09-07-1993 HR MIN • MEETING OF THE ELK RIVER HOUSING AND REDEVELOPMENT AUTHORITY HELD AT THE ELK RIVER CITY HALL MONDAY, SEPTEMBER 7, 1993 Members Present: Chair Hinkle, Commissioners Schuldt and Duitsman Members Absent: Commissioners Kropuenske and Toth Staff Present: Bill Rubin, Economic Development Coordinator; Patrick Klaers, Executive Director (4:55 p.m. ) 1. Call Meeting To Order Pursuant to due call and notice thereof, the meeting of the Elk River Housing and Redevelopment Authority was called to order at 5:45 p.m. by Chair Hinkle. 2. Consider 9/7/93 HRA Agenda COMMISSIONER DUITSMAN MOVED TO APPROVE THE 9/7/93 HRA AGENDA WITH THE FOLLOWING ADDITION: 9.1. COMMISSIONER DUITSMAN "OTHER BUSINESS I" COMMISSIONER SCHULDT SECONDED THE MOTION. THE MOTION CARRIED 3-0. 3. Consider 8/12/93 HRA Minutes COMMISSIONER DUITSMAN MOVED TO APPROVE THE 8/12/93 HRA MINUTES AS PRESENTED. COMMISSIONER SCHULDT SECONDED THE MOTION. THE MOTION CARRIED 3-0. 4. Open Mike No one appeared for this item. 5. Jackson Square Parking Lot Improvements Bill Rubin updated HRA Commissioners regarding the results of the September 1, 1993, Elk River Downtown Development Corporation meeting. The Development Corporation reviewed the various parking illustrations for the Jackson Square lot pursuant to the HRA's action at its 8/12/93 meeting. After reviewing the illustrations, the Development Corporation created its own hybrid design for the Jackson Square parking lot. This design included: parallel parking on the east side of Jackson Place; angled parking on the west side of Jackson Place; the creation of a "right turn only" bulb from Jackson Place to U.S. Highway 10 (Jackson Place continues as a one way, northbound street) ; additional stalls are created in the parking area near Highway 10 by 1111 virtue of the right turn only "bulb"; the balance of the parking stalls in the lot are angled; movement within the lot is counter-clockwise (that is a vehicle enters or exits onto Jackson Place from Main Housing and Redevelopment Authority Page 2 September 7, 1993 Street) ; vehicles may exit onto Highway 10, or may exit onto Jackson • Avenue (that is, "exit only") . The Development Corporation desired this layout because it helped retain the landscaping in the middle of Jackson Square, and, it retained the flagpole. In addition, the Development Corporation preferred angled parking in this lot. The Corporation went on record in support of this design. Commissioner Schuldt went on record as preferring more green space in Jackson Square regardless of the layout or design. COMMISSIONER DUITSMAN MOVED TO RECOMMEND TO THE ELK RIVER CITY COUNCIL THAT IT APPROVE THIS ILLUSTRATION FOR THE PARKING LOT IMPROVEMENTS PROPOSED AT JACKSON SQUARE. COMMISSIONER SCHULDT SECONDED THE MOTION. THE MOTION CARRIED 3-0. 6. Former Railroad Parking Lot Improvements The Elk River Downtown Development Corporation also reviewed proposed improvements to the former railroad parking lot that is bounded by Jackson Avenue, U.S. Highway 10, Hunts Feeds, and the railroad tracks. Two illustrations were presented to the Development Corporation; one included angled parking; and the second illustration included perpendicular parking. The Development Corporation went on record in favor of perpendicular • parking for the landscaping enhancements and other improvements proposed on this site. The Corporation voted to recommend the perpendicular layout to the Elk River HRA. COMMISSIONER SCHULDT MOVED TO RECOMMEND TO THE ELK RIVER CITY COUNCIL THAT IT APPROVE PERPENDICULAR PARKING STALLS AS PART OF ITS PROPOSED IMPROVEMENTS TO THE FORMER RAILROAD PARKING LOT BOUNDED BY JACKSON AVENUE, HIGHWAY 10, HUNTS FEEDS, AND THE RAILROAD TRACKS. COMMISSIONER DUITSMAN SECONDED THE MOTION. THE MOTION CARRIED 3-0. 7. Consider a Recommendation from the Elk River City Council to Fund a Portion of a Redevelopment Project at Main Street and Freeport Avenue Bill Rubin reviewed the status of this request with the HRA Commissioners. Following a public hearing on August 16, 1993, the Elk River City Council approved a modification to Tax Increment Financing Plans No. 1 and No 3. The modification resulted in a $50,000 amendment to Plans No. 1 and No. 3. Further, the modification enabled a developer, Mr. Dennis Chuba, to be reimbursed for certain eligible TIF expenditures as authorized by Minnesota Statutes. This reimbursement will be used to help support a proposed 8,000 square foot office townhouse facility at Main Street and Freeport Avenue. In a related motion, the Elk River City Council voted to recommend that the HRA consider funding 50% of the eligible redevelopment costs, up to a maximum of $25,000. Housing and Redevelopment Authority Page 3 September 7, 1993 • At this time, Commissioner Duitsman suggested that it would be appropriate to discuss his "Other Business I" item. He stated that if the HRA agreed to fund 50% of these costs, up to a maximum of $25,000, the City would retain additional funds from TIF Districts No. 1 and No. 3 for future projects such as a Business Park. In addition, Commissioner Duitsman suggested that the HRA consider funding an additional $10,000 of the redevelopment project, thereby increasing its contribution to $35,000. Chair Hinkle questioned whether the City Council should adopt a new motion requesting that the HRA participate more than the 50% of the eligible cost, up to a maximum of $25,000. Executive Director Klaers responded by stating that this action was up to the HRA. Chair Hinkle suggested an additional $10,000 may not affect the TIF project. However, he desired that the HRA build up its account for other future projects. Commissioner Duitsman stated that the request to the HRA for participation in the project at Main Street and Freeport Avenue came from him. Executive Director Klaers stated that requests like this likely will not be the last request from the City for assistance in future projects. Chair Hinkle stated that he preferred to go along with the Council's original motion funding 50% of the eligible cost. COMMISSIONER DUITSMAN MOVED TO AUTHORIZE THE EXPENDITURE OF UP TO $25,000 IN HRA FUNDS TO HELP FINANCE THE REIMBURSEMENT OF ELIGIBLE REDEVELOPMENT COSTS ASSOCIATED WITH THE PROJECT AT MAIN STREET AND FREEPORT AVENUE. COMMISSIONER SCHULDT SECONDED THE MOTION. THE MOTION CARRIED 3-0. 8. Elk River Limited Partnership Change Order Request HRA Commissioners reviewed a request from Elk Terrace Limited Partnership regarding a change order in the amount of $2,100 for costs over and above a budgeted amount to locate and cap a utility line. This cost was incurred as part of the site preparation activities associated with Tax Increment Financing District No. 10 - a 23 unit senior apartment project constructed at 4th Street and Holt Avenue. Because as-built drawings did not exist for 4th Street or Holt Avenue, the subcontractor incurred additional out-of-pocket costs to close a utility line. Requests for change orders like this are not extraordinary. The Mork Clinic redevelopmen 7ro4ecz resulted in similar requests. COMMISSIONER SCHULD'' MOVED TO APPROVE THE $2,100 CHANGE ORDER PAYABLE 1111 TO ELK TERRACE LIMITED PARTNERSHIP FOR COSTS INCURRED ENCLOSING A UTILITY LINE. COMMISSIONER DUITSMAN SECONDED THE MOTION.
