Location Southeast Corner of the intersection of Highway 169 and Main Street. Zoning/Land Use PUD (Planned Unit Development) / HB (Highway Business) Attachments · Location map · Plat showing easements to be vacated · Resolution No. 00- Overview The applicant is replatting Lots 1 and 2, Block 1, Elk River Crossing. The replatting includes changing the common lot line between the two lots and the right-of-way for Zane Street. These changes to the existing lot lines trigger the need to vacate the existing drainage and utility easements that following the old lot lines. In order to simplify the description of the easements to be vacated, all the drainage and utility easements on Lot 1 and Lot 2 will be vacated. The easements to be vacated will be replaced with new easements approved as part of the replatting process for Elk River Crossing 2nd Addition. The preliminary and 13065 Orono Parkway · P.O. The City Engineer has reviewed the request and does not have any concerns regarding the proposed easement vacation. Recommendation Staff recommends the Council approve Resolution No. 00- approving the request to vacate the existing drainage and utility easements on Lot 1 and Lot 2, Block 2, Elk River Crossing with the following condition: 1. DOC RESOLUTION O0 - RESOLUTION FOR THE CITY OF ELK RIVER A RESOLUTION FOR VACATING DRAINAGE AND UTILITY EASEMENTS Case No. EV 00-7 WHEREAS, the property owner abutting the street, drainage, and utility easement has requested the City Council in a petition dated July 5, 2000, to vacate such easement according to law; and, WHEREAS, a public hearing was held on July 17, 2000, before the City Council at the Elk River City Hall on such petition after due published and posted notice had been given as well as personal notice to affected property owners on July 6, 2000, and all persons interested were given an opportunity to be heard; and, WHEREAS, it appears that it will be in the best interest of the City to approve such petition. NOW, THEREFORE, BE IT RESOLVED that such petition is hereby granted and the drainage, and utility easement described as follows is hereby vacated: Lot 1 and Lot 2, Block 2, Elk River Crossing, Sherburne County, Minnesota Adopted by the Elk River City Council this 17th day of July, 2000.
