Overview
Hoyt Partners is proposing to plat 127 acres into 1 lot and 6 outlots. The plat also
includes platting the right-of-way for the realignment of Waco Street and
Business Center Drive from it current terminus at the Sherburne County
Government Center to Waco Street. The applicant has petitioned the City for the
extension of Business Center Drive and municipal utilities through the property to
Waco Street.

Lot sizes and future development
Lot 1, Block 1 4.50 acres
Outlot A 2.63 acres
Outlot B .63 acres
Outlot C 6.22 acres
Outlot D 3.74 acres

Lot 1, Block 1
This lot is zoned highway commercial and can be developed once the final plat is
recorded. Access to this site will be from Business Center Drive.
Outlots A and B
These two outlots total 3.36 acres and will serve as the location for storm water
management ponds.
Outlot C
This outlot is zoned Highway Commercial. In order for it to be developed it will
have to be platted. Future platting options include platting it as one large lot or
platting it into two or three smaller lots. Future uses of this lot will be commercial
in nature.
Outlot D
The City is requesting that the land use designation for this outlot be changed
from LI (Light Industrial) to HB (Highway Business) and the zoning be changed
from BP (Business Park) to C3 (Highway Commercial). If the requests for the
land use amendment and zone change are approved, the property can be
developed as highway commercial. Development of the site will require it to be
platted. Access to the site will be from both Business Center Drive and Waco
Street.
Outlot E
This lot is zoned BP (Business Park). Future development of this lot will require
platting. It is likely that configuration of future lots on this parcel will depend on
the needs of prospective developers. Access to the future development will be
from Business Center Drive and possibly Waco Street. Access to this area from
Mississippi Road should be eliminated or restricted.

Outlot F
This lot is zoned single family residential (Rlc). The western boundary of this
outlot should be changed so that it correspond with the correct Rlc zoning line.
Access to this property will from Mississippi Road.
Drainage and utilities
A 40 foot wide drainage and utility easement is proposed to cross Outlot E from
the west line of the Sherburne County Government Center to Waco Street. This
easement will allow for the extension of trunk sanitary sewer and watermain.
Additional comments are outlined in the City Engineer's memo.
Streets
The plat includes platting the right-of-way for Business Center Drive and Waco
Street. Additional comments regarding streets are outlined in the City Engineer's
memo.
Park and Recreation
Park dedication requirements will have to be met as each lot is platted. With this
plat, park dedication fees for Lot 1, Block 1 are due prior to recording the plat.
Park dedication requirements for the outlots will be due when they are platted.
Planning Commission Meetinq
At the Planning Commission meeting held on May 23rd, no one spoke at the
public hearing. Stewart Wilson, representing the applicant Hoyt Partners, was
available to answer questions. The Planning Commission recommended
approval of the preliminary plat.
Recommendation
The Planning Commission and staff recommend the City Council approve the
preliminary plat request for Elk Path Business Park with the following conditions:
1. ALL COMMENTS OF THE CITY ENGINEER BE ADDRESSED.
PARK DEDICATION FEES IN THE AMOUNT REQUIRED BY THE CITY AT THE TIME OF
FINAL PLAT BE PAID ON LOT 1, BLOCK 1 PRIOR TO RELEASING THE PLAT FOR
RECORDING. PARK DEDICATION REQUIREMENTS ON THE OUTLOTS ARE DUE WHEN
THEY ARE PLATTED.

SURFACE WATER MANAGEMENT FEE IN THE AMOUNT REQUIRED BY THE CITY AT THE
TIME OF FINAL PLAT BE PAID ON LOT 1, BLOCK 1 PRIOR TO RELEASING THE PLAT FOR

PRELIMINARY PLAT
Dear Ms. McPherson:
As requested, we have reviewed the preliminary plat submitted for the Elk Path Business
Center. This is the platting of the Hoyt Partners property in the western area of the City. The
plat itself creates one lot located at the future intersection of Business Center Ddve and the
realignment of Waco Street. The remainder of the plat is a sedes of outlots. Based on our
review, we would offer the following comments:
1. We have verified the alignment of Business Center Ddve and find that it replicates the
alignment on the construction plans for this area. There is some curve data on Waco Street
missing from the plat. It appears that Waco Street may be slightly different than the
construction plans. This needs to be vedfied and corrected if necessary.
2. The plat should provide access control along all TH 10 frontage and the Waco Street
frontage of Lot 1, Block 1.
3. The plat provides a 40-foot wide drainage and utility easement from the west line of the
Sherbume County Government Center across the Hoyt Partners property to Waco Street,
which will allow the extension of the trunk sanitary sewer and watermain in this area.
4. We believe that on the east line of Outlot F, located in the southeast corner of the plat, there
is an existing easement for watermain extension, which was accomplished with the Western
Area Phase II project. This should be shown on the plat.
5. We believe that all of the outlots that abut e'.:isting or proposed roadways should provide a
10-foot drainage and utility easement along these perimeters.
6. The street name of Business Center Ddve is missing from the plat.
7. Outlots A and B, lying west of the realigned Waco Street, should be dedicated to the City.
These two outlots are necessary for the storm water quality and detention pond to service
the extension of Business Center Drive and the realignment of Waco Street. Also, these
two outlots would be necessary for a further extension of Business Center Drive to service
properties lying west of the intersection.

No grading plan or storm drainage calculations have been provided for this final plat. We
assume that as a development proposal comes forward for Lot 1, Block 1, or as the outlots
are replatted to provide for development, grading plans and drainage calculations will be
provided at that time.
If you have any questions regarding any of these comments, I will be in attendance at your May
15, 2000, City Council meeting.
