Request
The applicant requests that the drainage and utility easements on Lot 5, Block 3,
Hillside Estates 4th Addition be vacated to allow recording of the plat The Woods at
Hillside.
Location
Lot 5, Block 3, Hillside Estates 4th Addition, located on Auburn Street five lots south of
the water tower

Analysis
Lot 5, Block 3 is vacant and was incorporated into the plat of The Woods at Hillside.
The configuration of the lot changed slightly in the incorporation due to the road design
of 195th Street. Because the lot configuration changed, the easements granted with the
4th Addition approval do not match the easements granted with the approval of the 9th
Addition. In order to record the plat for the 9th Addition, the easements from the 4th must
be vacated.

With the filing of the plat for the 9th Addition, the City will be obtaining the necessary
drainage and utility easements as required by the ordinance.
Recommendation
Staff recommends that the City Council approve the attached resolution vacating the
drainage and utility easements on Lot 5, Block 3, Hillside Estates 4th Addition.

RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION FOR VACATING DRAINAGE AND UTILITY
EASEMENTS
Case No. EV 00-6
WHEREAS,
the property owner abutting the street, drainage, and utility
easement has requested the City Council in a petition dated July 5,
2000, to vacate such easement according to law; and,
WHEREAS,
a public hearing was held on July 24, 2000, before the City Council
at the Elk River City Hall on such petition after due published and
posted notice had been given as well as personal notice to affected
property owners on July 6, 2000, and all persons interested were
given an opportunity to be heard; and,
WHEREAS, it appears that it will be in the best interest of the City to approve
such petition.
NOW, THEREFORE, BE IT RESOLVED that such petition is hereby granted and
the drainage, and utility easement described as follows is hereby
vacated:
Lot 5, Block 3, Hillside Estates Fourth Addition, according to the recorded plat
thereof situated in Sherburne County, Minnesota.
Adopted by the Elk River City Council this 24th day of July, 2000.
