PUBLIC HEARING/ASSESSMENT HEARING CONTINUATION
CITY OF ELK RIVER, MINNESOTA
Dear Council Members:
At the request of Stewart Wilson, the Western Area Phase IV Improvements public
hearing/assessment hearing was continued until Monday, August 14, 2000. As you are aware,
this is the project that proposes to extend Business Center Drive to Waco Street and realign
Waco Street, creating a new intersection with Trunk Highway (TH) 10. In addition to the street
improvements, there will be lateral sanitary sewer, watermain, and storm sewer along Business
Center Drive to serve the Stewart Wilson Property and trunk sanitary sewer and watermain from
the southwest corner of the Sherburne County Government Center over to Waco Street.
There are a total of four properties noticed for these hearings. They consist of the Stewart
Wilson property, the S & Z Investment property located just west of Waco Street, and two
properties located north of TH 10: the Roy property (Custom Motors) and the White property
(Wapiti Park). These four properties are proposed to be assessed for trunk sanitary sewer and
watermain at a rate of $3,800.00 per acre. In addition, the Stewart Wilson is proposed to be
assessed a total of $1,329,600.00 for lateral sanitary sewer, watermain, storm sewer, and street
on Business Center Drive. Both the Stewart Wilson property and the S & Z Investment property
have petitioned for these improvements.
I will be prepared to make a brief presentation concerning the proposed improvements and the
proposed assessments at the hearings. After my presentation, I will answer questions of the
City Council and/or property owners. Property owners can appeal their assessment by
providing a written notice of objection to the Mayor by the close of the assessment hearing. _A
property owner simply statin.q an oral obiection to the proposed assessment does not
constitute an appeal of the assessment.
At the close of the public hearing/assessment hearing, the Council should consider the attached
two resolutions. The first resolution orders the improvement. The second resolution adopts the
final assessment roll. The bid date for this project is set for Friday, August 11. Bids will be
tabulated and presented at Monday's meeting.

A RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION ORDERING THE IMPROVEMENT IN
THE MATTER OF THE WESTERN AREA PHASE IV IMPROVEMENT
OF 2000
WHEREAS
a public hearing relating to the Western Area Phase IV improvement was held
before the Elk River City Council after ten days mailed notice and two weeks
published notice of the hearing was given; and
WHEREAS
the City Council has duly considered the Feasibility Report and those matter
presented at the public hearing by those person desiring to be heard on the
matter;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota:
The Western Area Phase IV improvement is hereby ordered as recommended in the
amended Feasibility Report dated June 22, 2000.

RESOLUTION 00-
A RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION ADOPTING FINAL ASSESSMENT ROLL
WHEREAS
upon due notice properly made as required by law, the Elk River City Council has
met and heard and passed upon all objections to the proposed assessment for
the Western Area Phase IV improvement and has determined the amount to be
assessed against each individual property as the Council deems just;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota:
The final assessment roll, a copy of which is attached hereto and incorporated herein by
this reference, is hereby accepted and adopted and shall constitute the special
assessment against the lands therein named. Each such tract of land in the assessment
roll is hereby found to be benefited by the improvement in an amount not less than the
amount of the assessment levied against it.
Such assessment shall be payable in equal annual installments, including both principal
and interest, amortized in such amount annually as is required to pay the principal with
interest at 7.5% over a period of fifteen years.
The owner of any property so assessed may at any time prior to certification to the
County Auditor of the assessment or the first installment thereof, pay to the City
Treasurer the whole of the assessment on such property, with interest accrued to the
date of payment; except that no interest shall be charged if the entire assessment is paid
within 30 days after the adoption of this Resolution. Prepayment may also be made
after the certification of the assessment or first installment thereof by paying to the City
Treasurer/County Auditor the entire amount of the assessment remaining unpaid with
interest. In the case of a payment made before November 15, interest will be calculated
through December 31 of the year in which payment is made. If payment is made after
November 15, interest will be calculated through December 31 of the next succeeding
year.
The City Administrator shall transmit to the County Auditor a certified duplicate of the
attached assessment roll to be extended on the property tax lists of the County. Such
assessment shall be collected and paid over in the same manner as other municipal
taxes.
