MEMORANDUM
Mayor & City Council
Michele McPherson,~irector
of Planning
DATE: June 14, 2000
SUBJECT:
Reconsideration of Approval Of ZC 00-2 and
LU 00-2, Hoyt Partners
Request
The City Council, at its April 17, 2000 meeting agreed to continue the reconsideration of
their approval to change the land use and zoning of Parcel 3 (see attached map) of the
Hoyt Partners request to Highway Business and Highway Commercial from Light
Industrial and Business Park to June 19, 2000.
Previously, the City Council will have considered a land use change and rezoning for
Outlot D, Elk Path Center from Light Industrial and Business Park to Highway Business
and Highway Commercial. Assuming that the Council concurs with the Planning
Commission recommendation, it would be appropriate to allow Parcel 3 to remain Light
Industrial and Business Park.

Analysis
The original staff report and the action of the Planning Commission recommended that
Parcel 3 remain in Business Park Zoning. It was not intended to be zoned commercial
for the following reasons:
1. It does not have the same level of visibility as the parcels previously zoned
commercial,
2. It has difficult access issues due to the site lines and curves of Business Center
Drive and the closeness of the driveway to the Government Center, and;
3. It creates traffic conflicts due to potential levels of traffic and driveway locations.

Recommendation
Staff recommends that the City Council reconsider its motion to approve LU 00-2 and
ZC 00-2 and deny the requests as they relate to Parcel 3. Denying the request will
maintain the land use as Light Industrial and the zoning as Business Park.
