REVISED FEASIBILITY STUDY

Dear Council Members:
Attached is a copy of the Revised Feasibility Study for the Western Area Phase IV
Improvements that was ordered by the City Council with the adoption of Resolution 00-27 on
April 24th, 2000. This Revised Feasibility Study removes the water main looping and street
construction on 185th Avenue (North Frontage Road of TH 10). It adds the westerly extension of
trunk sanitary sewer and water from the southwest corner of the Sherburne County Government
Center through the Hoyt Partners property to Waco Street. These changes in the proposed
improvements result in an increased total project cost to $2,677,500.00.
The project is proposed to be funded through three sources: (1) assessments to the benefiting
properties, (2) cooperative agreement funds from MnDOT, and (3) Municipal State Aid
construction funds. With the revised improvements, the area available for trunk sanitary sewer
and water assessments has increased substantially. Added to the proposed assessment role
was the remainder of the Hoyt Partners property and S&Z Investment property located west of
Waco Street. Still in the proposed trunk sewer and water assessment is the White property
(Wapiti Park) and the Roy property (Custom Motors). With these proposed trunk assessments,
all properties located north of County Road 30 in the western area will have been assessed for
trunk sanitary sewer and water. There are still a few small parcels located in the extreme
southwestern area that have yet to be assessed. With this increase in assessable area, the
amount of the project proposed to be assessed has increased to approximately $2,000,000.00.
The property owned by Denny Chuba and Rich Kincannon adjacent to TH 10 is not proposed to
be assessed, and in fact, is not even mentioned in the Feasibility Study because this property is
outside the Urban Service Area. Previously, the property owners petitioned to be removed from
the Urban Service Area, and this removal was granted by the City Council. I have talked with
Mr. Chuba regarding the possibility of being included in the Urban Service Area again. I have
indicated to him he would need to petition for this inclusion and suggested the best time to do
that would be after the City Council awards the construction contract indicating that trunk utilities
will be extended to Waco Street.

Given the enlarged area, with the addition of the Hoyt Partners property and the addition of the
S&Z Investment property, it would be appropriate to have an additional public hearing. Staff
would recommend that this public hearing, together with an assessment hearing for all
properties, be held on August 7, 2000. Attached are two resolutions for the City Council's
consideration that call for the public hearing and the assessment hearing on this project.

A RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION DETERMINING ASSESSED COST OF
IMPROVEMENT AND ORDERING PREPARATION OF
PROPOSED ASSESSMENT ROLL IN THE MATTER OF
WESTERN AREA PHASE IV IMPROVEMENT OF 2000
WHEREAS
costs have been determined for the Western Area Phase IV improvement
consisting of a contract price of $2,091,800.00, and expenses incurred or to be
incurred by the City in the making of the improvement in the amount of
$585,700.00, for a total cost of the improvement of $2,677,500.00.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota:
Based upon the City Assessment Policies, it is determined that the portion of this
improvement to be paid by the City and not assessed to benefited properties is
$591,700.00.
The portion of the cost to be assessed against benefited properties pursuant to the Elk
River City Assessment Policies shall be $2,085,800.00.
The assessments shall be payable in equal annual installments and shall extend over a
period of 5 to 15 years, the first of the installments to be payable on or before the first
Monday in January, 2001, with interest at the rate of 7.5% per annum from the date of
the adoption of the assessment resolution.
The City Administrator with the assistance of the Project Engineer shall forthwith
calculate the proper amount to be specially assessed for such improvement against
every assessable lot, piece, or parcel of land, without regard to cash valuation, as
provided by law, and shall have available at the City Administrator's office a copy of the
proposed assessment roll for public inspection.
Upon completion of the proposed assessment roll, the City Administrator shall notify the
Council and schedule a public hearing upon the proposed assessment, causing notice of
the hearing by publication and mail to be made at least two weeks prior to the hearing.

A RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION RECEIVING THE FEASIBILITY REPORT
AND ORDERING A PUBLIC HEARING ON THE
IMPROVEMENT IN THE MATTER OF THE WESTERN AREA PHASE IV
IMPROVEMENT OF 2000
WHEREAS,
the Revised Feasibility Report ordered by the Council in Resolution 00-27 has
been prepared with reference to the Western Area Phase IV improvement and
was received by the City on June 26, 2000; and
WHEREAS, the Feasibility Report recommends that the proposed improvement is feasible;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota:
The City Council will consider the Western Area Phase IV improvement as described in
the Feasibility Report and the assessment of the property abutting this proposed
improvement for all or a portion of the cost of the improvement pursuant to Minnesota
Statutes, Section 429 at an estimated total cost for the improvement of $2,677,500.00.
A public hearing shall be held before the City Council on the proposed improvement on
the 10thd day of July, 2000, at 6:00 o'clock p.m. at Elk River City Hall Council Chambers.
The City Clerk shall provide two published notices (one week apart) in the official
newspaper with at least three days between the last publication date and the hearing,
and mailed notice ten days prior to the hearing as required by law.
