Attachments · Location Map Resolution No. 04 - · August 2, 2004 Memo from the City Engineer · Preliminary Plat · Final Plat (5 Sheets) Existing Conditions The parcel under consideration has a land area of 115.56 acres. Located on the subject property is an existing family farmstead located in the southwest corner of the site, with access from County Road 13 (Twin Lakes Road). Also located on the site are 10 wetland complexes of varying types, most of which are Type 2 that can be characterized as predominantly grass with no open water. There are two Type 3 open water wetlands located on the site. Two of the wetlands are Type 7 wetlands, which are essentially forested. Each of these wetland complexes are associated with tree cover and shrubby underbrush. The subject parcel is bounded by County Road 13 and five large lot single-family parcels on the west, Trott Brook Farms to the south, and vacant developable sites to the east, with the Trout Brook Estates August 16, 2004 Page 2 exception of the Ertel parcel which contains a single family dwelling at the far north point of the site. Judicial Ditch #1 (Trott Brook) borders the east side of the development. Overview On July 19, 2004, the City Council approved the preliminary plat of Trout Brook Estates with 148 lots. The approval was conditioned upon the extension of 188m Lane to the easterly edge of the plat. Final Plat The final plat request includes the "middle" portion of the development. This portion includes the entry from County Road 13 in the north and the lots located in the central portion of the development. The areas along the west, northeast, and east are not included in this plat. The City Engineer's memo addresses a number of issues, including providing a lot for a well site. This will increase the total number of lots in the development to 149. Elk River Municipal Utilities will acquire this lot for a well with no associated water treatment structure. A condition regarding this has been added to the approval. A portion of the park dedication requirements will be met by the dedication of Outlot E for park purposes. The remainder will be met with additional land and cash dedication in a future phase of the development. Recommendation Staff recommends that the City Council approve the final plat with the following conditions: e Se A DEVELOPERS AGREEMENT BE PREPARED AND EXECUTED OUTLINING THE TERMS AND CONDITIONS OF THE PLAT APPROVAL PRIOR TO RELEASING THE PLAT FOR RECORDING. SURFACE WATER MANAGEMENT FEE BE PAID IN THE AMOUNT REQUIRED BY THE CITY AT THE TIME OF FINAL PLAT PRIOR TO RELEASING THE PLAT FOR RECORDING. A SEALCOAT FEE IN THE AMOUNT TO BE DETERMINED BY THE CITY ENGINEER BE PAID PRIOR TO RELEASING THE PLAT FOR RECORDING. WATER ACCESSIBILITY FEES IN THE AMOUNT DETERMINED BY THE CITY BE PAID TO ELK RIVER MUNICIPAL UTILITIES PRIOR TO RELEASING THE PLAT FOR RECORDING. A LETTER OF CREDIT BE PROVIDED TO THE CITY IN THE AMOUNT OF 100% OF THE COSTS OF THE PUBLIC IMPROVEMENTS. e UPON COMPLETING ALL OF THE IMPROVEMENTS AND HAVING THEM ACCEPTED BY THE CITY, A WARRANTY BOND IN THE AMOUNT OF 25% OF THE IMPROVEMENT COSTS SHALL BE SUBMITTED TO THE CITY FOR THE PERIOD OF ONE YEAR. 9. ALL COMMENTS CONTAINED IN REBECCA HAUG'S MEMO DATED JUNE 16, 2004 SHALL BE ADDRESSED. 10. THE LETTER OF CREDIT SHALL COVER WETLAND MITIGATION. DRAINAGE EASEMENTS SHALL BE IN PLACE OVER THE WETLAND AND THE WETLAND MITIGATION AREAS. I I. RESTRICTIVE COVENANTS SHALL BE RECORDED ON THE WETLAND AND THE WETLAND MITIGATION AREAS. 12. A THREE YEAR MONITORING REPORT ON THE WETLAND MITIGATION IS REQUIRED. 13. Based on our review we would offer the following comments: 1. The plat was prepared by Pioneer Engineering. The plat consists of 79 residential lots plus a lot for the existing farmstead located in the southwest comer of the plat. o The first addition will have two means of ingress and egress. First, from Trott Brook Farms in the south, and second point will be a new access point along CSAH No. 13. Also, the road layout in the first addition will provide for a looped roadway system with the exception of one short cul-de-sac. The plat should provide access control along the CSAHNo. 13 frontage with the exception of where 188th Lane meets CSAH No. 13 and along the frontage of the existing operating farmstead. The property description on the dedication sheet of the plat appears to be somewhat different than the description on the preliminary plat previously approved. This should be reviewed and modified if necessary. We are aware that Bryan Adams has been dealing with the developer and their engineer relative to a site for a future well. If this area is agreed upon, it should be added to the first addkion plat as an additional lot than can be given to the Elk River Municipal Utilities. 6. The physical characteristics of the site, including, but not limited to, topography, soils, vegetation, susceptibility to erosion and siltation, susceptibility to flooding, and drainage are suitable for the type and density of development and uses contemplated. D. The proposed subdivision makes adequate provision for water supply, storm drainage, sewage transportation, erosion control and all other services, facilities and improvements otherwise required herein. The proposed subdivision will not cause substantial environmental damage. F. The proposed subdivision will not conflict with easements of record or with easements established by judgment of a court. G. The proposed subdivision will not have an undue or adverse impact on the reasonable development of neighboring land. Final plat approval is hereby granted for the Property, subject to the conditions set forth in attached Exhibit B. The officers of the City are hereby authorized, once the conditions set forth in Exhibit B are met and complied with, to sign the final plat for the Property and to issue a certified copy of this Resolution giving final approval of the plat. The owner of the Property is authorized to record the final plat as required by law and shall file proof of said recording with the City. No building permits will be issued for the Property until the final plat is recorded. This final plat approval shall expire one year from the date of this resolution if the final plat is not recorded within that time.
