Overview
In 1996, the City Council approved an administrative subdivision to subdivide a
53 acre parcel into three individual parcels. One of the three parcels totaling 28
acres was retained by the church for their development. The other two 10-acre
parcels were sold for residential development.
The church proposes two phases of construction, with Phase 1 including a multi-
purpose facility and a building with space for classrooms, offices, storage and
nursery space. Phase 2 of the church has not been detailed, however, a
conditional use permit will need to be reviewed and approved prior to
commencement of Phase 2 construction.
Analysis
Existing Conditions
The subject property is currently vacant and is composed of rolling topography
and oak savannah-type vegetation. A portion of the site appears to have been
farmed and is currently an open meadow. A barrier of coniferous trees have
been planted along the west edge of the property adjacent to County Road 1.
The topography increases from west to east, with a steep slope adjacent to the
north property line along 217th Avenue NW.
Proposed Site Plan
The initial construction is comprised of a multi-purpose facility measuring 64' x
96' and general purpose space comprised of offices, classrooms, storage and
restrooms, measuring approximately 149' x 140. This entire space is not taken
up by building, as there is a main entry courtyard and a small open space
adjacent to the multi-purpose room. Also proposed with phase 1 are two parking
areas, which contain 335 parking spaces. As this property is not within the urban
service district, they have identified on the property primary and secondary septic
system sites. Use of the church for daycare or a school will require a separate
conditional use permit.
Compliance with Ordinance Requirements
The proposed building is set back substantially from both the County Road 1 and
217th Avenue rights-of-way, preserving the trees along the west property line and
minimizing impacts to existing trees along the east side of the site. The building
exceeds the setback requirements for the A1 zoning district.
The proposed parking area also exceeds the minimum setback requirements of
the A1 district, being set back a minimum of 60 feet from both the County Road 1
and 217th Avenue rights-of-way. The proposed lot coverage is approximately

1.8 percent, with the combined parking and building hard surface coverage
totaling 9.8 percent.
The plan indicates 335 parking spaces. The code requires the following:
Worship hall: 182 spaces
Classrooms/nursery: 26 spaces
Offices: 5 spaces
TOTAL 213 spaces
The plan indicates adequate parking.
Building Elevations and Materials
The building will be constructed of differing materials. That portion of the building
housing the classrooms, office and nursery will be frame construction with vinyl
siding and asphalt shingles. The multi-purpose building will be constructed of
pre-cast concrete panels with a wide rake finish. A wide stripe painted white will
be formed toward the top of the panels.
Access and Parking
The City Engineer reviewed the access proposed for Phase 1 which is one
driveway onto 217th Avenue. In Phase 2, a second access onto County Road 1
is proposed. Any access onto County Road 1 will require a Sherburne County
access permit. The City Engineer recommends that the driveway onto 217th
Avenue be moved farther to the east in order to provide adequate stacking space
on 217th Avenue for cars leaving the church and exiting onto County Road 1.
The engineer also indicated that the access onto County Road 1 will more than
likely necessitate a turn lane and a bypass lane, however, no written comments
from the County have been received. In order to alleviate internal traffic conflicts,
it may be appropriate for the access onto County Road 1 to be installed as part of
Phase 1, instead of waiting for construction of Phase 2.
The site plan also indicates overflow stalls of approximately 156 spaces. The
ordinance requires parking to occur on approved hard surface which would
require removal of topsoil and vegetation in the installation of Class 5 or some
other suitable material to create these overflow parking areas.
Grading Plan
The City Engineer has reviewed the preliminary grading plan submitted by the
applicant and the following summarizes staff concerns:

a. The steep slope along 217th Avenue should be removed to allow a gradual
slope to the church parking facility. This will necessitate the removal of a
number of trees along this slope.

The drainage calculations have been received but were not reviewed. There
are a number of questions the engineer has in regard to the overall grading
plan and direction of flow for storm water from the hard surface areas. The
engineer is recommending that the plan be redefined to contain drainage on
the site of the church and not to rely on the county ditch system for storm
water conveyance.
c. The single proposed drainage pond is within the county right-of-way and
needs to be relocated outside of the right-of-way.
d. The phasing of the proposed grading is unclear from the submittal.
Landscape Plan
For this proposal, the ordinance requires 53 total trees, 26 overstory, 13
coniferous and 13 ornamental trees. The proposed plan indicates 12 trees, three
of which are overstory. The ordinance also allows credit for maintenance of
existing trees. A specific tree inventory was not submitted, however, so an
analysis of trees available for credit was not completed. The parking lot needs
additional landscaped islands in order to eliminate the mass of parking and
blacktop and to define the aisles more clearly (see attached amended landscape
plan). With the additional landscaped islands, staff feels that the new trees
required and the existing trees to be saved would meet the intent of the
ordinance.
Miscellaneous Site Details
Staff has the suggested the following improvements to the miscellaneous site
details to improve the overall functionality of the proposed plan:
The proposed five-foot sidewalk along the east side of the parking lot should
be widened to seven feet. Once cars overhang the five-foot sidewalk, the
sidewalk becomes very narrow for pedestrian movement.
b. A similar sidewalk should be constructed along the south side of the northerly
parking lot for ease of pedestrian movement in an east-west direction.

The dumpster is located in the far easterly edge of the north parking lot. It
appears that this location would be inconvenient for office users or those
using the multi-purpose room for elimination of trash and perhaps needs to be
relocated closer to the main structure.

One monument sign 42 square feet in area is proposed to be located at the
intersection of County Road 1 and 217th Avenue. It will need to be 10 feet from
the property lines. A small wall sign of individual letters is also proposed. All
signs will require permits.
Planning Commission Action
The Planning Commission conducted a public hearing regarding this request at
its July 25, 2000 meeting. Neighbors that spoke were concerned about the
levels of traffic on 217th Avenue during peak exit times of the church. The
neighbors also inquired if 217th Avenue would be paved in the future.
The Planning Commission voted unanimously to recommend approval of the
request. They also recommended additional landscape islands for the parking
area and that the County Road 1 access be constructed first. The applicant
indicated that they had no concerns with the staff recommendations.
Recommendation
Staff recommends that the City Council concur with the Planning Commission
recommendation and approve the request to construct a church with the
following conditions:
1. ALL COMMENTS OF THE CITY ENGINEER BE ADDRESSED.
THE LANDSCAPE PLAN SHALL BE REVISED AS INDICATED ON THE ATTACHED AMENDED
LANDSCAPE PLAN INCLUDING ADDITIONAL LANDSCAPE ISLANDS IN THE PARKING LOT.
THE PLAN SHALL INCLUDE AN INVENTORY OF TREES ELIGIBLE FOR CREDIT.
3. THE SITE PLAN SHALL BE AMENDED TO INCLUDE WIDER SIDEWALKS AND A NEW
SIDEWALK ALONG THE NORTHERLY PARKING AREA.
THE ACCESS TO COUNTY ROAD 1 SHALL BE CONSTRUCTED IN PHASE 1, AND THE
APPLICANT SHALL OBTAIN A SHERBURNE COUNTY ACCESS PERMIT AND COMPLY WITH
ALL CONDITIONS REQUIRED BY THAT PERMIT.
5. THE DRIVEWAY ON 21~H AVENUE SHALL BE RELOCATED AS FAR EAST AS POSSIBLE AND
CONSTRUCTED IN PHASE 2.
6. THE CURB AND GuI'rER AROUND THE PERIMETER OF THE PARKING LOT SHALL BE

Dear Mr. Wensman:
As requested, we have reviewed the River of Life Church submittal package. The package
consisted of a topographic survey prepared by Taylor Land Surveyors, Inc., site plan and
building drawings prepared by W.C.L. Associates, Inc., and a preliminary grading plan,
landscape plan, and preliminary sewage collection and disposal plan prepared by John Oliver
and Associates. Based on our review and comments received at the staff review meeting, we
would offer the following comments:
A. Topographic Survey
1. The site is approximately 30 acres in size. It is not clear if the site will be platted.
If it is to be platted, there are Iow areas in the site that should be covered by
drainage and utility easements because these areas will receive and hold runoff.
The other question we would have is: Are there any wetlands on the site? With
the rolling terrain and the size of the site, it is reasonable to expect that there
may be wetlands on the site. If there are wetlands, they should be delineated.
B. Site Plan Phase I and II
The driveway onto 217th Avenue should be moved further to the east. It is too
close to the intersection of CSAH 1 for the large amount of cars that will be
attempting to exit the parking lot in a short period of time.
217th Avenue should be paved from CSAH 1 past the driveway access.
The second phase shows an access onto CSAH 1. We assume that the County
will want a right turn lane and bypass lane for this access point to be permitted.
It is unclear from the drawings what the sight distances would be each direction
at this location.
As the traffic comes into the site from the 217th Avenue access point, an
additional island should be placed on the parking lane to direct traffic.

The temporary drop-off spot shown in front of the church building with Phase I is
in a poor location. This is the only spot for circular traffic around the large
parking island. If this is a drop-off location, there will be conflicts between
vehicles stopping to drop people off and vehicles wanting to circulate around the
parking stalls. Perhaps a couple of parking stalls in front of the church could be
deleted in Phase I and that area used for the drop-off site.
C. Preliminary Grading Plan
There is a relatively steep slope on the south side of 217th Avenue. The grading
plan shows leaving that in place. Phil Hals, Street Superintendent, has indicated
that he would like to see that slope removed with a gradual grade into the church
site.
We have just received drainage calculations and have not had time to review
them. However, the concept of the drainage of the site is questionable.
Basically, the drainage is being picked up in the northern parking lot and
conveyed to the County ditch. Then the County ditch is being used as a portion
of the storm drainage conveyance system to the southwest corner of the site
where a culvert directs drainage from the County ditch into a holding pond. We
question whether or not the County would even allow this type of drainage
pattern. Here are the other questions we have: Are there any culverts under
CSAH I that would outlet this drainage? What will happen if CSAH 1 is rebuilt
and the drainage ditch adjacent to it redefined? We believe that the drainage for
the church should be contained totally within its site and not rely on the County
ditch system.
The drainage pond in the southwest corner is partially within the County right-of-
way. This pond should be moved to the east to eliminate the encroachment into
the right-of-way. Also, the slopes of this pond are a 3:1. This is a pond that will
hold water and has no outlet. We would suggest that the pond's slopes be 4:1 or
flatter. Certainly with a thirty-acre site, there is enough room to move the area to
the east and allow a larger area with a flatter pond slope.
It is unclear whether the entire site will be graded at once or will be graded in
phases with the building. If it is to be graded in phases, there should be a phase
line shown on the grading plan. If it is to be graded in phases, the storm
drainage pond needs to be included with Phase I.
The grading plan shows concrete curb and gutter along the front of the church
and around the parking lot islands. The remaining perimeter of the parking area
is proposed to be bituminous berm. We question whether this is acceptable.
The site should be graded to eliminate the need for the catch basin immediately
to the east of the Phase I building. At a minimum, an emergency overflow
elevation needs to be shown here so that drainage beyond the catch basin
capacity will get into the parking lot area and not into the building.
With the access point onto CSAH 1, the grade is downhill to the road. The road
appears to be at a 967 elevation, and the lowest contour shown on the access is
966. It is unclear how drainage will be taken from the Iow point off of the road

into the pond. We would suggest that catch basins be placed on the culvert
under the road as a method to convey drainage from the access road to the
pond.
Bruce West, Fire Chief, indicated at the staff review meeting that the size of the
Phase II building will require a fire lane around its perimeter. This fire lane
should be planned for in the development and grading of the site.
No septic system calculations have been submitted at this time. These
calculations need to be submitted, reviewed, and approved prior to construction.

Dear Mr. Demele;
The access permit you recently appl:i, ed for has been field checked and created a lot of
discussion in our office. The access point on your drawing is acceptable as far as spacing
requin:ment and sight distance is concerned. The biggest problem we face is the curve just
north of217~ avenue and the pine t~¢¢s that limit sight distance. Another problem is limited
sight distance created by the hill on CSAH 1 to the south. Before I can issue aa access permit I
feel a sight visit would be beneficial, but not a necessity. I will grant the permit trader the
following conditions.
1. Right turn lanes must be constructed at both the proposed entrance and at 217t~ Avenue.
2. A bypass lane must be constmct.~:i at the proposed entrance.
3. No part of the retention pond ca~l be located within the right of way.
4. Slopcs on turn laaes and bypass lane must be 4:1. This will require tree cutting and possible
slope cascracnt from The Jeniors for thc construction of thc bypass lane.
5. You are responsible for the strip:ir~g removal and thc restriping of CSAH lin the
constlaaction area,
6. Pay for the signage changes required to make this segment safe for the traveling public.
We suggest moving the access on tc: 217m Avenue to thc east for greater stacking distance, We
also suggest a Stop Sign be placed a.t the main entrance. It may be purchased and installed by
