Pursuant to due call and notice thereof, the meeting of the Elk River City Council
was called to order at 6:37 p.m, by Mayor Klinzing.

4. Open Mike
No one appeared for open mike.
5.1. Consider Amendment to Animal Ordinance
Police Chief Tom Zerwas indicated that the amendment to the animal ordinance
is an attempt to address citizen concerns regarding regulation of animal feces
and dogs on leashes in public places. He explained that the amendment requires
dogs to be on an 8-foot leash while in any public place. The amendment also
requires the person in custody of the dog having the responsibility of cleaning up
and disposing of animal feces in a sanitary manner.
Discussion was held regarding enforcement of the ordinance and the length of
the dog leash. Councilmember Motin indicated that the law does not address
retractable leashes. The Council questioned whether the ordinance addressed
dogs running at large on private property. It was the consensus of the council to
amend the language by adding "or private property of another" to 502,07 (1).
COUNCILMEMBER THOMPSON MOVED TO ADOPT ORDINANCE 00-15 AN
ORDINANCE AMENDING SECTION 502 OF THE ELK RIVER CITY CODE ENTITLED DOGS
AND OTHER ANIMALS. COUNClLMEMBER FARBER SECONDED THE MOTION. THE
MOTION CARRIED 4-1. COUNClLMEMBER MOTIN OPPOSED.

Councilmember Motin indicated that he voted against the motion as he feels it
infringes into the public's private realm.
Consider YMCA Letter Requestin.q Feasibility Study
The city administrator distributed the proposal for a feasibility study for the YMCA
facility locating in the city of Elk River. He noted that the city would be responsible
for one-half of the cost, which is $21,5[]0 plus expenses.
COUNClLMEMBER FARBER MOVED TO PARTICIPATE IN THE YMCA COMMUNITY
RESEARCH STUDY. COUNCILMEMBER MOTIN SECONDED THE MOTION. THE MOTION
CARRIED 5-0.
5.3A. Consider Bud,qet Debt Service Levy Adjustments
The city administrator reviewed the results of the 9/6/00 council worksession on
the budget and tax levy. He noted that the proposed budget stands at
$6,470,000 and the net levy at $4,457,247.

The finance director reviewed the debt service levy adjustments for taxes
payable in 2001.

Consider HRA Pay 2000 Tax Levy Resolution
COUNCILMEMBER FARBER MOVED TO ADOPT RESOLUTION 00-78 APPROVING THE
HOUSING AND REDEVELOPMENT AUTHORITY 2001 TAX LEVY. COUNCILMEMBER
MOTIN SECONDED THE MOTION. THE MOTION CARRIED 5-0.

Consider EDA Pay 2000 Tax Levy Resolution
COUNCILMEMBER THOMPSON MOVED TO ADOPT RESOLUTION 00-79 APPROVING
THE 2001 TAX LEVY FOR ECONOMIC DEVELOPMENT PURPOSES FOR THE ELK RIVER
ECONOMIC DEVELOPMENT AUTHORITY. COUNCILMEMBER DIETZ SECONDED THE
MOTION. THE MOTION CARRIED 5-0.
5.3D.
Consider City of Elk River Pay 2000 Tax Levy Resolution
COUNCILMEMBER THOMPSON MOVED TO ADOPT RESOLUTION 00-80 AUTHORIZING
THE PROPOSED PROPERTY TAX LEVY FOR COLLECTION IN 2001. COUNCILMEMBER
DIETZ SECONDED THE MOTION.
Mayor Klinzing explained that the consensus of the council is to raise the tax levy
by 1% with the funds going into a separate account marked for street repair and
maintenance. She noted that she is not in favor of increasing the tax levy by 1%.
THE MOTION CARRIED 4-1. MAYOR KLINZING OPPOSED.
5.3E. Set Date for Truth in Taxation Hearing
COUNCILMEMBER DIETZ MOVED TO CALL A SPECIAL MEETING OF THE CITY
COUNCIL FOR MONDAY DECEMBER 4, AT 6:00 P.M. TO HOLD THE CITY TRUTH IN
TAXATION PUBLIC HEARING ON THE TAX LEVY AND BUDGET WITH A CONTINUATION
DATE OF DECEMBER 11, 2000, AT 6:30 P.M. COUNCILMEMBER MOTIN SECONDED THE
MOTION. THE MOTION CARRIED 5-0.

Set Date for Bud.qet Hearing on Changes in Tax Rate
COUNCILMEMBER FARBER MOVED TO CALL A PUBLIC HEARING FOR OCTOBER 9,
2000, 6:30 P.M. TO RECEIVE INPUT ON THE 2001 TAX RATE. COUNClLMEMBER
THOMPSON SECONDED THE MOTION. THE MOTION CARRIED 5-0.
6. Other Business
6.1.
City Van
The council requested to use the city van to transport two councilmembers and
city staff to the airport.

6.2. Lowell and Main Street Stop Sign
Ralph Donais indicated that he missed open mike and requested an opportunity
to speak to the council. He noted his concern with the dangerous traffic situation
at Lowell and Main Street. He stated that he is concerned about the elderly
people trying to cross Main Street. He requested a 4-way stop in April 1999, but has
not received a response. He also indicated his concern with the dangerous
situation on Main Street at the Otsego Bridge. The City Administrator responded
that an analysis has been done in the area of Lowell and Main and that a 4-way
stop would not create a safe situation. He indicated that the city is proposing to
eliminate some parking on the street to help visibility at the intersection.
Councilmember Thompson suggested a crosswalk in the area. It was the
consensus of the council to have the city administrator discuss the possibility of a
crosswalk in the area with the city engineer. The council also requested an update
from the city engineer on Main Street options at the bridge and Highway 10.

There were no staff updates.
8. Adjournment
There being no further business, Mayor Klinzing adjourned the meeting of the Elk
River City Council at 7:20 p.m.
