Pursuant to due call and notice thereof, the meeting of the Elk River City Council
was called to order at 6:00 p.m. by Mayor Klinzing.

4.1. Community Recreation Update
Councilmember Motin updated the council on issues discussed at the September
18, 2000, Community Recreation Board Meeting. He noted that Hassan Township
is considering pulling out of the Joint Powers Agreement.

4.2. Utilities Commission Update
Councilmember Dietz updated the council on issues discussed at the September
13, 2000, Utilities Commission meeting. It was noted that the commission will be at
the 9/25/00 council meeting for a general discussion on issues of mutual interest.
4.3. Northstar Corridor Update
Scott Harlicker and Mayor Klinzing updated the council on issues discussed at the
September 7r~ Northstar Corridor Development Authority meeting. The Mayor
noted that both she and Councilmember Motin were favorably impressed with
the maintenance facility they toured on Thursday in Dallas.
5. Open Mike

Request by Marlene Hent.qes for Administrative Subdivision, Public Hearin.q - Case
No. AS 00-6
Scott Harlicker indicated that Marlene Hentges has requested an administrative
subdivision to subdivide a 24-acre parcel into two lots. The property is located at
the northeast corner of the intersection of 223rd Avenue and Quinn Street. A lot
width variance has already been approved for this property. Scoff Harlicker
reviewed the staff report on this request.
Mayor Klinzing opened the public hearing.
Ron Murphy, land surveyor representing the two property owners, indicated the
applicants concurred with all of staff's recommendations with the exception of
numbers 3 and 6. He indicated that these recommendations were made after
the Planning Commission recommendation. He indicated that number 3 requires
three man-made ponds that are not on the survey, be added on the survey and
included in the drainage easements. Item # 6 requires a 50-foot wide trail
easement on the southern boundary of the property. He indicated that the
owners do not believe the trail easement is appropriate or necessary.
David Anderson, Park and Recreation Commission representative stated that the
Park and Recreation Commission is requesting the easement to serve as a more
convenient future access to the trail system when and if future development
occurs,
Councilmember Farber stated he did not agree with the policy of charging park
dedication fee and obtaining trail easement dedication without payment to the
property owner.
Tom Thompson, 12899 217~ Avenue, had a question relating to the road drainage
and utility easements.
There being no further comments, Mayor Klinzing closed the public hearing.

SEPARATE PARCELS WITH THE CONDITIONS STATED IN STAFF'S MEMO AND WITH THE
DELETION OF #6 REFERRING TO THE 50 FOOT TRAIL EASEMENT.
ALL DRAINAGE AND UTILITY EASEMENTS SHALL BE RECORDED WITH THE
COUNTY.
THE ROADWAY EASEMENT AND SHARED ACCESS AGREEMENT SHALL BE
RECORDED WITH THE COUNTY.
THE THREE PONDS LOCATED ON PARCEL A SHALL BE SHOWN ON THE SURVEY
AND INCLUDED IN DRAINAGE EASEMENTS.
PARK AND RECREATION FEE OF $1400 SHALL BE PAID PRIOR TO RECORDING
THE SUBDIVISION.
SURFACE WATER MANAGEMENT FEE OF $73.02 SHALL BE PAID PRIOR TO
RECORDING THE SUBDIVISION.
COUNCILMEMBER FARBER SECONDED THE MOTION.
MAYOR KLINZING MOVED TO STRIKE ITEM #3 RELATING TO THE THREE PONDS.
COUNCILMEMBER THOMPSON SECONDED THE MOTION. THE AMENDMENT CARRIED 5-0.
THE MOTION AS AMENDED CARRIED 4-1. Councilmember Dietz opposed.
Request by John Bunkers for Conditional Use Permit to Amend PUD for Barrin.qton

Request by lSD # 728 for Conditional Use Permit for Interim Use (Park n.q Lot
Expansion~, Public Hearin.q - Case No. CU 00-31
Scott Harlicker indicated that the School District is requesting an interim use
permit to continue the use of a temporary parking lot connected to and west of
the existing paved parking lot between the Senior High and Vandenberge. This
parking area was constructed in the middle of the 1999-2000 school year. Scott
indicated that the Planning Commission recommended approval of the request
for one year, until June 15, 2001.
Mayor Klinzing opened the public hearing.
Tom Thompson, 12899 217rn Avenue felt the school should be spending its money
more wisely by requiring the students to take the bus.
There being no one else for or against the matter, Mayor Klinzing closed the
public hearing.
Councilmember Dietz questioned why this request wasn't presented to the
council before the beginning of the school year. It was noted that the School

District missed the August deadline for the Planning Commission. Councilmember
Dietz also indicated that he is not in favor of extending this request for more than
one year.
Councilmember Thompson suggested looking into using the ALC and Oak Knoll
parking lots and suggested putting in a crosswalk on County Road 1 between the
School Street and County Road 77 intersections.
COUNCILMEMBER THOMPSON MOVED TO APPROVE THE REQUEST BY THE SCHOOL
DISTRICT FOR AN INTERIM USE PERMIT FOR A TEMPORARY PARKING LOT WITH THE
FOLLOWING CONDITIONS:
1. THE INTERIM USE PERMIT IS EFFECTIVE FROM AUGUST 15, 2000 TO JUNE 15,
2001.
2. THE PARKING AREA IS TO BE SURFACED WITH CLASS 5.

Request by Dolphin Car Wash for Conditional Use Permit for Expansion, Public
Hearin.q
Scott Harlicker indicated that Dolphin Car Wash is requesting a conditional use
permit for an expansion to the existing car wash located at 516 Freeport Avenue,
Lot 3, Block 1, Elk River Plaza Third Addition. Scott Harlicker reviewed the staff
report on this issue.
Mayor Klinzing opened the public hearing. There being no one for or against the
matter, Mayor Klinzing closed the public hearing.
COUNCILMEMBER DIETZ MOVED TO APPROVE THE CONDITIONAL USE PERMIT
REQUESTED BY DOLPHIN CAR WASH TO' EXPAND THE EXISTING FACILITY WITH THE
FOLLOWING CONDITIONS:
1. THE NEW DRIVEWAY ON THE EAST SIDE OF THE BUILDING WILL HAVE TO
INCLUDE CURB AND GuI'rER.
2. THE EXTERIOR OF THE ADDITION SHALL MATCH THE EXISTING BUILDING.
3. AN ACCURATE PARKING LAYOUT WILL HAVE TO BE SHOWN ON THE SITE
PLAN.
4. A LANDSCAPE PLAN SHALL BE PROVIDED SHOWING THE EXISTING
LANDSCAPING ALONG THE EAST SIDE OF THE BUILDING RELOCATED EAST OF
THE NEW DRIVEWAY AND OTHER EXISTING LANDSCAPING.
5. THE EXISTING DUMPSTER ENCLOSURE WILL HAVE TO BE MOVED. THE NEW
LOCATION WILL HAVE TO BE SHOWN ON THE REVISED SITE PLAN.

6. THE COMPOSTING AREA ALONG THE SOUTH CURB LINE WILL HAVE TO BE

COUNCILMEMBER THOMPSON SECONDED THE MOTION. THE MOTION CARRIED 5-0.

Request by City of Elk River for Ordinance Amendment to Revise DesJ.qn
Standards in the Business Park Zonin.q District, Public Hearin.q, Case No. aA 00-7
Scott Harlicker indicated that the City of Elk River is requesting to amend the
design standards for the Business Park zoning district and to eliminate multi-tenant
buildings as a conditional use. Scott Harlicker reviewed the staff report on this
issue. The design standards issues included: 1.) load spaces/overhead doors and
2.) architectural design/building materials.
Mayor Klinzing opened the public hearing. There being no one for or against the
maurer, Mayor Klinzing closed the public hearing.
Planning Commission Representative Louise Kuester indicated that the Planning
Commission and staff spent many hours researching and discussing the proposed
amendments. She indicated that it was the Planning Commission's intent to
encourage creativity and design in commercial and industrial buildings.
Mayor Klinzing noted that she was aware of the many hours spent by the
Planning Commission on this issue and thanked the commission for their
recommendation.
COUNCILMEMBER MATIN MOVED TO ADOPT ORDINANCE 00-16 AMENDING
SECTION 900.12(16) PERTAINING TO BUSINESS PARK DISTRICT, CASE NO. aA 00-7.
COUNCILMEMBER DIETZ SECONDED THE MOTION. THE MOTION CARRIED 5-0.
7. Staff Updates
The city administrator indicated that the fire chief would have an update on the
Fire Station remodeling at the next council meeting.
8. Other Business
The city clerk informed the council of the Homecoming parade on October 6.
9. Adjournment
There being no further business, Mayor Klinzing adjourned the meeting of the Elk
River City Council at 7:05 p.m.
