Request by the City of Elk River for an Administrative Subdivision

Request
The City requests that an administrative subdivision be granted to subdivide Lot
1, Block 1, Country Crossing Business Center 2nd Addition into two parcels.

Overview
The City acquired the subject property in 1997 and transferred ownership to the
Economic Development Authority (EDA). The EDA has been approached by
Gary Santwire, representing Track of the Wolf and Equity Management, Inc., to
purchase the lot for two industrial buildings, each on their own parcel. As the
parcel was acquired through tax increment financing, the purchase agreement
sets a value of zero dollars. As part of the sale of the property, the EDA agreed
to incur the costs for subdivision, including payment of storm water management
fees and park dedication fees.

Analysis
The subject parcel is approximately 4.3 acres in area and is proposed to be
subdivided in two parcels with approximately equal areas. The business park
zoning district requires a minimum lot area of 1.5 acres; therefore, the proposed
parcels meet the minimum area requirement. The business park district does not
have a minimum lot width, however, the lots are proposed to be 260 ft. x 359 ft.
(Parcel A) and 259 ft. x 363 ft. (Parcel B). The proposed development will have a
shared access at Joplin Street. No access will be permitted onto 183rd Avenue.
As neither park dedication nor storm water management fees were collected
when the lot was originally platted, staff is recommending that these fees be paid
for the entire 4.3 acres.
Recommendation
Staff recommends that the City Council approve the administrative subdivision
with two conditions:
The Economic Development Authority pay park dedication fees in the
amount of $2,000 per acre.
2. Storm Water Management Fees in the amount of $3,768.56 be paid.

RE: EASTERN AREA IMPROVEMENTS
Dear Council Members:
Last Tuesday, we received a call from Richard Graham, who lives on Tyler Street between 173rd
and 175th Avenues, stating he was out of water. This was quite a surpdse because the contractor
on the Eastern Area Improvement had not done any dewatering in the area for over two months.
Ralph Bader, our inspector, and the contractor visited the site that afternoon. They checked Mr.
Graham's well point and discovered there was no water in the bottom of it. Mr. Graham originally
had a well point of approximately 10 to 12 feet in depth. After dewatedng for the pipe construction
last year and this spdng, the contractor chose to ddve Mr. Graham a new well point which was
installed at a depth of approximately 22 feet. That well point seemed to operate fine after the
dewatedng operations ceased. We have checked with two of Mr. Graham's neighbors who were
also out of water dudng the dewatedng phase of the construction. One neighbor has a well point
that is approximately 18 to 20 feet deep. That neighbor indicated that they still have water but their
well has been pumping air, indicating that they are at the very top of the water table. The other
neighbor has a well point approximately 30 feet deep and has noticed no interruption in water
supply. We have also noted the water elevations in Klever's Marsh and local ponds in the area.
All of these water levels appear to be substantially lower than they were at this time last year.
We can find no reason due to construction activities and/or dewatering activities that would have
caused Mr. Graham's well to go dry at this point in time. With only a shallow well point into the
ground water, we believe Mr. Graham's water supply is very susceptible to drought conditions
which we have been experiencing the last couple of months. Mr. Graham has indicated to me that
he thinks the City should connect him to the City water system. I have responded to Mr. Graham
that I cannot do that on my own, and that I would bdng this issue to the City Council at Monday
evening's meeting. I will be available at Monday's meeting to discuss this issue further with the
City Council.

Subject: Tax Forfeit Land in the City of Elk River
Dear Ms. Hopkins:
The City Elk River is expressing its desire to purchase two parcels of land that are up for
tax forfeiture within the city. Those parcels are Outlot A, Barrington Place Estates (75-
530-0010) and Lot 1, Block 2, Country Crossing Business Center (75-575-0205). The
Elk River City Council also expressed interest in a parcel own by Mr. Hunt, but you
informed me that the taxes have since been paid.
It is my understanding that, if the two remaining parcels of interest to the city are not
redeemed by the owners or others with a vested interest in them, the~'will be appraised and
offered to the city without going through a sale. Please keep me informed on their status.
