recommendation from the
Elk River Park and Recreation Commission that the Park Dedication Fees
be increased, due to the increased need for recreational opportunities
which increased development causes; increasing land values in the City
of Elk River; and the increasing costs of providing recreational
opportunities in the City of Elk River; and,
WHEREAS, the adoption of this resolution adjusts the Park Dedication Fees adopted
in Resolution 95-87.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk
River that the Park Dedication Fees paid to the City in lieu of 10% of the undeveloped
land shall be set at:
Residential:
$1,100/lot or dwelling unit with a $200 trail fee, effective 2/22/99.
Commercial:
$3,000 per acre, effective 2/22/99.
Industrial:
$2,000 per acre, effective 2/22/99.

Overview
Home Depot is requesting that a portion of a drainage and utility easement
located in the northeast corner of their lot be vacated. The easement was
oversized and the pro-initiative pick-up enclosure, attached to the north side of
the building, encroaches over a portion of the easement. Home Depot would like
to vacate that portion of the easement that is impacted by the pick-up enclosure.
The water line, sanitary sewer and storm sewer that are located within the
easement will not be affected by the proposed easement vacation.

Recommendation
Staff recommends the City Council approve the proposed easement vacation

Dear Mr. Harlicker:
As you requested, I have reviewed the easement vacation request proposed by the Home
Depot Company. This request is due to a small addition on the nor[h side of their building.
They are requesting the vacation of a small piece of the drainage and utility easement for the
public sanitary sewer and water main which goes around the northeast corner of the building.
would recommend that their easement vacation be approved, but with a smaller amount of
vacated easement. I would suggest that the easement only be vacated to a point five feet
outside the building structure. The remainder of the easement should remain in place. I have
also reviewed this recommendation with Dave Berg from the Elk River Municipal Utilities.

RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION FOR VACATING DRAINAGE AND UTILITY
EASEMENTS
Case No. EV 00-5
WHEREAS,
the property owner abutting the drainage, and utility easement has
requested the City Council in a petition dated May 17, 2000, to
vacate such easement according to law; and,
WHEREAS,
a public hearing was held on June 19, 2000, before the City Council
at the Elk River City Hall on such petition after due published and
posted notice had been given as well as personal notice to affected
property owners on June 2, 2000, and all persons interested were
given an opportunity to be heard; and,
WHEREAS, it appears that it will be in the best interest of the City to approve
such petition.
NOW, THEREFORE, BE IT RESOLVED that such petition is hereby granted and
the drainage and utility easement described as follows is hereby
vacated:
