Overview
Hoyt Partners is proposing to final plat 127 acres into 1 lot and 6 outlots. The plat
also includes platting the right-of-way for the realignment of Waco Street and
Business Center Drive from it's current terminus at the Sherburne County
Government Center to Waco Street. The applicant has petitioned the City for the
extension of Business Center Drive and municipal utilities through the property to
Waco Street. The plat received preliminary plat approval on June 19, 2000. The
proposed final plat is consistent with the approved preliminary plat.

Lot 1, Block 1 4.50 acres
Outlot A 3.28 acres
Outlot B 1.19 acres
Outlot C 6.09 acres
Outlot D 3.77 acres

Lot 1, Block
This lot is zoned highway commercial and can be developed once the final plat is
recorded. Access to this site will be from Business Center Drive.
Outlots A and B
These two outlots total 3.36 acres and will serve as the location for storm water
management ponds.
Outlot C
This outlot is zoned Highway Commercial. In order for it to be developed it will
have to be platted. Future platting options include platting it as one large lot or
platting it into two or three smaller lots. Future uses of this lot will be commercial
in nature.
Outlot D
This lot is zoned C3 (Highway Commercial). Development of the site will require
it to be platted. Access to the site will be from both Business Center Drive and
Waco Street.
Outlot E
This lot is zoned BP (Business Park). Future development of this lot will require
platting. It is likely that configuration of future lots on this parcel will depend on
the needs of prospective developers. Access to the future development will be
from Business Center Drive and possibly Waco Street. Access to this area from
Mississippi Road should be eliminated or restricted.
Outlot F
Outlot F was shown on the preliminary plat but not on the final plat; it is shown as
an exception on the final plat. The plat should be revised to include Outlot F and

the boundaries should correspond with those of the R1 c zoning district. Access
to this property will from Mississippi Road.
Drainaqe and utilities
A 40 foot wide drainage and utility easement is proposed to cross Outlot E from
the west line of the Sherburne County Government Center to Waco Street. This
easement will allow for the extension of trunk sanitary sewer and watermain.
Additional comments are outlined in the City Engineer's memo.
Streets
The plat includes platting the right-of-way for Business Center Drive and Waco
Street. Additional comments regarding streets are outlined in the City Engineer's
memo.
Park and Recreation
Park dedication requirements will have to be met as each lot is platted. With this
plat, park dedication fees for Lot 1, Block 1 are due prior to recording the plat.
Park dedication requirements for the outlots will be due when they are platted.
Recommendation
Staff recommends that the City Council approve Resolution No. 00-
approving the final plat for Elk Path Business Park with the following conditions:
1. ALL COMMENTS OF THE CITY ENGINEER BE ADDRESSED.
2. PARK DEDICATION FEES IN THE AMOUNT REQUIRED BY THE CITY AT THE TIME OF
FINAL PLAT BE PAID ON LOT 1, BLOCK 1 PRIOR TO RELEASING THE PLAT FOR
RECORDING. PARK DEDICATION REQUIREMENTS ON THE OUTLOTS ARE DUE WHEN
THEY ARE PLATTED.
3. SURFACE WATER MANAGEMENT FEE IN THE AMOUNT REQUIRED BY THE CITY AT THE
TIME OF FINAL PLAT BE PAID ON LOT 1, BLOCK 1 PRIOR TO RELEASING THE PLAT FOR
RECORDING. SURFACE WATER MANAGEMENT FEES ON THE OUTLOTS ARE DUE WHEN
THEY ARE PLATTED.
4. OUTLOT F BE SHOWN ON THE FINAL PLAT AND THE WESTERN BOUNDARY OF OUTLOT
F SHALL BE ADJUSTED SO IT CORRESPONDS WITH THE WESTERN BOUNDARY OF THE
R1C ZONING DISTRICT.

Dear Mr. Harlicker:
As requested, we have reviewed the final plat for the Elk Path Business Center. Based on our
review, we would offer the following comments:
As you are aware, the City Council is currently considering the extension of public
utilities and streets to service this area. A public hearing/assessment hearing is
scheduled for August 7, 2000. We anticipate that construction bids will be opened
prior to that meeting, so they will also be considered that evening. Since the City
Council will consider the final plat prior to the final decision on extending public
utilities and streets to this area, approval of the final plat should be conditioned on
the City extending those utilities and streets necessary to service the plat.
The final plat needs to provide access control along the entire frontage with TH 10,
excepting the new Waco Street intersection. Access control should also be provided
along the Waco Street frontage of Lot 1, Block 1.
Ten-foot wide drainage and utility easements should be provided around the outside
perimeter of all of the outlots. The one exception to this would be the old Waco
Street frontage of Outlots A and B.
Outlots A and B should be dedicated to the City of Elk River. Outlot A is necessary
for the ponding to be constructed with the public improvements, and Outlot B may be
necessary for a roadway connection to service property to the west. At a minimum, it
is anticipated that a driveway to serve the residential properties to the west will be
constructed along this alignment.

5. The plat we reviewed showed the residentially zoned property in the southeast
corner of the project as an exception to the plat. This property should actually be
included in the plat and possibly shown as another outlot.

CITY OF ELK RIVER
A RESOLUTION GRANTING FINAL PLAT APPROVAL FOR:
Elk Path Business Park
Case No. P 00-10
WHEREAS, application has been made for final plat approval, pursuant to
Section 1008.08 (1)(c) of the Elk River City Code of Ordinances, of the property
legally described on attached Exhibit A and hereinafter referred to as "the
Property"; and
WHEREAS, the application for preliminary plat approval has been referred
to the Planning Commission which has given its advice and recommendation to
the City Council; and
WHEREAS, a preliminary plat of the Property was approved by the City
Council June 19, 2000; and
WHEREAS, the proposed final plat is consistent with the preliminary plat
as approved by the City Council; and
WHEREAS, the proposed final plat complies with each of the conditions
set forth by the City Council in its approval of the preliminary plat of the Property;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF ELK RIVER, as follows:
It is hereby determined by the City Council for the City of Elk River as
follows:
A. The proposed subdivision is consistent with the Zoning Ordinance
and conforms with all of its requirements.
B. The proposed subdivision is consistent with all applicable general
and specialized city, county, and regional plans including, but not
limited to, the City's Comprehensive Development Plan.
C. The physical characteristics of the site, including , but not limited
to, topography, soils, vegetation, susceptibility to erosion and
siltation, susceptibility to flooding, and drainage are suitable for the
type and density of development and uses contemplated.
The proposed subdivision makes adequate provision for water
supply, storm drainage, sewage transportation, erosion control and
all other services, facilities and improvements otherwise required
herein.
The proposed subdivision will not cause substantial environmental
damage.

The proposed subdivision will not conflict with easements of record
or with easements established by judgment of a court.
The proposed subdivision will not have an undue or adverse impact
on the reasonable development of neighboring land.
Final plat approval is hereby granted for the Property, subject to the
conditions set forth in attached Exhibit B.
The officers of the City are hereby authorized, once the conditions set
forth in Exhibit B are met and complied with, to sign the final plat for the
Property and to issue a certified copy of this Resolution giving final
approval of the plat.
The owner of the Property is authorized to record the final plat as required
by law and shall file proof of said recording with the City. No building
permits will be issued for the Property until the final plat is recorded.
This final plat approval shall expire one year from the date of this
resolution if the final plat is not recorded within that time.
